Chairman James A. DeLeo called the meeting to order at 9:30 A.M.

DETERMINATION
At the meeting held on July 16, 1993 the Board heard a request from Paul Palmer to accept
his petition that was not timely filed. Mr. Palmer was told that his petition could not be
accepted for 1993 but that he could file it for 1994. Recently, a new policy was adopted
by the State Department of Revenue regarding appeals submitted after the filing deadline,
which requires that a "Determination Order" be sent to all petitioners whose requests to
appeal have been denied as a result of filing too late. Vice-Chairman Bill Marlow moved
that since Mr. Palmer did not meet the filing deadline the Board will not be able to accept
his petition for 1993. Member Dick Broders seconded the motion which carried by a
unanimous vote. A Determination Order will be sent to Mr. Palmer and a copy sent to the
Assessor.

Jean Mennella was present. Will Butterfield was present on behalf of the Assessor's office.
Chairman James A. DeLeo explained the hearing process and swore them in. Ms. Mennella
stated that a large portion of her property is in a gully. She learned from a neighbor that
if a large portion of your property is in a gully you can apply for an adjustment with the
Assessor's office. Since two (2) lots next to hers have received a 20% adjustment due to
the gully, she had a survey done and filed it with the Assessor's office. She is requesting
the land value be reduced to $18,160.

Mr. Butterfield stated the land is valued at $18,700 which is not much higher than she
requested. When a site is developed $4,000 is added to the land value for site
improvements such as utilities and water. The total land value is $22,700. Ms. Mennella
said she understood that. She used the $22,700 figure and deducted 20% to reach $18,160.
While other parcels is the area received an adjustment for the gully, the Assessor's office
felt that the gully did not affect Ms. Mennella's building capability.
After hearing the testimony of both parties the Board concurred that they would conduct an
inspection of the property and make a determination at a later date.

Mr. and Mrs. Booth were present. Mr. Kingsley was present on behalf of the Assessor's
office. Chairman James A. DeLeo explained the hearing process and swore them in. Mr.
Booth stated his property is currently valued at $155,965. It did not cost that much to
build and he doesn't feel he could sell it for what it cost to build. He is requesting the
value be reduced to $122,000.
Mr. Kingsley stated that Mr. Booth had noted on his appeal that he intended to submit
additional information which he did not do. Therefore, Mr. Kingsley did not know what he
would have to defend himself against so he did not prepare any information for the hearing.
He stated the Assessor's office is assumed to be correct until the Appellant has proven
otherwise. Now it's up to the Board to make the decision.
All information used at the hearing must be submitted to the Board of Equalization and the
Assessor no later than five (5) business days prior to the scheduled hearing. Therefore, with
the consent of the Assessor, Mr. Booth will submit additional information that breaks down
the costs of building his house.
After hearing the testimony of both parties the Board concurred that they would conduct an
inspection of the property and make a determinaion at a later date.

Joe Thompson was present. Will Butterfield was present on behalf of the Assessor's office.
Chairman James A. DeLeo explained the hearing process and swore them in. Mr. Thompson
stated that his property was previously valued at $11,000 and now it is $21,000, almost
double. He had it for sale for $30,000 but there were not any buyers. He said he could
accept the increase in value if he knew that every parcel in that area was increased by the
same amount.

Mr. Butterfield explained that the $21,000 value is made up of $17,000 for the land and
$4,000 for the site improvements. This parcel was also given a 15% adjustment for view
restriction. He stated the sales is this area substantiate the increase in value and the base
price for parcels in that area is $20,000. Every parcel in that area received an increase.
After hearing the testimony of both parties the Board concurred that they would conduct an
inspection of the property and make a determination at a later date.
Onsite inspections were scheduled for August 24, and 25, 1993.
