Marlow Richard A. Broden James A. DeLeo Chairman Vice-Chairman Member Chairman William S. Marlow called the meeting to order at 9:30 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. APPROVAL OF MINUTES Vice-Chairman Broders moved to approve the minutes of September 25 and 26, and October 21, 1996 as presented. Member DeLeo seconded the motion which carried by a unanimous vote. DETERMINATIONS Chester Northup 724 W. Uncas Road Port Townsend, W A 98368 BOE: 96-01-R PN: 902261006 After reviewing all the information submitted by both parties and conducting an inspection of the property, the Board agreed that there is no market evidence proving that the condition of the neighboring property negatively affects the value of the Northup's property. Based on comparable sales information the property value is fair and equitable. Vice-Chairman Broders moved to sustain the Assessor's valuation of$103,640 for parcel number 902 261 006. Member DeLeo seconded the motion which carried by a unanimous vote. Member DeLeo moved to overrule the Assessor and reduce the property valuations as follows: Larry and Shirley Browning, Parcel number 931 600 110: Reduce total value to $378,907 ($135,375 for the land and $243,532 for the improvements) Elizabeth Kingsland, Parcel number 931600105; Reduce total value to $261,107 ($76,000 for the land and $185,107 for the improvements) Bernice Davis, Parcel number 931600 111; Reduce total value to $350,407 ($142,500 for the land and $207,907 for the improvements) Vice-Chairman Broders seconded the motion which carried by a unanimous vote. (See also minutes of August 12, 1996) The State Department of Revenue will be sent requests to reconvene the Board of Equalization for the purpose of equalizing the other units in this condominium. Mary Ann Besel 2386 Cleveland Street Port Townsend, W A 98368 BOE: 96-02-R PN: 001034048 The Board reviewed all the information submitted by both parties and conducted an inspection of the property. The Board agreed that the assessed value does not reflect market value, due to the pending sale of the appellant's property. Member DeLeo moved to overrule the Assessor on parcel number 001 034048 and reduce the total value to $145,000. Vice-Chairman Broders seconded the motion which carried by a unanimous vote. Vice- Chairman Broders moved to distribute the value as follows: $33,750 for the land and $111,250 for the improvements, Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of August 12, 1996) BOARD OF EQUALIZATION MINUTES - NOVEMBER 4, 1996 Page 3 James and Gloria Ramey 2010 Rosewood Port Townsend, W A 98368 BOE: 96-12-LO 96-13-C PN: 001343022 957 606 901 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board agreed that the problems with the property, which is currently the site of Penny Saver Deli Mart, definitely have a negative impact on the market value and therefore, warrant a reduction. Based on testimony at the hearing from both the appellant and the Assessor's representative, the Board believes that $100,000 is a fair adjustment, since the cost to cure the problem is unknown. Vice-Chairman Broders moved to overrule the Assessor and reduce only the land value of parcel number 957606901 by $100,000 for a new total valuation of $290,200 ($124,000 for the land and $166,200 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. The Board reviewed all of the information submitted for the appeal on parcel number 001 343 022 and conducted an inspection of the property. Based on the recommendation of the Assessor's representative the Board concurred to overrule the Assessor. Vice-Chairman Broders moved to reduce the land value to $35,000 which is consistent with similar property in the area. Member DeLeo seconded the motion which carried by a unanimous vote. Manhatton Drive Tempe, AZ 85282-5564 BOE: 96-38-LO PN: 953 101 701 Chairman Marlow excused himself from hearing or making any determination regarding this appeal, due to a conflict of interest. Vice-Chairman Broders stated that he and Member DeLeo reviewed all the information submitted by both parties and conducted an inspection of the property. Based on sales of comparable property it was agreed that the value is fair and equitable. Member DeLeo moved to sustain the Assessor's valuation of $12,000 for parcel number 953 101 701. Vice-Chairman Broders seconded the motion which carried by a unanimous vote. (See also minutes of September 25, 1996) Lan Erickson P.O. Box 131 Port Townsend, W A 98368 BOE: 96-47-R PN: 101324010 The Board reviewed all the information submitted by both parties, conducted an inspection of the property and determined that the assessed valuation is consistent with sales of comparable property in the area. Vice- Chairman Broders moved to sustain the Assessor's valuation