Marlow and Member James A. DeLeo.

After careful consideration of all the information submitted by both parties and conducting a physical inspection of
the property, the Board determined that the value of the 4.6 acres should be reduced by 50% based on sales of
similar properties. Vice-Chairman Marlow moved to overrule the Assessor's determination of value and reduce it
from $32,800 to $25,900. Member DeLeo seconded the motion which carried by a unanimous vote. (See also

the property, the Board determined that the current assessment accurately reflects fair market value. The Assessor's
reduction of 50% for limited view is reasonable and a further reduction is not warranted. Vice-Chairman Marlow
moved to sustain the Assessor's valuation of $203,600 ($38,500 for the land and $165,100 for the improvements).

The Board carefully reviewed all the information submitted by both parties and conducted a physical inspection of
the property. Vice-Chairman Marlow stated that per the Board's request, the appellant forwarded a copy of the
County's denial of their permit application to access Highway 20 which was made part of the record. It was agreed
that it is highly unlikely that this property could be developed, based on the topography, access and utility problems,
and the fact that it is located in a land slide hazard area. In order to address those issues which impact the market
value of this parcel, it was decided that the base land value be reduced by 95%. Vice-Chairman Marlow moved to
overrule the Assessor's determination of value and reduce it from $90,370 to $18,070. Member DeLeo seconded the
motion which carried by a unanimous vote. (See also minutes of September 24, 2001)

the property. It was determined that if the property was marketed for the current assessed value, it would sell,
notwithstanding, the unique design of the house or the fact that it is located in the co-housing community of
RoseWind, Vice-Chairman Marlow moved to sustain the Assessor's valuation of $246,400 ($47,900 for the land

After carefully reviewing all the information submitted by both parties and conducting a physical inspection of the
property, the Board determined that regardless of any intrinsic value the property may have to individual members,
the fact that it is a separate parcel, obligates the Assessor's office to value the property at its highest and best use
according to its zoning designation. While the property is not currently being used for commercial purposes, it is
zoned commercial and based on commercial property sales, the valuation is fair and equitable. Vice-Chairman
Marlow moved to sustain the Assessor's valuation of $47,500. Member DeLeo seconded the motion which carried

The Board carefully reviewed all the information submitted by both parties and conducted a physical inspection of
the property. While the Board members may share many of the viewpoints and issues of concern brought up by the
appellant during the hearing, those matters are of a legislative nature and therefore, should be directed to the

appropriate authority. The function of the Board of Equalization is to insure property values are fair and equitable
based on sales of similar property. Property in Port Townsend which is similar to the appellant's property has sold
for equal or greater amounts. This indicates that the current assessment reflects fair market value and must be
upheld. Vice-Chairman Marlow moved to sustain the Assessor's valuation of $336,600 ($104,160 for the land and
$232,440 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See

property, the Board concurred that the evidence does not support a finding that the Assessor's valuation is
substantially incorrect. The varying views of each lot do not adversely affect the value of the property as a whole
parcel. Vice-Chairman Marlow moved to sustain the Assessor's valuation of$504,535 ($267,875 for the land and

of 10% and parcel number 954 000 301 should reflect an adjustment of20%. Vice-Chairman Marlow moved to
sustain the Assessor's valuation of $35,000 for parcel number 954 000 101; overrule the Assessor's determination of
value for parcel number 954 000 201 and reduce it from $35,000 to $31,500; and overrule the Assessor's
. determination of value for parcel number 954 000 301 and reduce it from $35,000 to $28,000. Member DeLeo

The appellant asked that the current valuation be sustained in order to proceed with filing an appeal to the
Washington State Board of Tax Appeals. Based on the appellant's request and the fact that no evidence was
provided to support a determination that the Assessor's valuation is substantially incorrect, Vice-Chairman Marlow
