When a eo-partnership is a bidder, the agent who signs the proposal for the firm shall also show the names and addresses of the individuals composing the firm. When a corporation is a bidder, the person signing for it shall state under the laws of what State the corporation -was chartered, and the name, title, and address of the officer having authority under the by-laws to; sign contraet~: The proposal shall also bear the seal of the corporation, attested by its secretary. Anyone signing the proposal as agent must file with it legal evidence of his authority to do so. Postoffice address, county and state must be given after each sig- nature. IRREGULAR PROPOSALS: Any omission of prices on items shown in the proposal forms, or any addition in writing to the form of the bid, or any condition, limitation, or provision will be liable to render the proposal informal and to cause its rejection. The contract should not be filled in until- after the awardal. CONTRACT PAYMEIV~7C~j r~~ The contract will be a h~ contract. Monthly estimates of the work done will be made by the Engineer, and there will be retained from moneys due on such estimates a sum equal to fifteen (15) per cent of the value of all work performed, the total estimate of which is Two Hundred Thousand Dollars ($200,0001 and less, and ten (10) per cent of the value of all work performed,the total estimate of which is in excess of Two Hundred Thousand Dollars ($200,000).. E%AMINATION OF PLANS, SPECIFICATIONS AND SITE: Bidders are required before submitting bids to examine carefully the site of the proposed work; as well as the •proposal, plans, specifications, and contract form for the improvement contemplated. Profession of ignorance regarding the requirements of the work will in no way serve to modify the pro- visions of the contract. MATERIAL SAMPLES Before any contract is awarded, the bidder may be required to furnish a complete statement of the origin, composition and manufacture of any or all materials to be used in the construction of the roadway, together with the samples, which samples may be subjected to the tests provided for in these specifications to determine their quality and fitness for the work. AWARD OF CONTRACT: The award of the contract, if made, will be to the lowest responsible bidder. No award will be made until all necessary investigations are made as to the responsibility of the bidder. RETURN OF PROPOSAL GUARANTY; As soon as the bid prices have been compared, the Board will return the guaranty deposits ac~om- panying such of the proposals as in its judgment would not be considered in making the award. E%ECUTION OF CONTRACT: The individual, firm or corporation to whom or to which the contract has been awarded, shall sign the necessary agreements, entering into a contract with the County, and furnish bond upon the forms prepared by the Engineer, and return them to the Board within twenty (20) days from date of notice of award. No proposal shall be considered binding upon the County prior to the execution of the contract. (2) The Contractor shall provide and be at the expense of all materials, labor, carriage, tools, implements and conveniences and things of every description that may be requisite for the trans- fer of materials and for improving, construction and completion of the above described work. (3) It is understood and agreed by and between the parties hereto that the work included in this contract is to be done under the direction and supervision of the .County Engineer or Con- struction Engineer, who may be designated as the Engineer in Charge by the Board, and hereinafter called the Engineer, and his decision as to the true construction and meaning of the profiles, maps, plans and specifications and estimates shall be final. It is also understood and agreed that such additional drawings and explanations as may be necessary to detail and illustrate the work, are to be furnished by the Engineer, and the Contractor agrees to conform to and abide by the same, so far as may be consistent with the purpose and intent of the original drawings and specifications. (4) Should the Contractor at any time refuse or neglect to supply a sufficiency of properly skilled workmen or of materials of the proper quality, or fail in any respect to prosecute the work with promptness and diligence, or fail in the performance of any of the agreements herein con- tained, the Board shall be at liberty, after three days' written notice to the Contractor, to provide any such labor or materials and to deduct the cost thereof from any money then due or thereafter to become due to the Contractor under this contract, and if the Engineer shall certify that such refusal, neglect or failure is sufficient ground for such action, the Board may; by written notice, terminate the employment of the Contractor for the said work, and enter upon the premises and take possession of all the materials, tools and appliances thereon, for the purpose of completing the work included in this contract, and employ by contract, or otherwise, any other person or per- sons to finish the work, and provide the materials therefor, and in ease of such discontinuance of the employment of the Contractor, he shall not be entitled to receive any further balance of the amount to be paid under this contract, until the work shall be wholly finished, at which time. if the unpaid balance of _the amount to be paid under this contract shall exceed the expense incurred by the Board in finishing the work, such excess shall be paid by the Board to the Contractor, but if such expense shall exceed such unpaid balance, the Contractor shall pay the difference to the Board. All " requests for extension of time must be accompanied by an agreement of the surety on the bond of the Contractor for such extension. In case an extension of time is asked for by the Contractor and granted by the BOARD, the Contractor agrees to reimburse .. (6) Time shall be of the essence of this contract on the part of the Contractor, and in case the Contractor shall fail in the due performance of the contract by and at. the time herein mentioned, or by and at such time to which the period of completion may have been .extended, he hall be ^liabpl~+e to pay to the Board as and for liquidated damages and not as penalty, the sum of.~ ~~ ..~.Q~~~1.4 for each and every day which may elapse between the appointed and aetnal time of comple- tion, which said sum is hereby. agreed upon, fixed and determined as the damage that will be suf- fered by such failure to complete within the time named; and the Board may deduct the same from the amount due or to become due to the Contractor and such payment or deductions shall not in any degree release the Contractor from the further obligations and penalties in respect to the fulfill- ment of the entire contract, nor any right which the Board might have to claim, sue for and recover compensation and damages for non-performance of this contract. __ _ _ _ _ - - Payment shall be made for avork and labor performed and material furnished under this contract accoxdin~ to the attached sah~dul€ of prices. -- ' ' ,• there shall be reserved from the moneys earned by theZC~vntraetor on estimates during the progress of the improvement or work, a sum equal to f~£-- ~. -(~6~b-~-per cent of -such estimates, said sum to be retained by the State, County, City, Town, District, Board, or other public body, as the case may be, as a trust fund for the protection and payment of any person or persons, mechanic, sub-contractor or materialman who shall perform any labor upon such contract or the doing of said work, and,all persons who shall supply such person or persons or sub- contractors with provisions and supplies for the carrying on of such work. Said fund. shall be re- tained for a period of thirty (30) days following the final acceptance of -said improvement or work as completed, and every person performing labor or furnishing supplies towards the completion of said improvement or work -shall have a lien upon said fund so reserved, provided such notice of lien of such claimant shall be given in the manner and within the time provided in Section 1161 of Rem- ington & Ballinger's Annotated Code. and Statutes of Washington as now existing and in accord- ance with any amendments that may hereafter be made thereto : PROVIDED, HOWEVER, that where in any improvement or work the contract price shall exceed two hundred thousand dollars .($200,000), but ten per cent. (10°fo) shall be reserved on estimates in excess of said sum or where the aggregate of previous estimates equals or exceeds said amount. In case of lump sum price a B2 schedule of prices to be used as a basis of partial payments shall be based upon the prices in the preliminary estimate, which prices shall be increased or reduced in the same ratio that the lump sum price bears fo the preliminary estimate. The certificate of the State Highway Engineer, certifying that the entire work has been completed in accordance with the contract, specifications, plan, map and profile shall constitute final acceptance of the work. Final payment shall be made as follows: After the expiration of thirty (30) days following the final acceptance of said improvement or work, -and the expiration of the time for filing of lien claims, as herein provided, said reserve, or all amounts thereof in excess of sufficient sum to meet and discharge the claims of materialmen and laborers who have filed their claims, as provided for in Section 1 of this Act, (Chapter 166, Laws of 1921), together with a sum sufficient to defray the cost of such action and to pay attorneys' fees, shall be paid to said Contractor. IT IS MUTUALLY AGREED between the parties hereto that any payments or contributions due or required by Chapter 74, of the Law of 1911, (Industrial Insurance Act) from the County of by virtue of or bn account of any of the work covered by this contract, may be d d eted from any payment or payments made to the Contractor herein, and that the sum or sums so deducted shall be determined each month upon the basis of the work. of said month, and shall be made upon the proper written order and demand of the Industrial Insurance Commission, a notice of which order and demand shall be served upon the said Contractor prior to said deduc- tion. IT IS FURTHER AGREED that the Contractor herein, or any sub-contractor or contractors employed by them shall be subject to the provisions of said act as provided and required in Sec- tion 17 thereof. (8) All payments under this contract shall be made by the State Treasurer from the Permanent Highway Fund, upon warrants of the State Auditor issued upon presentation of proper vouchers by the Contractor, said vouchers to be approved by the Board, and no payment shall be made for any alteration made during .the .progress of the work unless the same shall have been approved b~~ the Board of County Commissioners by resolution, and a copy of ~ said resolution shall have bee~~ transmitted to the State Highway Engineer, and in_ case of final payment, to be accompanied by certificate of the State Highway Engineer as aforesaid. No warrant, however, can be issued for any purpose against the Permanent Highway Fund unless there be sufficient money to pay such warrant iri such fund to the credit of~~County, PROVIDED, HOWEVER, that in case the Permanent Highway herein desc be hall be improved or constructed pursuant to a petition as provided in Section 2, Chapter 35, of the Laws of 1911 as amended, then and in that event, such portion of the total expense under this contract. as shall be chargeable to the property within the improvement district shall be paid from the General Road and Bridge Fund of the County upon the presentation of proper vouchers therefor. (9) No alterations shall be made in the work shown and described in the plans and specifica- tions, except upon the written order of the Engineer and as provided hereinbefore and when so made the value of the work so added or omitted shall•be computed by the Engineer, and the amount so certified shall be final and conclusive and binding upon the .Contractor, and shall be added to or deducted from the contract price. The schedule of unit or itemized prices hereto attached is intended to form a part of this eon= tract and shall constitute, as far as possible, the basis upon which the value of all work added or omitted shall be computed. (10) The Contractor-shall provide sufficient, safe and proper facilities at all times for the in- spection of the work, by the Board or its authorized representative. The said Contractor shall fur- nish, without charge, to the said Board or its authorized representatives, samples of cement or other materials used .in construction, as said samples may be required, in order. that the character of such materials may be determined. All materials and methods shall be subject to the approval of the Engineer. B3 ~y