DeLeo Chairman Vice-Chairman Member Chairman William S. Marlow called the meeting to order at 10:00 a.m. in the presence of Vice- Chairman Richard A. Broders and Member James A. DeLeo. ASSESSOR'S CERTIFICATE OF ASSESSMENT ROLLS The Board reviewed the Assessor's Cenijicate of Assessment Rolls to the County Board of Equalization subscribed and sworn to before the County Auditor. The total County assessed value as of August 12, 1996 is $1,994,545,775. Vice-Chairman Broders moved to accept the Assessor's Certificate of Assessment Rolls for 1996. Member DeLeo seconded the motion which carried by a unanimous vote. HEARING WAIVERS/ASSESSMENT CORRECTIONS Chairman Marlow read the following assessment correction into the record. APPELLANT Mary HilI- Tom Murkowski, P.O.A. APPEAL NO. BOE 96-41-R PARCEL NO. 30-37071 Vice-Chairman Broders moved to accept the assessment correction agreed to by both the Assessor's office and the appellant. Member DeLeo seconded the motion which carried by a unanimous vote. n '-J 100% Recycled Paper BOARD OF EQUALIZATION MEETING MINUTES - SEPTEMBER 6,1996 Page 2 HEARINGS Jack Hensel P.O. Box 610 Port Townsend, W A 98368 BOE: 96-36-R PN: 001182007 Jack Hensel was not present. Dennis Pownall represented the Assessor's office and was sworn in by Chairman Marlow. The property under appeal is located off of Loftus Road, Port Townsend. The appellant wrote on his petition that "The house is old and deteriorating and has had nothing done to it. Needs a new roof and major renovating. The market has not improved in the last 4 years and the property is not for sale at any price." He is requesting a reduction in value from $95,950 ($32,505 for the land and $63,445 for the improvements) to $77,505 ($32,505 for the land and $45,000 for the improvements). Mr. Pownall presented valuation worksheets and explained how the property was valued. The property contains several outbuildings (garagelshedslbamlchicken coops) which he increased in value and believes are still under valued. After reviewing all the information provided and hearing the testimony of Mr. Pownall, the Board concurred to conduct an inspection of the property and make a determination at a later date. Brad Malone 22508 - 80th Avenue W. Edmonds, W A 98026 BOE: 96-26-R PN: 921183022 Brad Malone was not present. Robert Kingsley represented the Assessor's office and was sworn in by Chairman Marlow. The property under appeal is located at 2901 Oak Bay Road. Mr. Malone's reason for appealing his property valuation is written on his petition. It states" 1985 mobile home, 2 bedroom, not 3 bedroom. Purchased in 1987 for $12,000. Made some minor improvements, but floor still warped in places and roofis saggy (structurally sound, but not cosmetically appealing). Mobile homes typically, unlike stick homes, depreciate rather than appreciate with time." He is requesting the current assessment of$124,840 ($94,500 for the land and $30,340 for the improvements) be reduced to $110,000 ($90,000 for the land and $20,000 for the improvements). Mr. Kingsley stated that the appellants claim that mobile homes depreciate over time is not substantiated by market sales. Mobile homes which are on property and set up with utilities continually sell for more than what they had sold for previously. He presented comparable sales which he believes support the current assessment. After reviewing all the information submitted and hearing the testimony ofMr. Kingsley, the Board concurred to conduct an inspection of the property and make a determination at a later date. BOARD OF EQUALIZATION MEETING MINUTES - SEPTEMBER 6, 1996 Page 3 MOTION FOR RECONSIDERATION Donalda Porter P.O. BOI 545 MoUala, OR 97038 BOE: 96-18-LO 96-19-LO PN: 954600 101 954 600 125 Donalda Porter was present. Robert Kingsley represented the Assessor's office. Chairman Marlow explained the hearing process and swore them in. The property under appeal is located off of Thorndyke Road. Ms. Porter stated that she is appealing her property value, based on new evidence which was not available at the time of the original hearing in September of 1995. The new evidence being presented to the Board, is the fact that Pope Resources harvested timber adjacent to her property. As a result of the logging, there is no longer a buffer of trees to block the wind. She had anticipated presenting a surveyor fee appraisal as additional evidence but is unable to do so at this time. Ms. Porter reiterated her concerns brought up at previous hearings. She believes that her property, which does not have clear title, should not be compared to, and assessed the same as property which has clear title and can be sold on the open market. She feels the current assessment of$62,590 for parcel number 954 600101 and $187,765 for parcel number 954 600 125 is too high. Ms. Porter is requesting an exemption from paying property taxes for four (4) years. Mr. Kingsley stated that under the laws of the State of Washington property must be valued as if it is owned fee simple. Giving an exemption from paying property taxes due to a clouded title would only set a precedent for other property owners who might purposely cloud their titles, just to get out of paying taxes. He believes the comparable sales which were presented at the original hearing support the property values. After hearing the testimony of both parties, the Board concurred to conduct an inspection of the property and make a determination at a later date. REQUEST TO RESCHEDULE MOTION FOR RECONSIDERATION and HEARING; James & Gloria Ramey, BOE#96-12-LO, Parcel Dumber 001343022 and BOE#96-13-C, Parcel number 957606901: James Ramey contacted the Clerk of the Board to request a second hearing be scheduled by the Board of Equalization so that he may present testimony regarding the parcels listed above. The Clerk contacted the Assessor Jack Westerman regarding this request. Mr. Westerman stated that he would not object to the Board scheduling another hearing. Hearing no objection from the Assessor, the Board concurred to grant Mr. Ramey's request. The hearing will take place on Wednesday, September 25, 1996 at 1 :00 p.m. BOARD OF EQUALIZATION MEETING MINUTES - SEPTEMBER 6, 1996 Page 4 The Board scheduled more appeals to be heard on September 25 and 26, 1996.
