Marlow called the meeting to order at 9:30 a.m. in the presence of Vice-Chairman Richard A. Broders. Member James A. DeLeo was not present. HEARING WAIVERS/ASSESSMENT CORRECTIONS Vice-Chairman Broders moved to accept petition withdrawals from the following individuals based on assessment corrections agreed to by the appellant and the Assessor's office: APPELLANT Alice L. Larkspur Daniel & Dorothy Kimble APPEAL NO. BOE 99-85-LO BOE 99-95-R PARCEL NO. 721 093 006 821 163009 Chairman Marlow seconded the motion. The motion carried. HEARING - CONTINUED Hervey K. Hicks 370 Dennis Blvd. Port Townsend, W A 98368 BOE: 99-93-E PN: 939 900 003 Mr. Hicks was present. Lead Property Technician Sherrie Shold represented the Assessor's office. After reviewing the hearing process Chairman Marlow swore them in. This appeal is based on the denial of a Senior Citizen and Disabled Persons Exemption by the Assessor's office for 1999. It is believed by the Assessor's office that Mr. Hicks does not reside at 370 Dennis Blvd., Port Townsend for a continuing period of six months or more. If that is the case, then Mr. Hicks would not quality to receive the Senior Citizen Exemption. He also prepared and read detailed written testimony in response to the Assessor's concerns as outlined in their written response to his appeal. Mr. Hicks noted that the signature on one (1) of the affidavits presented by the Assessor's office was not legible, so the identity of the individual could not be determined. The affidavits did not include a printed name, an address, or any means of identifying the authors. Mr. Hicks went to the Assessor's office and asked the identity of the individual who submitted the affidavit with the signature that was not readable and was told by Mr. Westerman that he could not give him the individuals name as he might attempt to influence the individual. How can the Board of Equalization accept affidavits with no identity or other relevant information that would allow anyone, including the Board, to know who submitted the affidavitsry Mr. Westerman stated that the individuals would be present at the hearing and they did not appear. He believes these affidavits were solicited by the Assessor's office, contrary to the statement of Mr. Westerman. Mr. Hicks discussed the encounters he has had with various neighbors which may explain why they would make false statements in the affidavits submitted to the Assessor's office. Neither affidavit is of any value in obtaining the truth. After responding to all of the concerns of the Assessor's office, Mr. Hicks concluded his testimony with some words he wrote about his terminating relationship titled "Good Night My Love" which describes why he will be in seclusion for the next two (2) years. Ms. Shold stated that the only additional information she has is that the Prosecuting Attorney determined that it was not necessary for the individuals who submitted the affidavits to appear in person at the hearing. It was felt that the affidavits were sufficient for the Board. After reviewing all the information submitted by both parties, the Board concurred that a physical inspection of the property is not necessary. A determination will be made at a later date.