Defective work or material may be condemned by the Engineer at any time before the final -~ acceptance of the work. Notice of condemnation shall be given in writing by the Engineer. Such "- condemned work shall be immediately •removed or disposed of to the satisfaction of the Engineer. Failure or neglect on the part of the Engineer to condemn unsatisfactory material or to reject in- ferior workmanship shall in no way release the Contractor, nor shall it be construed to mean the acceptance of such work nor shall the final acceptance bar the County of - - ---- - ------ from re- covering damages in ease fraud was practiced. Time lost in replacing such improper work shall furnish no ground to the Contractor for claiming an extension of time for the completion of the work. Incompetent, careless or negligent employes shall be forthwith discharged by the Contractor upon the written request of the Board, or Engineer in charge, and' failure to comply with such re- quest shall be sufficient ground for the termination of the contract, as provided for in this Article or Article 4 hereof. Should the Contractor be delayed in the prosecution or completion of the work by the act, ne- glect or default of the Board or the Engineer in ^harge, or of any other contractor employed upon the work, or by any damage caused by fire or other casualty for which the Contractor is not re- sponsible, or by combined action of workmen in no way caused by or resulting from default or col- lusion on the part of the Contractor, then the time herein fixed for the completion. of the work shall be extended for a period equivalent to the time lost by reason of any or all of .the causes afore- said, which extended period shall be determined and fixed by the Board, but no such allowance shall be made unless a claim therefor is presented in writing to the Board within ten {10) days after the oecurenee of such delay. (11) It is further mutually agreed between the parties hereto that no certificate given or pay- ment made under this contract, except the final certificate or final payment, shall be evidence of the performance of this contract either wholly or in part, and that no payment made shall be con- strued to be an acceptance of defective work or improper materials which may appear within two (2) years after such payments. (12) The work and material covered by this contract shall be at the sole risk of the Contract- or until the same shall have been finally accepted by the Engineer, Board and the State Highway Engineer, and any damage or loss that may occur or result to the same prior to the final com- pletion and acceptance of said work by the Engineer, Board and the State Highway Engineer, shall fall upon and be made good by the said Contractor. (13) The Contractor shall not let, assign or transfer this contract, or any interest therein, or sublet the work herein provided to be done, or any part thereof, without the consent of the Board. The Contractor shall file with ,the Board a duplicate of all sub-contracts made by him as aforesaid. The. Contractor shall give his personal attention to the work at all times and be present either in person or by duly authorized representative on the site of the work continually during its prog- ress and shall receive instructions from the Engineer in charge. Any sub-contractor shall be con- sidered the agent of the Contractor and the latter shall be responsible for any indebtedness incurred by such agent. If any sub-contractor fails to perform hip work in a satisfactory manner his sub- contract may be terminated by the Board. ' (14) The Contractor shall be liable for all damages and injury which shall be caused or which shall occur to any person or persons or property whatsoever by reason of any negligence of said Contractor or any of• his servants, employes or sub-contractors, or by reason of any breach or viola- tion of any of the provisions of this agreement or any of his duties or obligations thereunder. The Contractor shall also assume all liability for and protect the Board from any damages or claims arising from the use of any patented articles or devices in any part of the work. •. _ (15) It is a part of the public policy of the State of Washington that all work by contract . or day labor done for it or any political subdivision created by its law, shall be performed in work days of not more than eight hours each, except in cases of extraordinary emergency. In ease of the violation of the provisions of this article, the Board shall have the right to cancel this contract without notice, and shall have the right to complete the work in the manner provided in Article 4 hereof. If the Board shall have reason to believe that the security on said bond has become impaired since the execution thereof, or is insufficient, it may require the Contract- or to furnish other or additional security. (17) The Board hereby promises and agrees with the Contractor to employ and does employ him to provide the materials and to do and to cause to be done the work upon said Permanent Highway, and to complete -and finish -the same according to the plans and 'specifications and the terms and conditions herein contained and referred to for the price aforesaid, and hereby contracts to pay the same at the time• and in the manner and upon the conditions above set forth. The Contractor for himself, and for his heirs, successors, executors, administrators and assigns, does hereby agree'to the full performance of all the covenants herei contained upon his -part. STATE HIGI3WAY ENGINEER: The State Highway Engineer of the State of Washington. BOARD: The Board of County Commissioners of:. ....... .......... ......:..:.County. ENGINEER: County or Construction Engineer, hi d ly authorized assistants, by whom all explanaitons and directions necessary for the satisfactory prosecution and completion of the work described in these specifications will be given. CONTIIACTOR: The person, firm, co-partnership, or corporation, ~ or any lawful agent of such person, firm, partnership, or corporation, constituting one of the principals to the contract and under- taking to perform the work herein specified. CONTRACT: The agreement between the contractor and the County of .... .. ......... ..:... acting through the Board of County Commisioners. The contract shall inel e t e ecepted "Pro- posal," "Plans," "Specifications" and "Contract Bond," also any and all s pplemental agreements which reasonably could- be required to complete the construction of the work in a substantial and ac- ceptable manner. PROPOSAL: The written offer, or copy thereof, of the bidder to perform the work proposed. PLANS: The officially aproved plans, profiles, cross. sections and other drawings, or exact reproductions thereof, which show the location, character, dimensions and details of the work to be done and which are to be considered in the contract as co-ordinate with these specifications. SPECYFICATIONS: The directions, provisions, and requrements contained herein, together with all written agreements made or to be made, pertaining to the method and manner of performing the work, or to the quantities and. qualities of materials to be furnished under the contract. CONTRACT BOND : The approved form of security furnished by the Contractor and hs surety as a guarantee of good faith on the part of the Contractor to execute the work in accordance with the terms • of the contract. LABORATORY: The laboratories of the State Highway Department, or other laboratories desig- nated by the Engineer. PROPOSAL GUARANTEE: The security designated in the proposal to be furnished by the bid- der as a guarantee of good faith to enter into contract with the County of.. _.. ..........., if the work contemplated is awarded to him. C1 _:' ~ r~ . ,~ - .~ ~~~ ~- SPECIFICATIONS GENERAL PROVISIONS PERMITS AND LICENSES The Contractor shall procure all permits and licenses, pay all charges and fees, and give all notices necessary and incident to the due and lawful prosecution of the work. LAWS AFFECTING PUBLYC WORg: Attention is particularly called to the clearing and grubbing specifications and also to section three, Chapter 33 of the Session Laws of 1917, with reference to the burning of .refuse, timber, brush, and debris from clearing and grubbing operations. The Washington Forest Fire Association and the State Fire Warden all insist that the statutes covering the matter be strictly enforced, and that the refuse from clearing and grubbing on public roads be properly disposed of and the premises be left in a neat and presentable condition. The provisions of the specifications and the statutes, therefore, will be strictly enforced. INTERPRETATION OF PLANS : Any work or materials that may have been accidentally emitted in the description. of the work, but which is clearly implied, shall be furnished by the Contractor as if it had been specifically stated. Work shown en the plans and not mentioned in the specifications, and vice versa, will be done as if shown on both, when and where required. In case of discrepancy on any plans or drawings between the scaled and figured dimensions, the figured dimensions shall govern. In case of ambiguity of ex- pression in the specifications, or doubt as to the correct interpretation of the same, the .matter shall be submitted to the Engineer, whose decision shall be final. CONNECTIONS WITH INTERSECTING ROADS OR DRIVEWAYS: The Contractor shall, for the same compensation as for other grading, grade a safe, proper, and workmanlike connection with all intersecting public or private roads or driveways, according to the direction of the Engineer. UNAUTHORIZED WORg:- Work done without lines and grades being given, work done beyond .the lines and grades shown on the plans or as given, except as herein provided, or any extra work done or any deviation made from the plans and specifications, without written authority, will be considered unauthorized and at the expense of the. Contractor, and wili not be measured or paid for by the County. Work so done may be ordered removed and replaced at the Contractor's expense. LIMITATION OF OPERATIONS The Contractor shall so conduct his operations as to have under construction no greater length or amount of work than he can prosecute vigorously, and vs~hen in the judgment of the Engineer such operations are being so spread out as to be detrimental to such vigorous prosecution, thereby endan- gering the completion of the improvement within the contract time, he shall so advise the Contractor in writing. METHOD OF SERVING NOTICE: Any written notice to the Contractor which may be requisite under these specifications, may be served on said Contractor, either personally or by mail, or by leaving the same at his last known place of residence. CO-OPERATION OF CONTRACTOR REQUIRED The Contractor shall keep a copy of the plans and specifications on the work. DETOURS: The Contractor shall at all times conduct the work in such a manner as to insure the least obstruc- tion to traffic practicable. C2 = ~,-;~~ The Contractor shall provide and maintain at his own expense in passable condition • such tem- porary highways and bridges as may be necessary to accommodate the traffic diverted from the roadway or bridge under construction and shall provide and maintain in a safe condition temporary approaches to and crossing of intersecting highways except that the Contractor will not be required to build and maintain temporary detours around bridges more than twenty (20) feet in length, nor around a closed section of highway having a length of more than 500 feet, unless such detours are provided for in the specifications or on the plans, or ordered in writing as force account by the Engi- neer. . BARRICADES On all improvements the Contractor shall. provide, erect, and maintain at his own expense all neces- sary, barricades of sufficient strength for the purpose intended, suitable and sufficient lights, danger signals and signs and shall take all necessary precaution for the protection of the work and safety of the public. Any part of the work damaged from traffic or-other causes, occurring prior to its official acceptance shall be replaced and made good by the Contractor at his own expense in a manner satis- factory to the Engineer. Two barricades two hundred feet apart shall be constructed at each point where a highway is closed to traffic. The first or outside barricade shall be constructed of light lumber in such a manner that it will not seriously injure or wreck a car. The second barricade shall be constructed of heavy material in such a manner as to be difficult to remove or break down. On all barricades and obstructions there shall be kept burning at night from sunset `until sunrise two red lights, four to five feet apart, both of which can be plainly seen at a point in the road three hundred feet from the barrier. The lights shall be placed on the .first barricade. In daytime the Contractor shall place a red flag two feet square in a conspicuous place in the road three hundred feet from the barrier. FENCES In passing through private property the Contractor must keep up at his own expense such.. tempor- ary fences as shall be necessary for the preservation of the crops, and protection of the property, and the Contractor shall be liable for any and all damages resulting from anon-compliance with this re- quirement. PRESERVATION OF PROPERTY: The Contractor shall preserve from damage all property along the line of work, the removal or destruction of which is not called for by the plans. This applies to public utilities, trees, monuments, fences, etc., and wherever such property is damaged, due to the activities of the Contractor, it shall be immediately restored to its original condition by the Contractor and at his own expense. USE OF EXPLOSIVES When the use of explosives is necessary for the. prosecution of the work, the Contractors shall use the utmost care, so as not to endanger life or property, and whenever directed, the number and size of charges shall be reduced. TESTING MATERIALS Tests of materials to be used in the work shall be made in the laboratory designated in the "Def- inition of Terms," whenever such tests are required by the specifications or by the Engineer. The Contractor shall furnish the Engineer, without charge, samples of materials used in the work as such samples are required. 