Jim Ramey was present. Bob Shold was present on behalf of the Assessor's office.
Chairman James A. DeLeo explained the hearing process and swore them in. Mr. Ramey,
owner of Penny Saver Deli Mart, stated that when he applied for a permit to build a small
motel on his end lot which is 55' by 52', he learned there is a 13.11' vertical sethack from
the powerlines on Kearney and Jefferson streets, leaving a lot of size 39' by 40' which is
too small to build on. He feels the two end lots are not good for anything except a
parking lot and if they were owned separately they would be less valuable.
Additionally, he had wanted to build a store in Hadlock about 4 years ago and when he
went to a bank to borrow money against this property he was turned down due to the fact
that the property had at one time contained underground storage tanks (USTs). It doesn't
matter to the bank whether the property is pollution free or not. As far as they are
concerned the property has no loan value.
Mr. Shold stated the Assessor's office did account for the depth of the vertical setback. The
property was valued as one parcel rather than on a per lot basis. Therefore, an adjustment
of 25% was applied to the whole parcel and not just the most narrow lots. Since the lots
are on a corner they are considered more valuable so a 25 % adjustment was added back into
the value for the location. The two adjustments offset each other making it appear as
though no adjustment was made for the vertical setback. He then presented comparable
sales.

After hearing the testimony of both parties the Board concurred that they would conduct an
inspection of the property and make a determination at a later date.
The Board scheduled onsite property inspections for October 28, 1993.
