Marlow called the meeting to order at 10:00 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. APPROVAL OF MINUTES Vice-Chairman Broders moved to approve the minutes of September 19 and 25, 2000 as presented. Member DeLeo seconded the motion which carried by a unanimous vote. REQUEST FOR RECONVENING Bruce and Magdalena Henricus submitted a "Request for Reconvening" based on WAC 458-14-127 RECONVENED BOARDS-AUTHORITY (1)( c) which states that Boards of Equalization may reconvene on their own authority to hear requests or appeals concerning the current assessment year when the request or appeal is filed with the Board by April 30 of the tax year immediately following the Board's regularly convened session and when a bona fide purchaser or contract buyer of record has acquired an interest in real property subsequent to the first day of July and on or before December 31 of the assessment year and the sale price was less than ninety percent of the assessed value. Vice-Chairman Broders moved to approve the reconvening request. Member DeLeo seconded the motion which carried by a unanimous vote. DETERMINA nONS Richard Malott, Trustee P.O. Box 250 Nevada City, CA 95959 BOE: 00-53-LO PN: 001 202 011 After reviewing all the information submitted by both parties and conducting an inspection of the property, the Board concurred that based on sales of comparable property, the current assessment accurately reflects fair market value. In addition, the law states that parcels of property cannot legally be "landlocked". The access issue does not adversely affect the property value since there is a legal process for obtaining an easement. Vice-Chairman Broders moved to sustain the Assessor's valuation of$54,120. Member DeLeo seconded the motion which carried by a unanimous vote. It was ah'Teed that the BPA easement adversely affects the value of that parcel to the extent of25% ofthe residual acreage value. Vice- Chairman Broders moved to overrule the Assessor's valuation determination of$20,655 and reduce it to $17,490. Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales of comparable property the Board agreed that the current assessment of parcel number 602 344 015 accurately reflects fair market value. Vice-Chairman Broders moved to sustain the Assessor's valuation of $32,785. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of September ]9,2000) Steven R. Johnson 95 Timberline Road Port Townsend, W A 98368 BOE: 00-76-LO PN: 001 203 020 The Board reviewed all the information submitted by both parties and determined that the current assessment reflects fair market value based on sales of comparable property. Vice-Chairman Broders moved to sustain the Assessor's valuation of $27,020. Member DeLeo seconded the motion which carried by a unanimous vote. Box 1911 Valdez, AK 99686 BOE: 00-95-LO PN: 001064004 After reviewing all the information submitted by both parties and conducting an inspection of the property, the Board agreed that the current assessment reflects fair market value based on sales of comparable property. Since the appellant's property is not designated timber land, it cannot be valued as such and must be valued at highest and best use. Vice-Chairman Broders moved to sustain the Assessor's valuation of$146,7l5. Member DeLeo seconded the motion which carried by a unanimous vote.