11~Iaterials may be rejected by the Engineer whenever, in his judgment, they fail to meet the re- quirements of the specifications, and when so rejected, they shall be immediately removed from the work. STORAGE OF MATERIALS: All materials intended for use in the work shall be so stored by the Contractor as to prevent damage from exposure to the elements, from admixture of foreign material, or from any other cause. Materials found on the work, especially timber and existing structures, which are required to be removed but which are not used in the improvement by the Contractor, as provided above, shall be put into shape to be handled economically and neatly piled along the right of way, as herein provided, or as the Engineer may direct. LINES, GRADES AND MEASUREMENTS The Contractor will be governed by such lines, grades, and measurements as may be given by the Engineer in laying out the work and by the Engineer's determination of quantities of work per- formed. Stakes and markings set or made by the Engineer to mark out the work, shall be carefully preserved by the Contractor; in case such stakes, markings, or references are carelessly destroyed or defaced by the Contractor or his employees, the expense of replacing same will be .deducted from . any money due or to become due the Contractor. CROWN OR CROSS SECTION OF ROADWAY: The .cross-section of the roadway shall be as shown in the plans, except at intersecting highways on curves or wherever to insure correct drainage or for other reasons, changes may be directed. AUTHORITY AND DUTIES OF INSPECTORS The Engineer may appoint assistants to inspect all materials used and all work done. Such inspection may extend to any or all parts of the work and to the preparation or manufacture of the materials to be used. The assistants will not be authorized to revoke, alter, enlarge or relax the pro- visions of these specifications. An assistant is placed on the work to set the necessary lines and grades and to keep the Engineer informed as to the progress of the work and the manner in which it is being done ; also to call the attention of the Contractor to any infringements upon plans or speci- fications. Iie will not be authorized to approve or accept any portion of the work or to issue in- structions contrary to the plans and specifications. The assistant will have authority to reject defective material and to suspend any work that is being improperly done, subject to the final decision of the Engineer.- The assistant will exercise such additional authority as may from time to time be especially delegated to him by the Engineer. FINAL CLEANING UP The Contractor shall remove, at his own expense, from the highway and from the adjoining property, temporary structures and all rubbish and surplus materials resulting from the work which may have accumulated during its prosecution. All work, inchiding shoulders, ditches, and slopes, shall be neatly dressed and cleaned up on completion, according to the Engineer's direction, and shall be left in a neat and orderly condition. , SUSPENSION OF WORg: The Engineer shall have the authority to suspend the work on account of the default of the Contractor, unfavorable weather conditions, or any other condition which, in the judgment of the Engineer makes it impossible to secure first-class results. The Contractor shall immediately respect the written order of the Engineer to suspend work wholly or on any particular section of the road. If it becomes necessary to stop the work for a protracted period, the Contractor shall take every precaution to prevent any damage or unreasonable deterioration of the work during the time it is closed down. The Contractor shall not make any claim or demand for damage by reason of such suspensions. in the work, but the date for completion will be extended by the period of such suspen- sion. MEASUREMENT OF QUANTITIES The determination of the quantities of work performed will be made by the Engineer based on measurements taken by him or his assistants. In computing volumes, the method of, average end area C4 s ;, :>~ -.; ^ will be used for egeavation and embankment. Other quantities will be computed in the units used in the proposal form, according to well organized engineering principles, and no local rules or cus- toms will be considered. NO WAIVER OF LEt~AL $It~HTS: Should an error be discovered in the estimate, or should conclusive proofs of dishonesty on the part of the Contractor be discovered in the work, after the final payment has been made, the Board reserves the right to claim and recover by process of law, such sums as may be sufficient to correct. the error, or make good the defects in the work resulting from the Contractor's dishonesty. FURNISHINC$ DATA: The Contractor shall furnish the Engineer with such data as may be requured to enable him to keep an accurate cost of the work as it progresses. He shall furnish a statement of the number and rate of pay of all laborers and teams employed each day upon the work; also copies of all equip- ment and material bills, or a statement in.lieu thereof, showing the amount of equipment and ma- terials received on the work and cost thereof, together with such other information as may be re- quired. CONSTRUCTION CAMPS: The Contractor herein is required and he hereby agrees to conduct and maintain all con- struction camps in accordance with the rules and regulations of the County and State Board of $ealth, and it is understood that the work done under this contract will not be accepted by the County until all camps have been placed and left in a sanitary condition. Special reference is here- by made to the rules and regulations of the State Board of Health pertaining to Industrial camps. " 08 :,. ~ , ,; r:.~; r %- t,' .. f fs.`- - ~ - SPECIFICATIONS .r=` CONSTRUCTION DETAILS CLEARING, GRUBBING AND REMOVAL OF STRUCTURES CLEARING : 3a The right of way will in general be cleared to the width of feet on each side of the center line, but will be cleared to greater widths where ordered by the Engineer. Clearing outside of the right of way shall be done under the. same specifications and be paid for at the same price as clearing within the right of way. The clearing will in all eases conform to the stakes set by the Engineer. Within the .lines staked by .the Engineer, except as hereinafter specified, all trees, brush, logs, and other organic matter shall be removed and burned within the right of way. No stump shall be left in the cleared space with a height greater than its diameter. Under fills of more thah five (5) feet the tops of stumps shall be cut at least. two feet below. grade.. Trees designated by the Engineer shall be left standing and care shall be exercised by the Contractor not to damage such trees in falling adjacent timber or in burning. All merchantable timber shall be cut into logs of standard lengths and decked along the side of the clearing or within the right of way outside of the clearing, free from rubbish and worthless logs. At such times as the State or Government authorities prohibit burning, the refuse from the clear- ing shall be piled along the sides of the right of way at points where its burning will not damage standing timber, and when such prohibition is removed the piles of refuse shall be burned. Clearing must be carried on and completed at least one-half mile ahead of the grading. Clearing will be paid for by the acre for the area actually 'cleared by the Contractor in accord- ance with the stakes set by the Engineer. ~ GRUBBING All stumps and roots embedded in the ground within the areas included between the slope stakes of wll excavation, and all embankments of five (5) feet or less, shall be removed and burned within the right of way. At such times as the State or. Government authorities prohibit burning, the refuse from the grubbing shall be piled along the sides of the right of way at points where its burn- ing will not damage standing timber, and when such prohibition is removed, the piles of refuse shall be burned. Grubbing will be paid for by the acre for the area actually grubbed by the Contractor within the limits above specified. REMOVAL OF STRUCTURES Where the Contractor is required to remove from the right of way buildings, fences, puncheon, telephone poles, irrigation flumes, or other structures. not constituting a part of the roadway, and the removal of which is not elsewhere provided for in these specifications or the plans,. such work will be considered as extra work, and shall be done according to the Engineer's instructions and paid for as provided under the clause covering extra work. In case structures constituting a part of the roadway, such as existing culverts or bridges, are re- quired to be torn out and removed, such work will be considered as incidental to the structures which replace the ones removed and will not be paid for separately, and compensation for their .removal will be regarded as included in the payment for .new structures, unless otherwise specifically provided in the Special Provisions or on the plans. ~~ D1 i ":'' .. ~ - a J GRADING DESCRIPTION: Under this head is included all excavations and embankments required for the formation of the roadbed, the digging of drain ditches and cutting new channels for streams, either within or without the right of way, excavations or embankments for bridges, culverts, and other structures, and the- grad- ing of intersecting highways and private roads, and grading new approaches when ordered by the Engineer. ' CLASSIFICATION: Grading shall be classified under the heads of Solid Rock Excavation, Loose Rock Excavation, Common Excavation, Structure Excavation, Ditch Excavation, and on Paving improvements there shall be the additional elassificatian of Subgrade Excavation. Material from borrow pits shall be classified under the heads of Solid Roek Excavation, Loose Rock Excavation, and Common Excava- tion. Solid Rock Excavation will include all ledge rock that cannot be removed without drilling and blasting and all boulders containing more than one-half cubic yard. Loose Rock Excavation will include detached rock and boulders containing one cubic foot or more, and less than one-half cubic yard, cemented gravel and hard pan. Cemented gravel is defined as gravel. caused to cohere by infiltrated calcereous or silicious matter, or by the effect of such infil- tration combined with that of pressure, and which cannot be loosened by picking or by plowing with a 6-horse team. Hard pan is defined as a mixture of clay, sand, pebbles, and small rock so firm- ly compacted that it cannot be loosened by picking or by plowing with a 6-horse team.. Common Excavation will include all excavated material not included under the heads of Solid Rock Excavation, Loose Rock Excavation, Subgrade, Excavation, Excavation for Structures, and Ditch Excavation. Structure Excavation will include all material excavated for the footing of culverts, bridges, and retaining walls. Ditch Excavation will include all material excavated in constructing channel changes and other ditches, not including the side ditches in the regular road section or side borrow pits. In case loose rock or solid rock is encountered it 'will be so classified. Subgrade Excavation shall be so classified on paving improvements only, and shall include that material excavated from the traveled roadway of an existing road surfaced with gravel or crushed rock where the location follows such existing road, and where the cut at the .crown