Marlow called the meeting to order at 10:00 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. APPROVAL OF MINUTES Vice-Chairman Broders moved to approve the minutes of August 22 and 29, 2000 as presented. Member DeLeo seconded the motion which carried by a unanimous vote. REQUEST FOR RECONVENING Kathy Wilson submitted a "Request for Reconvening" based on WAC 458-14-127 RECONVENED BOARDS- AUTHORITY (1)( c) which states that Boards of Equalization may reconvene on their own authority to hear requests or appeals concerning the current assessment year when the request or appeal is filed with the Board by April 30 of the tax year immediately following the Board's regularly convened session and when a bona fide purchaser or contract buyer of record has acquired an interest in real property subsequent to the first day of July and on or before December 31 of the assessment year and the sale price was less than ninety percent of the assessed value. Vice-Chairman Broders moved to approve the reconvening request. Member DeLeo seconded the motion which carried by a unanimous vote. DETERMINA nONS Vivian Lasher P.O. Vice-Chairman Broders moved to overrule the determination of the Assessor and reduce the valuation from $164,765 ($66,000 for the land and $98,765 for the improvements) to $152,765 ($54,000 for the land $98,765 for the improvements). It was agreed that the current assessment accurately reflects fair market value based on comparable property sales. Vice-Chairman Broders moved to sustain the Assessor's valuation of$91,290 ($46,800 for the land and $44,490 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. The value of the first 100 front feet will be reduced by 35%. This is in addition to the 15% reduction already given by the Assessor's office for depth. Vice-Chairman Broders moved to overrule the determination of the Assessor and reduce the value from $90,000 to $55,000. Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales of comparable property in the area, the current assessment accurately reflects fair market value. Vice-Chairman Broders moved to sustain the Assessor's valuation of $240,900 ($39,700 for the land and $201,200 for the improvements). It is the Board's finding that the Assessor's office is required by law to value one (I) acre as a separate building site, regardless of whether or not it can be sold separately. The total value ofthe property is fair and equitable. Vice-Chairman Broders moved to sustain the Assessor's valuation of$33,l85 ($12,380 for the land and $20,805 for the improvements). Vice-Chairman Broders moved to overrule the determination of the Assessor and reduce the valuation from $424,545 ($351, I 00 for the land and $73,445 for the improvements) to $324,545 ($251,100 for the land and $73,445 for the improvements). Vice-Chairman Broders moved to overrule the determination of the Assessor and reduce the valuation from $476,865 ($130,500 for the land and $346,365 for the improvements) to $455,980 ($130,500 for the land and $325,480 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of August 22, 2000) Based on sales of comparable properties in the area, the current assessments of the remaining parcels accurately reflect market value. It was noted that no documented evidence was presented to support the claim that parcel number 959 000 013 should receive the developer's discount. Without such clear, cogent, and convincing evidence, the Assessor's office is presumed to be correct.
