Broders were also present. Members William S. HEARINGS . Robert Kingsley was present on behalf of the Assessor's Office. Chairman James A. DeLeo explained the hearing process and swore them in. Mr. McMillen stated his wife sent in petitions for three parcels of property but they only want to proceed with the appeal for petition number BOE 92-27-R. They built a house on this property in 1976. Later U.S. geological publications indicated that there house is located on a slide hill. There were no problems for two years and then the house began to settle and cracks were showing throughout the house. They have a well approximately 400 feet behind the house and one day the water stopped. A landscape engineer determined that in the process of putting in the new road above the McMillen's property, the County neglected to install a culvert, therefore changing the watertlow of that area and causing the problems with their house. Mr. McMillen stated they have appealed to the Board of County Commissioners to fix the road but nothing has been done. Approximately five years ago he appealed to the Board of Equalization and the assessment was reduced by approximately 40%. The next time the property was assessed it had gone up again. He talked with the Assessor's office and it was again reduced. This time he hired an appraiser to assess the problems and do an engineering study to see what it would cost to rebuild or stabilize the house to bring it up to sellable standards. BOARD OF EQUALIZATION MEETING MINUTES - SEPTEMBER 10, 1992 Page 2 Mr. Kingsley stated after looking over the appraisal submitted by Mr. McMillen that he has no problem with reducing the value of the property to the total listed on the appraisal which is $123,000. After hearing the testimony member Dick Broders moved to accept the valuation of $123,000 agreed to by both parties (Later the Assessor reported the exact amount was reduced to $122,145.00). Vice-Chairman Bill Marlow seconded the motion which carried by a unanimous vote. Richard A. Malott Trustee Charmaine Seather P.O. Box 1067 Lynnwood, W A 930% BOE: 92-64-LO PN: 001 202 011 Ms. Seather was not present. Robert Shold was present on behalf of the Assessor's office. Mr. Shold reported on comparable sales. He stated this property has no legal access. The cost to cure this problem is not known, however, in the past the Assessor's office has given a 25% reduction in value in similar situations. Mr. Shold offered a 25% reduction to Ms. Seather but she feels 25 % is not enough. After hearing testimony of the Assessor's office the Board concurred they would conduct an inspection of the property and make a determination at a later date. Roan Erickson 29654 2nd Ave. SW Federal Way, WA 98023 BOE: 92-62-LO PN: 002 344 015 Mr. and Mrs. Erickson were present. Robert Kingsley was present on behalf of the Assessor's office. Chairman James A. DeLeo explained the hearing process and swore them in. Mr. Erickson presented photographs of the property to the Board and stated they feel it is over valued. He then reported on comparable sales in the area. Mr. Kingsley reported on other comparable sales in the area. After hearing the testimony of both parties the Board concurred they would conduct an inspection of the property and make a determination at a later date. DOE: 92-63-LO PN: 002 353 005 Mrs. Erickson presented photographs of the property to the Board and stated that the property does not have a view due to the height of trees on neighboring lots. She stated the Assessor's office did not send them copies of comparable sales to justify the valuation. BOARD OF EQUALIZATION MEETING MINUTES - SEPTEMBER 10, 1992 Page 3 . They feel there property was assessed on a rising market which has since declined. Mr. Kingsley stated he did not send any comparable sales because the only ones that were comparable occurred in 1988. Since there were no sales in this particular neighborhood, sales in the Gardiner area were used to value the property. After hearing the testimony of both parties the Board concurred they would conduct an inspection of the property and make a determination at a later date. Samuel H. Shinozati 11832 77th Ave. S. Seattle, WA 98110 BOE: 92-65-LO PN: 902 261 004 Mr. Shinozaki was present. Robert Kingsley was present on behalf of the Assessor's office. Chairman James A. DeLeo explained the hearing process and swore them in. Mr. Shinozaki stated several years ago he had the house which was on the property torn down because water was not accessible in that area of the property. He rents his property to a neighbor who uses it for cattle. The value has gone up approximately 50% and he cannot rent the property for as much as it would cost to cover the taxes. . Mr. Kingsley reported there was only one other sale that was comparable. Property is assessed by its size. Smaller parcels are generally worth more per acre than larger ones. A mathematical progression formula is used in assessing property with adjustments for topography. After hearing the testimony of both parties the Board concurred they wonld conduct an inspection of the property and make a determination at a later date. Meeting adjourned.