of the existing road is three (3) feet or less. In ease loose rock or solid rock is encountered, it will be so classified and paid for instead of subgrade excavation. In excavations where the cut at the crown of the existing road is greater than three (3) feet, the material will not be classified as Subgrade Excavation, but will be classified as common, loose rock, or solid rock, as the case may be. In computing subgrade ex- cavation the material in the shoulders of the existing road above the base of the pavement and within two and one-half .feet of the edge of the pavement will be allowed as subgrade excavation. ESCAVATION: Excavation shall-include the removal of and satisfactory disposal of all materials taken -from within the limits of the work contracted for. All excavation shall, if required, be taken or hauled into the nearest embankment to the extreme distance required by the Engineer. The surplus beyond what is necessary to form the contiguous em- bankment, is to be disposed of in widening the embankment uniformly along one or both sides of the same, or is to be deposited in waste banks, or is to be hauled to form any embankment on the road to be improved, as the Engineer may direct. In cases where the quantity of material taken from the regular cuttings shall not be sufficient to form the requisite embankment,. the deficiency shall be supplied by taking material from cuttings within or without the right of way, at such places as the Engineer may direct, or from an enlargement of the regular cuttings, made uniformly on one or both sides of the same, and the sides of the excavation in all cases shall be dressed to such slopes as the Engineer may require, provided, that if the Contractor shall have sloped such excavation by direction of the Engineer before widening the same, payment for sloping the second time shall be made by force account as hereinafter provided. . E1 ::p ;; 7rat VPherever the Engineer may deem such a course necessary, the cuttings shall be made below grade, and clean sand, gravel, loose rock or other material deemed proper for the roadbed, shall be procured by the Contractor and deposited as the Engineer may direct. In Solid Roek Excavation, the Contractor shall be required to excavate eight (8) inches below the grade and to backfill to true grade and crown with material as specified above. Such excavation and backfill will be estimated and paid for at the contract price for common excavation, solid rock excavation, or common borrow, as the case maybe. • The surface of the roadbed shall conform strictly to the final grades set by the Engineer, and shall be composed of the best materials obtainable from the excavation. No boulders shall be left protruding from the surface and all stones of greater diameter than two inches shall be removed from the entire surface of the roadbed. STRUCTURE EXCAVATION: Foundation pits for culverts, bridges; and other structures, shall be excavated to the depth and lines indicated on the plans or established by the Engineer. The material obtained from such excava- tion shall be used, as the Engineer may require, either in constructing embankments, or for back- filling over and around the structures after they are complete, or, in ease it is unsuitable for either of these purposes, it shall lie disposed of in such manner as to avoid obstructing the stream or other- wise impair the efficiency or appearance of .the structure or other parts of the road. The backfilling of openings made for-structures shall be considered as a necessary part of the excavation, though the Engineer may require that the material for use in making a backfill be obtained from a source entirely apart from the .structure.- On paving improvements the backfill -for structures -shall be made in layers not more than six (6) inches thick, and each layer shall be thoroughly tamped or rammed before the next succeeding layer is laid. Where .the material used in making the backfill is difficult to compact, the Engineer may require each layer to be thoroughly flushed with. water if in his judg- ment such flushing would be desirable. Compensation for such wetting shall be included in the con- tract price for Structure Excavation. , Measurement will be made to the actual lines of the excavation, provided that in no case will meas- urement be made to lines at a greater distance than twelve inches from .the greatest outside dimen- sion of the completed structure.. Structure Excavation will not be further classified into Solid Rock or Loose Rock Excavation. . OVERBREAK AND SLIDES: Side slopes shall be made as staked by the Engineer. In case finished slopes slide into the excavation during the progress of the work, the slide material shall be removed at contract price per. cubic yard. Slopes undercut at the base by draglines used in excavation, or destroyed in any manner by act of the Contractor, shall be resloped, parallel to the slope as staked by the Engineer, at the Contractor's ex- pense.. In solid rock excavation, overbreaks shall be removed by the Contractor at his own expense. EMBANKMENT; The materials composing the embankment must be entirely imperishable, and wherevex the natur- al surface upon which the embankment is to be placed is of such a nature as, in the judgment of the Engineer, would impair -the stability or usefulness of the surface, it shall be removed to such width and depth as the Engineer may direct, and the material so removed, disposed of as ordered. On paving improvements all embankments shall be conNtructed in successive horizontal layers not exceeding eight (8) inches in thickness. Each layer shall be rolled with aself-propelled roller weighing not less than ten (10) tons and such rolling shall extend across the entire fill. If the mate- rial does not compact readily under rolling, each layer shall be sprinkled with water before or during the process of rolling in order to secure a thoroughly compacted mass. Layers shall be carried up full width from the bottom of the fill to avoid the necessity of widening on the edges after the center has been brought up to grade. The contract price per cubic, yard of excavation shall~be full compensation for such rolling and sprinkling. Whenever the site of an embankment is covered with snow sufficiently deep to impair the utility of the work, the same must be removed and deposited beyond the slope stakes, at the Contractor's own expense. Work of this nature shall always be at least one hundred (100). feet in advance of the embankment. Side slopes of borrow pits in all cases shall be dressed to such slope as the Engineer may direct. A berme of not less than six (6) feet in width shall be left between the slope stakes of the embankment and the edge of the borrow pit, and a berme of not less than two (2) feet shall be left between the outside slope of the borrow pit. and the right of way line. The berme must consist of original unbroken ground. OVERHAUL ON EXCAVATION: Excavated material shall. be hauled to any distance that the Engineer may direct. Whenever the material is hauled to a distance greater than four hundred (400) feet, the Contractor will receive addi- tional compensation for overhaul on excavation. The method of computing- overhaul shall be by appli- cation of the mass diagram. WASTE AND BORROW The Contractor will not be allowed to waste and borrow in lieu of hauling the material as required. DISPOSAL OF SURPLUS MATERIAL: All surplus excavation and waste material shall be used uniformly to widen embankments along one or both sides of the same, or to flatten side slopes, or be deposited in such other places and. for such other purposes as the Engineer may designate. DEPOSIT OF STONE: The Contractor, when directed by the Engineer, shall deposit on the side of the road, or at such convenient points as may be designated, any- stone or rock that he may excavate, and if in so doing, he shall deposit material required for embankment, the additional number of cubic yards of a cavaton required in forming such embankment will be allowed and paid for. All stone or rock excavated and deposited as above. shall be the property. of the County, and the Contractor will be held responsible for its safe keeping until removed by proper authority, or until the contract is completed. DRAINAGE DITCHES All ditches shall be constructed as shown on the plans and shall be so graded as to conform to the natural flow of the water to culverts, or natural or artificis,l channels. In going from cut to fill the ditches shall be cut to the right or left before reaching the fill. Under no circumstances shall the water be allowed to run upon the fill. METHOD OF MEASUREMENT OF QUANTITIES All grading will be measured in excavation in its original position by cross sectioning, except in the case of borrow pits of necessity so irregular in shape as to make accurate measurement impossi- ble, in which case, the volume of the settled embankment shall be taken as the volume of the borrow pit.. PAYMENT Grading will be paid for by the cubic yard of excavation at the respective unit .price bid for the various classes of excavation provided for and the price paid for such excavation, with the additional price paid for overhaul as hereinafter defined, shall be full compensation for excavating the material, hauling into embankment or disposing of it as directed by the Engineer, and finishing the roadbed and slopes as heretofore directed. The price paid for .excavation shall include hauling the material within and up to a distance of four hundred feet. As compensation for hauling excavated material to distances greater than the speci- fied four hundred feet, the contract price for overhaul will be paid, on each yard for each one hundred feet that it is hauled beyond the above specified four hundred feet. Payment. for Structure Excavation will be made at the contract price per cubic yard for "Struc- ture Excavation," which price shall be full compensation for all necessary pumping, bailing, drain- ing, sheeting, diversion of streams, etc., and backfilling over and around such structure .to the original surface of the ground. PAYMENT The basis of payment for concrete and masonry drainage structures shall be as provided in the specifications for concrete and masonry, herein before given. See page D-2 for removal of structures. PIPE CULVERTS: . Pipe culverts shall be constructed wherever indicated on the plans or directed by the Engineer. Pipe culverts shall be of plain concrete or reinforced concrete as called for on the plans. Double strength, salt glazed vitrified clay sewer pipe may be substituted for plain concrete pipe at the option of the contractor. Concrete for the pipe shall be mixed in the proportions of one (1) part Portland cement, two (2) parts sand and one and one-half (11/2) party clean pea gravel; or one (1) part Portland cement and three (3) parts of properly graded aggregate. The cement shall meet the requirements specified- under "Concrete Structures." The aggregate shall meet the requirements contained in the specifications for Concrete Structures, except that the maximum size of coarse aggregate shall be no gres,ter than three-eights- (3/8) of the wall thickness of the pipe. The aggregate shall be well graded from coarse to fine. Transverse steel is defined as steel placed in planes perpendicular to the axis of the pipe. All pipe shall be the product of approved factories. The Engineer reserves the right to reject the product of any pipe works whenever in his opinion the methods of manufacture are not such as to guar-. antee uniform results, or where the materials are such as to produce inferior pipe. The Engineer shall have access to all parts of the pipe factory, storehouses, yards, etc. at any time. . All pipe shall be kept wet continuously for ten (10) days immediately following manufacture. Pipe may be steam cured; however, steam curing shall not be started until the cement-has taken its final set. The period for keeping the pipe wet specified above may be shortened one day for each 24 hours of steam curing. Pipes that have not been steam cured shall not be laid until thirty (30) days old; pipes that have been steam cured shall not be laid until twenty-five (25) days old. Pipe, while being cured in the yard, shall be covered with burlap. The finished pipe shall be sound, hard, and dense, free from porosity, cracks, or distortion. Plaster- ing or grouting of defects will not be permitted. Ninety-five per cent of the area of the inside of plain pipe shall show troweling by the inside form. Ninety per cent of the area of the outside of plain pipe shall show web. The pipes shall have the factory name or trademark plainly impressed thereon, and shall be marked as reinforced pipe where such marking is necessary to distinguish the reinforced from the plain pipe. The date of manufacture of the pipe and the letter "R" for reinforced pipe shall be stamped in the con- crete. _ Joints of