of$383,235 for parcel number 101 324010. Member DeLeo seconded the motion which carried by a unanimous vote. Box 610 Port Townsend, W A 98368 BOE: 96-36-R PN: 001182007 The Board reviewed all the information submitted by both parties and conducted an inspection of the property. It was agreed that the improvements on the property are in fair shape and do not appear to be deteriorating. The appraiser adequately took into consideration the age of house, which is reflected in the assessment. Member DeLeo moved to sustain the Assessor's valuation of$95,950 for parcel number 001 182007. Vice-Chairman Broders seconded the motion which carried by a unanimous vote. (See also minutes of September 6, 1996) BOARD OF EQUALIZATION MINUTES - NOVEMBER 4, 1996 Page 4 Jennifer EUis P.O. Box 491 Port Hadlock, W A 98339 BOE: 96-05-P PN: 30-77574 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board agreed that sales indicate that mobile homes located on property and set up with utilities, are worth more than mobile homes that are not. Since this mobile home is currently located in a storage yard, the current assessment does not reflect market value. Based on this information and the recommendation of the Assessor's representative at the hearing, the Board overruled the Assessor and reduced the valuation of parcel number 30- 77574 to $9,000 by motion of Member DeLeo, which was seconded by Vice-Chairman Broders, and carried by a unanimous vote. Box 1143 Port Townsend, W A 98368 BOE: 96-46-R PN: 961 800 907 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board agreed that their duty is to insure that property is valued fairly and equitably among property owners. They further agreed that they would not rule on the matter regarding the assessment error, since it is unclear how the laws apply. Based on all the information submitted, the Board concurred that the property value is fair and equitable. Vice-Chairman Broders moved to sustain the Assessor's valuation of $66,790 for parcel number 961 800907. Member DeLeo seconded the motion which carried by a unanimous vote. Box 36 Port Hadlock, W A 98339 BOE: 96-03-LO PN: 960000 108 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board determined that the valuation is consistent with sales of comparable property in the area. Vice-Chairman Broders moved to sustain the Assessor's valuation of$48,000 for parcel number 960 000 108. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of September 26, 1996) Ruth Baldwin 101 Baldwin Road Nordland, W A 98358 BOE: 96-11-LO PN: 921 094026 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board concurred that the alternate method of valuation presented by the Assessor's representative at the hearing, best reflects market value of the property. Vice-Chairman Broders moved to overrule the Assessor's land value of parcel number 921 094026 and reduce it to $545,450. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of August 13, 1996) BOARD OF EQUALIZATION MINUTES - NOVEMBER 4, 1996 Page 5 Brad Malone 22508 - 80th Avenue W. Edmonds, W A 98026 BOE: 96-26-R PN: 921183022 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board concurred that the land value is fair, however, the improvement value may be high due to the poor condition of the mobile home. After further discussion the Board decided to reduce the percentage good factor from 75% to 60%. Vice-Chairman Broders moved to overrule the Assessor's valuation of parcel number 921 183022 and reduce only the improvement value from $30,340 to $24,271 for a new total valuation of$118,771. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of September 6, 1996) Bruno KoslotT 3740 Oak Bay Road Port Hadlock, W A 98339 BOE: 96-04-LO PN: 921194078 After reviewing all the information submitted by both parties and conducting an inspection of the property the Board concurred that based on comparable sales information the property value is fair and equitable. Vice- Chairman Broders moved to sustain the Assessor's valuation of$8,360 for parcel number 921 194078. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of August 14, 1996) Rocky Brook Hydroelectric 11225 SE 6th - Suite 100 Bellevue, W A 98004 BOE: 96-28-C PN: 602282004 The Board reviewed all the information submitted by both parties for this motion for reconsideration. A physical inspection of the property was not conducted as no changes have occurred since the time of the original appeal in 1994. The decision of the Board in 1994 was based on the same information the appellant presented. Since the appellant did not provide any new evidence, the Board concurred to sustain the assessed valuation of$543,670 for parcel number 602 282 004 by motion of Vice-Chairman Broders, which was seconded by Member DeLeo, and carried by a unanimous vote.
