DE LEO CHAIRMAN VICE-CHAIRMAN MEMBER ALTERNATE MINUTES OCTOBER 26,1990 The Board of Equalization convened at 9:00 a.m. with Chairman AC. Dalgleish, Vice- Chairman David G. Douglas, Member Archie Barber, Jr. and Clerk Dierdrei Keegan present. It was noted that the purpose of this meeting is to provide determinations regarding the parcels under appeal for the assessment year of 1990. The Board dispensed with the Minutes of previous meetings at this time and proceeded with the Determinations. It was also noted that on-site inspections were held on October 19, 22, and 24, 1990. MOTION Vice-Chairman Douglas moved that the Board suspend on-site inspec- tions of the property on the Bogachiel River in the West End as an inspection would not be safe, and the County does not know where the property lines are. Chairman Dalgleish seconded the motion which carried by unanimous vote. Board of Equalization Minutes: October 26, 1990 Page: 2 . MEETINGS Vice-Chairman Douglas explained that the Board has 87 parcels of land to complete decisions on, and that it will take a minimum of three days to complete these decisions. MOTION Vice-Chairman Douglas moved to continue meetings, for the purpose of making Board Determinations, on October 31, November 2, 7, and 9, 1990. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. DETERMINATIONS Gene Seton Discovery Timber Company BOE: 90-040-LO PN: 963304201 The Minutes of August 15, 1990 show the facts presented to the Board. Available data was reviewed and the Board noted that an on-site inspection was held October 19, 1990 with the Deputy Assessor present. MOTION Vice-Chairman Douglas moved to approve a reduction from $5,625 to $4,500 based on the rate of $1,000 a lot to be consistent with lot values in the adjacent Block 33. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. Marilyn Seton BOE: 90-041-LO PN: 964 201 001 The Minutes of August 15, 1990 show the facts presented to the Board. Available data was reviewed and the board noted that an on-site inspection was held October 19, 1990 with the Deputy Assessor present. MOTION Vice-Chainnan Douglas moved to approve a reduction from the base value of $3,250 per lot to $1,300 per lot due to low, wet topography and questionable perk conditions, (the reduction being increased to -60%). The suggested reduction of this parcel would be from $14,300 to $10,400. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. Available data was reviewed and the board noted that an on-site inspection was held October 19, 1990 with the Deputy Assessor present. E. 61 Cirque Drive Brinnon, W A 98320 BOE: 9O-048-LO PN: 602343 005 BOE: 90-050-LO PN: 602343 008 Jeff Chapman was present on behalf of the Assessor's Office. R. E. Duppenthaler did not appear for the re-hearing although notified by letter on October 10, 1990. Vice-Chairman Douglas explained that these two parcels are located above the State Park in Brinnon. An inspection took place on October 22, 1990, at which time the Park Ranger, Mr. Harry Lauch, met the Board and was cooperative throughout the inspection process. Further evidence has been accumulated regarding the property in question. Letter dated August 3, 1984 to Mr. Duppenthaler from Mr. Mike E. McKim, Superintendent of Land Acquisition re: Review of Request with the Administration and Advisement of the Outcome. Letter dated October 26, 1981 to Mr. Jim Waldo re: DosewaUips State Park Access for Property & Potential Extension to his Clients, Mr. and Mrs. Eubank; Personal, Non-Assignable Use of the Park Road to Previous Owners, Barnett and Turlis. Letter dated November 14, 1978 to Turlis and Barnett re: Permission Granted for Access to Property through Dosewallips State Park. The Board requested that in addition to acquiring these four letters as exhibits, the ranger confirmed that Mr. and Mrs. Duppenthaler do not have access to these two parcels of land through the Dosewallips State Park. However, the ranger investigated rifle shots and found hunters on an adjacent parcel which brought up the question: How did they get there? Entry to the property was made by a Pope & Talbot logging road, through Pope & Talbot owned timber land. Jeff Chapman explained that since the hearing of September 28, 1990, he has discovered, through Mike Elliott with Windemere Real Estate Sales Associates, that the Duppenthaler properties are for sale as five acre tracts. There is a five acre survey, as recorded with the Auditor's Office, Volume Four, Page Eleven. Mr. Chapman stated that the property is grandfathered in, and under new platting ordinances the other four parcels could be sold. Bonneville Power has access across the property, there is already an allowance of -15% for that, as well as a -25% reduction for accessibility. He pointed out that Tax 36 sold at a value of $16,930 and that the remaining four parcels should be of the same approximate value. Jeff Chapman recommended that the Board maintain the Decision previously made on September 28, 1990, but it should be noted that although there may not be a good, legal access to the property, the Realtors are still interested in it. Chairman Dalgleish agreed that the Decision of the Board should stand as prepared on September 28, 1990, This being a reduction on BOE: 90-048-LO from $15,480 to $11,610 at $3,000 per acre with the 40% reduction for lack of access and a further 15% reduction for the power easement. , Board of Equalization Minutes: October 26, 1990 Page: 5 DETERMINATIONS R. E. Duppenthaler BOE: 90-050-LO PN: 602343 008 The Minutes of September 28, and October 26, 1990 show the facts presented to the Board. Available data was reviewed and the Board noted that an on-site inspection was held on October 22, 1990 with the Deputy Assessor present. It was noted that the petitioner did not supply accurate information to the Board of Equalization on the land in question as the property was subdivided into five parcels, yet it was not presented to the Board as five acre parcels. MOTION Vice-Chairman Douglas noted that Exhibit IV of the Assessor's Office indicates that the land covered under BOE: 9O-050-LO and BOE: 90- 048-LO has been subdivided into five, five acre tracts of which tract #2 has been sold for about $17,500. Tracts 1, 3, 4, and 5, have not been sold due to continuing access and easement problems. It was further noted that the creation of this subdivision changes the land use category from large acreage to five acre tract development, which ultimately increases the valuation of the individual parcels within the total area; however, since the problem of access to the property is still open, Vice- Chairman Douglas moved to sustain the valuation of this property as reduced in the "counter appeal" from $47,310 to $37,850 on August 27, 1990. The valuation of what has become five parcels is reasonable in terms of the range of prices for parcels sold. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. R. E. Available data was reviewed and the Board noted that an on-site inspection was held on October 22, 1990 with the Deputy Assessor present. MOTION Vice-Chairman Douglas moved to sustain the valuation as previously ordered on September 28, 1990. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. Available data was reviewed and the Board noted that an on-site inspection was held on October 22, 1990 with the Deputy Assessor present. MOTION Vice-Chairman Douglas moved that on the basis of the October 22, 1990 inspection which confirmed the preservation of the parcel and of the septic drainage system, and recognizing that subparcel "C" is to all intents and purposes unbuildable due to topography and a solid rock foundation, and determining that there is clearly the capability for building sites with residential buildings for a subdivision not to exceed 10 bedrooms total (on septic system), and recognizing that the Assessor based the valuation on 1,000 front feet at $500 a front foot less 36% for excess front footage, and less 50% for the "developers discount" for a net valuation of $160,000, that the valuation be sustained at $160,000. Member Archie Barber, Jr. seconded the motion which carried by unanimous vote. OTHER BUSINESS OF THE BOARD There being no further business before the Board, the meeting adjourned until November 2, 1990 at which time the Board will continue making determinations.