reinforced pipe if of the bevel, overlapping or butt type shall have a positive metal con- - nection of a design approved by the Engineer. Reinforced pipe may be of the bell and spigot type, in ' which case metal connections will not be required. All joints shall be thoroughly sealed, both Inside and outside, with a mortar composed of one part Portland cement and one part sand. A mortar collar, composed of one pa"rt Portland cement and one part sand, and having a width of six (6) inches and a thickness equal to the thickness of the wall of the pipe less one-half inch shall be placed around the pipe at joints of the bevel or overlapping type. CONSTRUCTION : • A trench shall be excavated to grade and line, as given by the Engineer or to one (1) foot below grade, if required, and backfilled with gravel or other approved material, and tamped to grade to in- sure an unyielding foundation. Compensation for additional excavation will be made at the contract price per cubic yard for "Excavation for Structures." Compensation for the backfilling and tamping. to the grade of the bottom of the pipe will. be made by Force Account except where the backfilling is called for on the plans. While laying the pipe the joint shall be sealed as specified above, care being taken' to protect' the joints until the mortar has- thoroughly set. All pipe shall be laid with the bell or larger end up stream. Pipe having a bevel, butt or overlapping joint shall be thoroughly cleaned before the mortar collar is placed. _ A form shall be used to hold the mortar in place on the lower two-thirds of the collar or wet earth shall be carefully packed around the lower two-thirds of the mortar collar as it is pieced. After the pipe is placed, the trench shall be backfilled with gravel or other suitable material and thoroughly tamped as backfilling progresses. Special attention shall be given to tamping joints. Concrete pipe, thirty-six (36) inches or more in diameter, to be placed under embankment of eight (8) feet or more, shall be reinforced during construction of embankment with four by four posts placed in a vertical position. The posts shall be lightly wedged in place at three-foot intervals where .the em- bankment is six (6) feet or more over the pipe. If there will be water in the pipe during the construc- tion of the embankment, the posts and wedges shall be soaked in water twenty-four (24) hours before being placed. VITRIFIED CLAY CULVERT PIPE: . Vitrified clay culvert pipe shall be of the best quality, double strength and salt-glazed. They shall be sound and well burned throughout their thickness, impervious to moisture, with a clear ring, smooth and well glazed on the interior and exterior surfaces, free from cracks, flaws, blisters,' fire-checks or other imperfections. Any pipe which varies between any two diameters more than three per cent (3%) or which betrays in any manner a want of thorough vitrification, or the use of improper or insuf- ficient materials or methods in the manufacture shall be rejected. TESTS: ' Vitrified clay culvert pipe shall comply with the specifications of the American Society of Testing Materials, Serial Designation C13-24 and all subsequent amendments thereof, unless otherwise stated in these specifications, and all tests shall be made in accordance with the A. S. T. M. specifications. The State Highway Engineer shall be permitted to select specimens, mark pipe, etc. as outlined in the above specifications. All pipe shall be free from fractures, large or deep cracks and blisters, laminations and surface roughness and shall be subject to rejection on account of the following (a) Fracture or cracks passing through the-shell or socket, except that a single crack at either end of a pipe not exceeding two (2) inches in length or a single fracture in the socket not exceeding three (3) inches in width nor two (2) inches in length will not be deemed cause for rejection unless these de- fects exist in more than five per cent (5 Jo) of the entire shipment or delivery. ' (b) Blisters where the glazing is broken or which exceed three (3) inches in diameter, or which project more than one-eighth (1/8) inch above the surface. (c) Laminations which indicate extended voids in the pipe material. (d) Fire cracks or-hair cracks sufficient to impair the strength, durability or serviceability of the pipe• (e) Glaze which does not fully cover and protect all parts of the shell and ends, except that glaz- ing will not be required on the outer surface of the barrel at the spigot end for a distance from the end equal to two-thirds (2/3) the depth of the socket or spigot for the corresponding size of the pipe. (f) Failure to give a clear ringing sound when placed on end and dry tapped with a light ham-. mer. A trench shall be excavated to grade and line, as given by the Engineer or to one (1) foot below grade, if required, and backfilled with gravel or other approved material, and tamped to grade to in- sure an unyielding foundation. Compensation for the additional excavation will be made at the con- tract price per cubic yard for "Excavation for Structures." Compensation for the backfilling and tamping to the grade of the bottom of the pipe will be made by Force Account except where the back- filling is called for on the plans. Particular attention shall be paid to excavation for the bells of the tile, to prevent the bell from bearing on the foundation. Clay pipe shall be laid with the bell end up stream and all ;joints shall be cemented with Portland cement mortar mixed in the proportion of one (1) part cement and one (1) part sand. Vitrified clay culvert pipe shall be backfilled with sand, gravel, clay or loam which is free from large rock. The backfill shall be brought up to a depth of one (1) foot over the bell ends of the culvert and shall be tamped as backfilling progresses, to insure full support under the pipe. Payment. Culvert pipe will be paid for at the contract price per linear foot of pipe in place, which shall be full compensation for furnishing the pipe, cementing joints, backfilling and tamping, and all other incidental work except as stated under Construction, on Page M-3. Excavation of the trench will be paid for at the contract price per cubic yard for "Excavation for Structures." See Page D 2 for re- moval of structures. Headers or .End Wa11s. Headers or end walls shall be constructed where called for on the plans and of the materials and dimensions indicated on the plans. REMOVING PIPE CULVERTS: Where shown on the plans or designated by the Engineer, the contractor shall take up existing pipe culverts and place them on the edge of the right of way. If not fit for further use, the pipe shall be disposed of as directed by the Engineer. For compensation see "Removal of Structures," page D 2. Where the removed culvert is not replaced by a new structure, compensation for removal of the pipe shall be covered by the contract price per cubic yard for "Structure Excavation." RELAYING PIPE CULVERTS: Removed culvert pipe shall be relaid where shown on the plans or where designated by the Engi- neer. The contract price per linear foot for relaying culvert pipe shall be full compensation for all labor, materials, tools and equipment employed in connection with the transportation and relaying of the pipe. M4 TILE DRAINR DESCRIPTION: At such places as shown on the plans, or as designated by the Engineer, pipe drains shall be con- structed. They shall have suitable outlets into culverts to drain water entirely away from the road. They shall be constructed to the line and grade furnished by the Engineer and in accordance with- the plans. POROUS TILE: Porous Clay Drain Tile shall be burned from clay or shale, free from pebbles and other foreign substances which impair its strength or durability. The the shall have a smooth interior and square ends. It shall-not vary from circle more than ten per cent of its internal diameter. Concrete Drain Tile shall be composed of one part of Portland cement and three parts of sand of •the quality and grading specified under :Concrete Structures. PAYMENT Pipe drains shall be paid for at the contract price per linear foot of pipe in place, which shall be full compensation for furnishing the materialsr laying, and all other work incidental thereto, except backfilling with gravel, and excavation. Excavation for the trench will be paid for at the contract price per cubic yard for "Structure Ex- cavation." N1 _ ~-~~- . ~_ ~ ~.>. ,- ~1~~ GUARD RAIL DESCRIPTION: Guard rails shall be constructed where indicated on the plans or directed by the Engineer, and shall conform in all respects to the requirements of the Standard plans for same. MATERIALS Materials shall be as indicated on the Standard Plan for guard rails for the type of guard rail to be used. Timber post and guard rails shall conform to the specifications for "Timber Structures." Cement, sand, gravel and reinforcing steel shall conform to the specifications for those materials as specified under "Concrete Structures." The timber shall be Select Common bouglas Fir. Concrete posts shall be precast to the dimensions shown on the plans. The concrete shall be made up of one part cement to two parts fine aggregate and three and one-half parts of .coarse aggregate (1:2:31/2). The surface shall be smooth and true. The posts shall be given a Class "B" finish after they are set in place. The holes for the base of the posts shall be of the minimum dimensions shown on the plans. If round post holes are dug they shall have a minimum diameter of fifteen (15) inches. The concrete in the base shall be Class "C" concrete. The posts and the rail shall be set to the true line and grade of the highway. CONSTRUCTION Timber posts shall first be creosoted for a distance of three and one-half (31/2) feet at their butt ends. Creosoting shall conform to the specifications for creosoting specified for "Timber Struc- tures," using dipped process. They shall then be set vertically, to the full depth shown on the plans, and accurately lined. The post holes shall then be backfilled, using especial care to see that only suitable material is used in the baekfill and that it is thoroughly tamped. The top of the posts shall be sawed to exact grade after the tamping of the baekfill is finished. The railings shall be securely spiked in place and the entire guard rail, except the lower edge, shall be painted with two coats of white lead and linseed oil, as specified for "Priming Coat" and "Finish Coat." The paint shall conform to the speci- fications for painting specified for "Timber Structures." Joints in the rail shall be staggered and the pieces of lumber shall have a minimum length equal to two panel lengths except at the ends, where lumber of one panel length shall be used. Lumber for guard rails shall be kiln dried or if not kiln dried it shall be piled on or near the work and in a manner to facilitate drying. The layers in the piles shall be separated with narrow pieces of lumber and a clearance of approximately one-half inch shall be left between pieces in the same layer. The lumber shall be protected from rains and shall be left in the piles for a period of forty-five days. PAYMENT Guard rail will be paid far at the contract price per linear foot of guard rail complete in place, which price shall include all materials and labor, excavating, backfilling, painting, and other work, in- cidental thereto. In compliance with the provisions of Chapter 166, Laws of 1921, there shall be reserved from the moneys earned by the Contractor on estimates during the. progress of the improvement or work, a sum equal to fif- teen (15%) per cent of such estimates, said sum to be retained by the State, County, City, Town, District, Board, or other public body, as the case may be, as a trust fund for the protection and payment of any person or persons, mechanic, sub-contractor or materialman who shall perform any labor upon such contract or the doing of said work, and all persons who shall supply such person or persons or sub- contractors with provisions and supplies for the carrying on of such work. Said fund shall be re- tained for a period of thirty (30) days following the final acceptance of said improvement or work as completed, and every person performing labor or furnishing supplies towards the completion of said improvement or work shall have a lien upon said fund so reserved, provided such notice of lien of such claimant shall be given in the manner and within the time provided in Section 1161 of Rem- ington & Ballinger's Annotated Code and Statutes of Washington as now existing and in aeeord- ance with any amendments that may hereafter be made thereto : PROVIDED, HOWEVER, that where in any improvement or work the contract price shall exceed two hundred thousand dollars ($200,000), but ten per cent. (9) No al±erations shall be made in the work shown and described in the plans and specifica- tions, except upon the written order of the Engineer and as provided hereinbefore and when so made the value of the work so added or omitted shall be computed by the Engineer, and the amount so certified shall be final and conclusive and binding upon the Contractor, and shall be added to or deducted from the contract price. The schedule of unit or itemized prices hereto attached is intended to form a part of this- con- tract and shall constitute, as far as possible, the basis upon which the value of all work added or - omitted shall be computed. (10) The Contractor shall provide sufficient, safe and proper facilities at all times for the in- spection of the work, by -the Board or its authorized representative. The said Contractor shall fur- nish, without charge, to the said Board or its authorized representatives, samples of cement or other materials used in construction,. as said samples may be required, in order that the character of such materials may be determined. All materials and methods shall be subject to the approval of the Engineer. ~?