BACKGROUND:
•2 May 2024 Auditor memorandum:
➢Referenced RCW 36.96 –Dissolution of Inactive Special Purpose
Districts
➢Recommended the Board of County Commissioners consider declaring
the district inactive and dissolved
➢Formed in 1919
➢Purpose was to manage a drainage and flood
control system
➢The district is a special purpose district
organized under Chapters 85.06.010 and
85.38.180, RCW
➢No district funds collected since mid-1960
➢District has been inactive since 1974 when
the governing board resigned

Criteria in RCW 36.96.010 required to be declared
inactive:
(3) "Inactive" means that a special purpose district is characterized by any of the
following criteria:
(a) Has not carried out any of the special purposes or functions for which it was
formed within the preceding consecutive five-year period;
(b) No election has been held for the purpose of electing a member of the governing
body within the preceding consecutive seven-year period or, in those instances where
members of the governing body are appointed and not elected, where no member of
the governing body has been appointed within the preceding seven-year period; or
(c) The special purpose district has been determined to be unauditable by the state
auditor;
BOARD OF COUNTY COMMISSIONER OPTIONS:
➢Declare the district inactive and leave it in place, as is
➢Declare the district inactive and dissolve it
➢Reactive the district in its current form
➢Repurpose the district to add irrigation/watershed
management/improvement to its mission
CONSIDERATIONS:
➢What do district residents want for the district?
➢There is an effort underway to determine this.
➢Does the Board have enough information to decide
which course of action to take?
RECOMMENDATION:
➢Declare the district inactive and keep it in its current form
➢Continue to gather information regarding the district and
what residents of the district wish to happen
➢Schedule another public hearing for a final decision
regarding the future of the district
