Marlow called the meeting to order at 9:00 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. APPROVAL OF MINUTES Vice-Chairman Broders moved to approve the minutes of September 20, 2004 as presented. Member DeLeo seconded the motion which carried by a unanimous vote. ASSESSOR'S CERTIFICATE OF NEW CONSTRUCTION VALUE The Board reviewed the Assessor's Certificate of New Construction Value. Vice-Chairman Broders moved to accept the Assessor's Certificate of New Construction Value for 2004 in the amount of $93,193,090. Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales of comparable property, and lacking sufficient documented evidence showing that the issues brought up by the appellant negatively affect the market value ofthis parcel, the Board is compelled to uphold the current assessed valuation. Vice-Chairman Broders moved to sustain the valuation of $90,205 for parcel #947800003 (land only) and $128,005 ($88,005 for the land and $40,000 for the improvements) for parcel #947 800 002. Member DeLeo seconded the motion which carried by a unanimous vote. No documented evidence was presented by the appellant showing that the market value of their parcel is negatively affected by the eroding bluff, man-made berm, or the large house constructed on the neighboring parcel. While the Board is sympathetic to the appellant's financial burden, State law requires that all property must be assessed at 100% of its fair market value. Based on sales of comparable property in the area, the Board is compelled to uphold the current assessed valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of $361,280 ($310,700 for the land and $50,580 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales which have occurred in the area, and lacking sufficient documented evidence showing that the property carmot be developed, or that a small building site negatively impacts the market value of this property, the Board is compelled to uphold the current assessed valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of$50,000 (land only) for parcel #938400525 and $20,000 (land only) for parcel #938 400 545. Laporte, IN 46350 BOE: 04-37-R PN: 939 900 020 After reviewing all the information submitted by both parties and conducting a physical inspection of the property, the Board agreed that based on sales of comparable properties in the area, the current valuation is fair and equitable. Vice-Chairman Broders moved to sustain the current assessed value of$108,265 ($70,000 for the land and $38,265 for the improvements). Wilson, Trustee 51 Spruce Drive Port Townsend, W A 98368 BOE: 04-27-R PN: 940500014 The Board considered all the information submitted by both parties and conducted a physical inspection of the property. The fact that two of the lots are bound together with the third lot has been adequately addressed by the Assessor's office with a reduction in value of50% for the two lots which carmot be sold separately. Based on sales of properties in the area, the current valuation ofthis parcel is fair and equitable. Vice-Chairman Broders moved to sustain the Assessor's valuation of $405,310 ($105,000 for the land and $300,310 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. According to State law all property must be valued at 100% of its fair market value. Based on sales of comparable property in the area, the current assessed value is fair and equitable. Vice- Chairman Broders moved to sustain the Assessor's valuation of$101,620 ($65,000 for the land and $36,620 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 11, 2004) Tim & Kim McGnire 152 Douglas Way Port Townsend, W A 98368 DOE: 04-28-R PN: 959 000 013 After reviewing all the information submitted by both parties and conducting a physical inspection of the property, the Board determined that based on sales information the current assessed value represents fair market value. Without sufficient documented evidence showing that the appellant's concerns negatively affect the market value of this parcel, the Board is compelled to uphold the Assessor's current valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of $284,760 ($106,505 for the land and $178,255 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 11, 2004) Richard O. & Niki Walcome 240 Airport Road Port Townsend, W A 98368 BOE: 04-24-R PN: 001 283 001 After reviewing all the information submitted by both parties and conducting a physical inspection of the property, the Board concurred that based on sales information the current assessed value represents fair market value if placed for sale on the open market. Without sufficient documented evidence showing that the appellant's concerns negatively affect the market value ofthis parcel, the Board is compelled to uphold the Assessor's current valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of $283,925 ($109,960 for the land and $ $173,965 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. Based on the purchase price for this property, and lacking sufficient documented evidence showing that the appellant's concerns about water and power negatively affect the market value ofthis parcel, the Board is compelled to uphold the Assessor's current valuation. Without sufficient documented evidence showing that the noise issue negatively affects the market value of this parcel, the Board is compelled to uphold the Assessor's current valuation. Vice- Chairman Broders moved to sustain the Assessor's valuation of$173,795 ($44,300 for the land and $129,495 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 11, 2004) REQUEST FOR WAIVER OF FILING DEADLINE William & Lorna McKinley, Trustees 50-1 Harborview Drive Port Townsend, W A 98368 BOE: 04-40-R PN: 964900017 The Board waived the filing deadline for the appellant and accepted their petition based on the showing of good cause for late filing as outlined in RCW 84.40.038 (2)(b) and WAC 458-14-056 (3)(b)(i),(ii) and (iii). The petitioners were able to provide copies of airline tickets which showed that they were absent from the address where they would normally receive the assessment or value change notice, and were absent for mor<;l than fifteen of the thirty days prior to the filing deadline. Vice-Chairman Broders moved to accept the petition of William & Lorna McKinely. Member DeLeo seconded the motion which carried by a unanimous vote. Meeting adjourned. ArEST: !