~' B3 Defective work or material may be condemned by the Engineer at any time before the final acceptance of the work. Notice of condemnation shall be given in writing by the Engineer. Such condemned. work shall be immediately removed or disposed of to the satisfaction of the Engineer. Should the Contractor be delayed in the prosecution or completion of the work by the act, ne- glect or default of the Board or the Engineer in charge, or of any other contractor employed upon the work, or by any damage caused by fire or other casualty for which the Contractor is not re- sponsible, or by combined action of workmen in no way caused by or resulting from default or col- " lusion on the .part of the Contractor, then the time herein fixed for the completion of the work shall be extended for a period equivalent to the time lost by reason of any or all of the causes afore- said, which extended period shall be determined and fixed by the Board, but no such allowance shall be made unless a claim therefor is presented in writing to the Board within ten (10) days after the occurence of such delay. (11) It is further mutually agreed between the parties hereto that no certificate given or pay- ment made under this contract, except the final certificate or final payment, shall be evidence of the performance of this contract either wholly or in part, and that no payment made shall be con- strued to be an acceptance of defective work or improper materials which may appear within two (2) years after such payments. (12) The work and material covered by this contract shall be at the sole risk of the Contract- oi~ until the same shall have been finally accepted by the Engineer, Board and the State Highway Engineer, and any damage or loss that may occur or result to the same prior to the final eom- pletion and acceptance of said work by the Engineer, Board and the State Highway Engineer. shall fall upon and be made good by the said Contractor. (13) The Contractor shall not let, assign or transfer this contract, or any interest therein, or sublet the work herein provided to be done, or any part thereof, without the consent of the Board. The Contractor shall file with the Board a duplicate of all sub-contracts made by him as aforesaid. The Contractor shall give his personal attention to the work at all times and be present either in person or by duly authorized representative on the site of the work continually during its prog- ress and shall receive instructions from the Engineer in charge. Any sub-contractor shall be con- sidered the-agent of the Contractor and the latter shall be responsible for any indebtedness incurred by such agent. If any sub-contractor fails to perform hic work in a satisfactory manner his sub- contract may be terminated by the Board. (14) The Contractor shall be liable for all damages and injury which shall be caused or which shall occur to any person or persons or property whatsoever by reason of any negligence of said- Contractor or any of his servants, employes or sub-contractors, or by reason of any breach or viola- tion of any of the provisions of this agreement or any of his duties or obligations thereunder. The Contractor shall- also assume all liability for and protect the Board from any damages or claims arising from the use of any patented articles or devices in any part of the work. (151 It is a part of the public policy of the ,State of Washington that all work by contract or day labor done for it or any political subdivision created by its law, shall be performed in work days of not 'more than eight hours each, except in cases of extraordinary emergency. No case of B4 extraordinary emergency shall be construed to exist in any case where other labor can be found to take the place of labor which has already been employed for eight hours in any calendar day. In case of the violation of the provisions of this article, the Board shall have the right to cancel this contract without notice, and shall have the right to complete the work in the manner provided in Article 4 hereof. C] ~,... , SPECIFICATIONS GENERAL PROVISIONS PERMITS AND LICENSES The Contractor. shall procure all permits and licenses, pay all charges and fees, and give all notices necessary and incident to the due and lawful prosecution of the work. LAWS AFFECTING PUBLIC WORK: Attention is particularly called to the clearing and grubbing specifications and also to section three, Chapter 33 of the Session Laws of 1917, with reference to the burning of refuse, timber, .brush, and debris from clearing and grubbing operations. The Washington Forest Fire Association and the State Fire Warden all insist that the statutes covering the matter be strictly enforced, and that .the refuse from clearing and grubbing on public roads be properly disposed of and the premises be left in a neat and presentable condition. The provisions of the specifications and the statutes, therefore, will be strictly enforced. INTERPRETATION OF PLANS: Any work or materials that may have been accidentally omitted in the description of the work, but which is clearly implied, shall be furnished by the Contractor as if ~it had been specifically stated. Work shown on the plans and not mentioned 'in the specifications, and vice versa, will be done as if shown on both, when and where required. In case of discrepancy on any plans or drawings between the scaled and figured dimensions, the figured dimensions shall. govern: In case of ambiguity of ex- pression in the specifications, or doubt as to the correct interpretation of -the same, the matter shall be submitted to the Engineer, whose decision shall be final. - CONNECTIONS WITFI INTERSECTING ROADS OR DRIVEWAYS: The Contractor shall, for the same compensation as for other grading, grade a safe, proper, and workmanlike connection with all intersecting public or private roads or driveways, according to the direction of the Engineer. UNAUTHORIZED WORK: Work done without lines and grades being. given, work done beyond the lines and grades shown on the plans or as given, except as herein provided, or any extra work done or any deviation made from the plans a.nd specifications, without written authority, will be considered unauthorized and at the expense of~ the Contractor, and will not be measured or paid for by the County. Work so done may be ordered removed and replaced at the Contractor's expense. LIMITATION OF OPERATIONS The Contractor .shall so conduct his operations as to have under construction no greater length or amount of work than he can prosecute vigorously, and when in the judgment of the Engineer such operations are being so spread out as to be detrimental to such vigorous prosecution, thereby endan- gering the completion of the improvement within the contract time, he shall so advise the Contractor in writing. METHOD OF SERVING NOTICE: Any written notice to the Contractor which may be requisite under these specifications, may be served on said Contractor, either personally or by mail, or by leaving the same at his last known place of residence. CO-OPERATION OF CO1vTRACTOR REQUIRED The Contractor shall keep a copy of the plans and specifications on the work.. DETOURS The Contractor shall at all times conduct the work in such a manner ae to insure the least obstruc- tion to traffic practicable. C2 The Contractor shall provide and maintain `at his own expense in passable condition such tem- porary highways and bridges as may be necessary to accommodate the traffic diverted from the roadway or bridge under construction and shall provide and maintain in a safe condition temporary approaches to 'and crossing of intersecting highways except that the Contractor will not be required to build and maintain temporary detours around .bridges more than twenty (20) feet in length, nor around a closed section of highway having a length of more than 500 feet, unless such detours are provided for in the specifications or on the plans, or ordered in writing as force account by the- Engi- neer. BARRICADES On all improvements the Contractor shall provide, erect, and maintain at his own expense all neces- sary barricades of sufficient strength for the purpose intended, suitable and sufficient lights, danger. signals and signs and shall take all necessary precaution for the protection of the work and safety of the public. Any part of the work damaged from traffic or other causes, occurring prior to its official acceptance shall be replaced and made good by the Contractor at his own expense in a manner satis-. factory to the Engineer. Two barricades two hundred feet apart shall be constructed at .each point where a highway is closed to traffic. The first or outside barricade shall be constructed of light lumber in such a manner that it will not seriously injure or wreck a car. The second barricade shall be constructed of heavy. material in such a manner as to be difficult to remove or break down. PIt.ESERVATION OF PROPERTY: The Contractor shall preserve from damage all property along the line of work, the removal or destruction of which is not called for by the plans. This applies to public utilities, trees, monuments, fences, etc., and wherever such property is damaged, due to the activities of the Contractor, it shall be immediately restored to its original condition by the Contractor and at his own expense. USE OF EXPLOSIVES When the use of explosives is necessary for the prosecution of the work, the Contractors shall use the utmost care, so as not to endanger life or property, and whenever directed, the number and size of charges shall be reduced. TESTING MATERIALS Tests of materials to be used in the work shall be.made in the laboratory- designated in the "Def- inition of Terms," whenever such tests are required by the specifications or by the Engineer. The Contractor shall furnish the Engineer, without charge, samples of materials used in the work as such samples are required. Materials may be rejected by the Engineer whenever, in his judgment, they fail to meet the re- quirements of the specifications, and when so rejected, they shall- be immediately removed from the work. STORAGE OF MATERIALS: All materials intended for use in the work shall be so stored by the Contractor as to prevent damage from exposure to the elements, from admixture of foreign material, or from any other cause. The Engineer will refuse to accept, or to sample for testing, any materials that are improperly stored. C3 - USE OF MATERIALS FOUNII ON WORB: In the absence of special provision to the contrary, the Contractor may use any stone, gravel, sand, etc., that may occur in the regular roadway excavations, and which may not be needed to make the fills shown on the plans, or any timber removed in making the improvement, except as herein other- wise provided, or any existing structures that are to be replaced, provided that. these materials are suitable for, and required in the work. Materials found on the work, especially timber and existing structures, which are required to be removed but which are not .used in the improvement by the Contractor, as provided above, shall be put into shape to be handled .economically and neatly piled along the right of way, as herein provided, or as the Engineer may direct. LINES, GRADES AND MEASUREMENTS The Contractor will be governed by such lines, grades, and measurements as may be given by the Engineer in laying out the work and by the Engineer's determination of quantities of work per- formed. Stakes and markings set or made by the Engineer to mark out the work, shall be carefully preserved by the Contractor; in case such stakes, markings, or references are carelessly destroyed or defaced by the Contractor or his employees, the expense of replacing same will be deducted from any money due or to become due the Contractor. CROWN OR CROSS SECTION OF ROADWAY: The cross-section of the roadway shall be as shown in the plans, except at