Chairman William S. Marlow called the meeting to order at 9:30 a.m, in the presence of Vice-Chairman
Richard A. Broders and Member James A. DeLeo.

Richard Hoidal was present. Will Butterfield was present on behalf of the Assessor's office. Chairman
Marlow explained the hearing process and swore them in. Mr. Hoidal stated his waterfront property is
currently assessed at $50,000 and he is requesting it be reduced to $15,000. Under current setback
regulations it is not possible to build on the lot. There is approximately 30 feet of property between the
road and the edge of the bank. Regulations require a building setback of 100 feet from the edge of the
bank. The property has been listed with Windemere Real Estate for the past six months for $25,000. The
only potential sale fell through due to the building restrictions. He added that the comparable sales
presented by the Assessor's office are not comparable to his property. For these reasons he feels a
reduction should be made to the property value.
Will Butterfield stated that there was a wide range of value in the comparable sales used in the
assessment. Property has been developed in this area that the Assessor's office never thought could be.
They tried to make reasonable adjustments for all the property in the area, however, Mr. Hoidal has been
unable to provide any evidence from the building department that states why the property is unbuildable,
The Assessor's office sympathizes with Mr. Hoidal because the building department requires he get a
$5,000 engineering study before they will determine if the property is buildable or not. Further
adjustments could be made if Mr. Hoidal had stronger evidence, but it would be expensive proof for Mr.
Hoidal to provide.

After hearing the testimony of both parties the Board concurred that they would conduct an inspection of
the property and make a determination at a later date.
The Board scheduled property inspections for September 5 and 6, 1995 and hearings for September 7,
1995.
Meeting adjourned.