intersecting highways on curves or wherever to insure correct drainage or for other reasons, changes may be directed. AUTHORITY AND DUTIES OF INSPECTORS The Engineer may appoint assistants to inspect all materials used and all work done. Such inspection may extend to any or all parts of the work and to the preparation or manufacture of the - materials to be used. The assistants will not be authorized to revoke, alter, enlarge or relax the pro- visions of these specifications. An assistant is placed on the work to set the necessary lines and grades and to keep the Engineer informed as to the progress of the work and the manner in which it is being done; also to call the attention of the Contractor to any infringements upon plans or speci- fications. He will not be authorized to approve or accept any portion of the work or to issue in- structions contrary to the plans and specifications. The assistant will have authority to reject defective material and to suspend. any work that is being improperly done, subject to the final decision of the Engineer. The assistant will exercise such additional authority as may from time to time be especially delegated to him by the Engineer. FINAL CLEANING UP : . The Contractor shall remove, at his own expense, from the highway and from the adjoining property, temporary structures and all rubbish and surphts materials resulting from the work which may have accumulated during its prosecution. All work, including shoulders, ditches, and slopes, shall be neatly dressed and cleaned up on completion, according to the Engineer's direction, and shall be left in a neat and orderly condition. SUSPENSION OF WOKS: The Engineer shall have the authority to suspend the work on account of the default of the Contractor, unfavorable weather conditions, or any other condition which, in the judgment of the Engineer makes it impossible to secure first-class results. The Contractor shall immediately respect the written order of the Engineer to suspend work wholly or on any particular section of the road. If it becomes necessary to stop the work for a protracted period, the Contractor shall take every precaution to prevent any. damage or unreasonable deterioration of the work during the time it is closed down. The Contractor shall not make any claim or demand for damage by reason of such suspensions in the work, but the date for completion will be extended by the period of such suspen- sion. MEASUREMENT OF QUANTITIES The determination of the quantities of work performed will be made by the Engineer based on measurements taken by him or his assistants. In computing volumes, the method of average end areas C4 will be used for excavation and embankment. Other quantities will be computed in the units used in the proposal form, according to well organized engineering principles, and no local rules or cus- toms will be considered. NO WAIVER OF LEGAL SIGHTS: Should an error be discovered in the estimate, or should conclusive proofs of dishonesty on the part of the Contractor be discovered in the work, after the final payment has been made, the Board reserves the right to claim and recover by process of law, such sums as may be sufficient to correct the error, or make good the defects in the work resulting from the Contractor's dishonesty. FURNISHING DATA: The Contractor shall furnish the Engineer with such data as may be required to enable him to keep an accurate cost of the work as it progresses. He shall furnish a statement of the number and rate of pay of all laborers and teams employed each day upon the work; also copies of all equip- ment and material bills, or a statement in lieu thereof, showing the amount of equipment and ma- terials received on the work and cost thereof, together with such other information as may be re- quired. CONSTRUCTION CAMPS: The Contractor herein is required and he hereby agrees to conduct. and maintain all con- struction camps in accordance with the rules and regulations of the County and State Board of $ealth, and it is understood that the work done under this contract will not be accepted by the County until all camps have been placed and left in a sanitary condition. Special reference is here- by made to the rules and regulations of the State Board of Health pertaining to Industrial camps. OS SPECIAL PROVISIONS FOR "PERMANENT HIGHWAYS" The special provisions hereinafter contained shall supereede any provisions of the Standard Speei- fieations in conflict herewith. - LIIMP SIIM CONTRACT: The lump sum price bid will be considered full compensation for- the full compliance with the terms of the contract, plans and specifications and the completion of the entire work covered by them. In the preparation of the plans, the classification and quantities of the various items of work shown thereon were determined as accurately as possible from the Engineer's best judgment; however, the county assumes no responsibility for the correctness of them and no additional eompens~tion will be allowed, or deductions be made on account of any increase or decrease in the quantities or classifi- cation of work performed, except as provided for in the contract and specifications for "Alterations" and "Extra Work." Where reference is made elsewhere in the specification to payment at the contract price per unit of work complete in place, it shall be understood to apply only to "extra work" and shall not apply to the work to be performed under the lump sum bid. EXTRA WORg: No extra work shall be done except upon the written order of the Engineer, and when so ordered, the value of the work shall be computed by the Engineer and his determination shall be final and con- clusive -and binding upon the Contractor. In the event of extra work arising for which no bid has been taken, and agreement cannot other- wise be reached as to payment. therefor, the Engineer and Board shall have the right to order the same done upon the basis of Force Account. Payments for extra work done under force account shall be the amount of the actual reasonable cost to the Contractor for materials and labor, with an addi- tion of ten per cent (10%), which ten per cent shall cover all overhead expense, profit and use of tools and equipment, except that the ten per cent shall not apply to industrial insurance and medical aid. FIINns: In the event that there are not sufficient funds to the credit "of the County in the Permanent Highway Fund, then such .additional amount as may be necessary to complete the. full amount of the lump sum contract, may be paid by County warrants drawn on the Road District, or Road and Bridge Funds of the County; said payments to be made as otherwise provided for in the contract. C6 SPECIFICATIONS " CONSTRUCTION DETAILS CLEARING, GRUBBING AND REMOVAL OF STRUCTURES CLEARING The right of way will in general be cleared to the width of 20 feet on each side of the center line, but will be cleared to greater widths where ordered " by the Engineer. Clearing outside of the ~ right of way shall be done under the same specifications and be paid for at the same price as clearing within the right of way. The clearing will in all cases conform to the stakes set by the Engineer. Within the lines staked by the Engineer, except as hereinafter specified, all trees, brush, logs, and other organic matter shall be removed and burned within the right of way. No stump shall be left in the cleared space with a height greater than its diameter. Under fills of more than five (5) feet the tops of stumps shall be cut at least two feet below grade. Trees designated by the Engineer shall be left standing and care shall be exercised by the Contractor not to damage such trees in falling adjacent timber or in burning. All merchantable timber shall be cut into logs of standard lengths and decked along the side of the clearing or within the right of -way outside of the clearing, free from rubbish and worthless logs. At such times as the State or GFovernment authorities prohibit burning, the refuse from the clear- ing shall be piled along the sides of the right of way at points where its burning will not damage standing- timber, and when such prohibition is removed the piles of refuse shall be burned. Clearing must be carried on and completed at least one-half mile ahead of the grading. Clearing will be paid for by the acre for the area actually cleared by the Contractor in accord- ance with the stakes set by the Engineer. GRUBBING All stumps and roots embedded in the ground within the areas included between the- slope stakes of all excavation, and all embankments of five (5) feet or less, shall be removed and burned within the right of way. At such times as the State or (Iovernment authorities prohibit burning, the refuse from the grubbing shall be piled along the sides of the right of way at points where its burn- ing will not damage standing timber, and when such prohibition is removed, the piles of refuse shall be burned. (~-rubbing will be paid for by the acre for the .area actually grubbed by the Contractor within the limits above specified. REMOVAL OF STRUCTURE$ ' Where the Contractor is required to remove from the right of way bu-ildings, fences, puncheon, telephone poles, irrigation flumes, or other structures not constituting a part of the roadway, and the removal of which is not elsewhere provided for in these specifications or the plans,. such work will be considered as extra work, and shall be done according to the Engineer's instructions and paid for as provided under the clause covering extra work. . In case structures constituting a part of the roadway, such as existing culverts or bridges, are re- • quired to be torn out and removed, such work will be considered as ineideritai to the structures which replace the ones removed and will not be paid for separately, and compensation for. their removal will". be regarded as included in the payment for .new structures, unless otherwise specifically provided in the Special Provisions or on the plans. D1 :-, ~~. ~RAL~J.~ LT DESCRIPTION: Under this head is included all excavations and embankments required for -the formation of the roadbed, the digging of drain ditches and cutting new channels for streams, either within or without the right of way, excavations or embankments for bridges, culverts, and other structures, and the grad- ing of intersecting highways and private roads, and grading new approaches when ordered by the .Engineer. CLASSIFICATION: ' Grading shall be classified under the heads of Solid Rock Excavation, Loose Rock Excavation, Common Excavation, Structure Excavation, Ditch Excavation, and on Paving improvements there shall be the additional classification of Subgrade Excavation. Material from borrow pits shall be classified under the heads of Solid Rock Excavation, Loose Rock Excavation, and Common Excava- tion. Solid Roek Excavation will include all ledge rock that cannot be removed without drilling and blasting and' all boulders containing more than one-half cubic yard. Loose Rock Excavation will include detached rock and boulders containing one cubic foot or more, and less than one-half cubic yard, cemented gravel and hard pan. Cemented gravel is defined as gravel caused to cohere by infiltrated calcereous or silicious matter, or by the effect of such infil- tration combined with that of pressure, and which cannot be loosened by picking or by plowing with a 6-horse team. Hard pan is defined as a mixture of clay, sand, pebbles, and small rock so firm- ly compacted that it cannot be loosened by picking or by plowing with a 6-horse team. Common Excavation will include all excavated material not included .under the heads of Solid Rock Excavation, Loose Rock Excavation, Subgrade Excavation, Excavation for Structures, and Ditch Excavation. Structure Excavation will include all material excavated for the footing of culverts, bridges, and retaining walls. . Ditch Excavation will include all material excavated in constructing channel changes and other. ditches, not including the side ditches in the regular road section or side borrow pits. In ease loose rock or solid rock is encountered it will be so classified. Subgrade Excavation. shall be so classified on paving improvements .only, and shall include that material excavated from the traveled roadway of an existing road surfaced with gravel or crushed rock where the location follows such existing road, and where the cut at the crown of the existing road is three (3) feet or less. In case loose rock or solid rock is encountered, it will be so classified and paid for instead of subgrade excavation. In excavations where the cut at the crown of the existing road is greater than three (3) feet, the material will not be classified as Subgrade Excavation, but will be classified as common, loose rock, or solid rock, as the case may be. In computing subgrade ex- cavation the material in the shoulders of-the existing road above the base of the pavement and within two and one-half feet of the edge of the pavement will be allowed as subgrade excavation. EXCA®ATION: Excavation shall include the removal of and satisfactory disposal of all materials taken from within the limits of the work contracted for. All excavation shall, if required, be taken or hauled into the nearest embankment to the extreme distance required by the Engineer. The surplus beyond what is necessary to form the contiguous em- bankment, is to be disposed of in widening the embankment uniformly along one or both sides of the same, or is to be deposited in waste banks, or is to be hauled to form any embankment on the road to be improved, as the Engineer may direct. In cases where the quantity of material taken from the regular cuttings shall not be sufficient to form the requisite embankment, the deficiency shall be supplied by taking material from cuttings within or without the right of way, at such places as the Engineer may direct, or from an enlargement of the regular cuttings, made uniformly on one or both sides of the same, and- the sides of the excavation in all cases shall be dressed to such slopes as the Engineer may require, provided, that if the Contractor shall have sloped such excavation by direction of the Engineer before widening the same, payment for sloping the second time shall be made by force account as hereinafter provided. E1 Wherever the Engineer may deem such a course necessary, the cuttings shall be made below grade, and clean sand, gravel, loose rock or other material deemed proper for the roadbed, shall be procured by the Contractor and deposited as the Engineer may direct. In Solid Rock Excavation, the Contractor shall be required to excavate eight (8) inches below the grade and to backfill to true grade and crown with material as specified above. Such excavation and backfill will be estimated and paid for at the contract price for common excavation, solid rock excavation, or common borrow, as the ease may be. The surface of the roadbed shall conform strictly to the final grades set by the Engineer, and shall be composed of the best materials obtainable from the excavation. No boulders shall be left protruding from the surface and all stones of greater diameter than two inches shall be removed from the entire surface of the roadbed. STRUCTURE EXCAVATION: Foundation pits for culverts, bridges, and other structures, shall be excavated to the depth and lines indicated on the plans or established by the Engineer. The material obtained from such excava- tion shall be used, as the Engineer may require, either in canstructing embankments, or for baek- filling over and around the structures after they are complete, or, in case it is unsuitable for either of these purposes, it shall be disposed of in such manner as to avoid obstructing the stream or other- wise impair the efficiency or appearance of the structure or other parts of the road. The baekfilling of openings made for structures shall be considered as a necessary part of the excavation, though the Engineer may require that the material for use in making a backfill be obtained from a source entirely apart from the structure. On paving improvements the backfill for structures shall be made in layers not more than six (6) inches thick, and each layer shall be thoroughly tamped or rammed before the next succeeding layer is laid. Where the material used in making the backfill is difficult to compact, the Engineer may require each layer to be thoroughly flushed with- water if in his judg- ment such flushing would be desirable. Compensation for such wetting shall be included in the con- tract price for Structure Excavation. . Measurement will be made to the actual lines of the excavation, provided that in no case- will meas- urement be made to lines at a greater distance than twelve inches from the greatest outside dimen- sion of the completed structure. Structure Excavation will not be further classified into Solid Rock or Loose Rock Excavation. OVERBREAK AND- SLIDES: Side slopes shall be made as staked by the Engineer. In ease finished slopes slide into the excavation during the progress of the work, the slide material shall be removed at contract price per cubic yard. Slopes undercut at the base by draglines used in excavation, or destroyed in any manner by act of the Contractor, shall be resloped, parallel to the slope as staked by the Engineer, at the Contractor's ex- pense. In solid rock excavation, overbreaks shall be removed by the Contractor at. his own expense. EMBANXMENT: The materials composing the embankment must be entirely imperishable, and wherever the natur- al surface upon which the embankment is to be placed is of such a nature as, in the judgment of the Engineer, would impair the stability or usefulness of the surface, it shall be removed to such. width and depth as the Engineer may direct, and the material so removed, disposed of as ordered. On paving improvements. all embankments shall be constructed in successive horizontal layers not exceeding eight (8) inches in thickness. Each layer •shall be rolled with aself-propelled roller weighing not less than ten (10) tons and such rolli~~g shall extend across the entire fill. If the mate- rial does not compact readily under rolling, each layer shall be sprinkled with water before ~r during the process of rolling in order to secure a thoroughly compacted mass. Layers shall be carried up full width from the bottom of the fill to avoid the necessity of widening on the edges after the center has been brought up to grade. The contract price per cubic, yard of .excavation shall be fnIl compensation for such rolling and sprinkling. Whenever the site of an embankment is covered with snow sufficiently deep to impair the utility of the work, the same must be removed and deposited beyond the slope stakes, at the Contractor's own expense. Work of this nature shall always be at least one hundred (100) feet in advance of the embankment. E2 ~. BORROW PITS: Borrow pits shall be connected with ditches and drained to the nearest natural outlet. Side slopes of borrow pits in all cases shall be dressed to such slope as the Engineer may direct. A berme of not less than six (6) feet in width shall be left between the slope stakes of the embankment and the edge of the borrow pit, and a berme of not less than two (2) feet shall be left between the outside slope of the borrow pit and the right of way line. The berme must consist of original unbroken ground. OVERHAUL ON EXCAVATION: Excavated material shall be hauled to any distance that the Engineer may direct. Whenever the material is hauled to a distance greater than four hundred (400) feet, the Contractor will receive addi- tional compensation for overhaul on excavation. The method of computing overhaul shall be by appli- cation of the mass diagram. WASTE ~ AND BORROW The Contractor will not be allowed to waste and borrow in lieu of hauling the material as required. DISFOSAL OF SURPLUS 1ViATERIAL All surplus excavation and waste material shall be used uniformly to widen embankments along one or both sides of the same, or to flatten side slopes, or be deposited in such other places and for such other purposes as the Engineer may designate. DEPOSIT OF STONE The Contractor, when directed by the Engineer, shall deposit on the side of the road, or at such convenient points as may be designated, any stone or rock that he may excavate, and if in so doing, he shall deposit material required for embankment, the additional number of cubic yards of excavation required in forming such embankment will be allowed and paid for. All stone or rock excavated and deposited as above shall be the property of the County, and the Contractor will be held responsible for its safe keeping until removed by proper authority, or until the contract is completed. DRAINAGE DITCHES All ditches shall be constructed as shown on the plans and shall be so graded as to conform to the natural flow of the water to culverts, or natural or artificial channels. In going from cut to fill the ditches shall be cut to the right or left before reaching the fill. Under no circumstances shall the water be allowed to run upon the fill. METHOD OF MEASUREMENT OF QUANTITIES All grading will be measured in excavation in its original position by cross sectioning, except in the case of borrow pits of necessity so irregular in shape as to make accurate measurement impossi- ble, in which case, the volume of the settled embankment shall be taken as the volume of the borrow pit. PAYMENT: Grading will be paid for by the cubic yard of excavation at the respective unit price bid for the various classes of excavation provided for and the price paid for such excavation, with the additional price paid for overhaul as hereinafter defined, shall be full compensation for excavating the material, hauling into embankment or disposing of it as directed by the .Engineer, and finishing the roadbed and slopes as heretofore directed. The price paid for excavation shall include hauling the material within and up to a distance of four hundred feet. As compensation for hauling excavated material to distances greater than the speci- fied four hundred feet, the contract price for overhaul will be paid on each yard for each one hundred feet that it is hauled beyond the above specified four hundred feet. Payment for Structure Excavation will be made at the contract price per cubic yard for "Struc- ture Excavation," which price shall be full compensation for all necessary pumping, bailing, drain- ing, sheeting, diversion of streams, etc., and backfilling over and around such structure to the original surface of the ground. E~ ". { h _, _. ~, CULVERTS DESCRIPTION End walls, retaining walls, catch basins, drop inlets, etc., and concrete and masonry culverts. and bridges, or parts of same, .shall be constructed in accordance with the plans and of the particular kind .of concrete or masonry indicated on the plans or in these specifications. MATERIALS The materials and workmanship shall conform to the requirements of the specifications for the class' of concrete or the kinds of masonry used. PAYMENT: The basis of payment for concrete and masonry drainage structures shall be as provided in the specifications for concrete and masonry, herein before given. See page D-2 for removal of structures. PIPE CULVERTS: Pipe culverts shall be constructed wherever indicated on the plans or directed by the Engineer. Pipe culverts shall be of plain concrete or reinforced concrete as called for on the plans. Double strength, salt glazed vitrified clay. sewer, pipe may be substituted for plain concrete pipe at the option of the contractor. CONCRETE PIPE Concrete pipe shall be circular in cross-section and in lengths of not less than two (2) feet. It shall be dense, smooth and free from imperfections. Materials. Concrete for the pipe shall be mixed in the proportions of one (1) part Portland cement, two (2) parts sand and one and one-half (1i/2) party clean pea gravel; or one (1) part Portland cement and three (3) parts of properly graded aggregate. The cement shall meet the requirements specified under "Concrete Structures." The aggregate shall meet the requirements contained in the specifications for Concrete Structures, except that the maximum size of coarse aggregate shall be no greater than three-eights (3/s) of the wall thickness of the pipe. The aggregate: shall be well graded from coarse to fine. The material passing a one-quarter (1/4) mesh sieve shall meet the, strength requirements for Fine Aggregate under "Con- crete Structures" when graded to conform to the upper limit of that specification. Transverse steel is defined as steel placed in planes perpendicular to the axis of the pipe. All pipe shall be the product of approved factories. The Engineer reserves the right to reject the product of any pipe works whenever in his opinion the methods of manufacture are not such as to guar- antee uniform results, or where the materials are such as to produce inferior pipe. The Engineer shall have access to all parts of the pipe factory, storehouses, yards, etc. at any time. All pipe shall be kept wet continuously for ten (10) days immediately following manufacture. Pipe may be steam cured; however, steam curing shall not be started until the cement has taken its final set. The period for keeping the pipe wet specified above may be shortened one day for each 24 hours of steam curing. Pipes that have not been steam cured shall not be laid until thirty (30) days old; pipes that have been steam cured shall not be laid until twenty-five (25) days old. Pipe, while being cured in the yard, shall be covered with burlap. The finished pipe shall be sound, hard, and dense, free from porosity, cracks, or distortion. Plaster- ing or grouting of defects will not be permitted. Ninety-five per cent of the area of the inside of plain pipe shall show troweling by the inside form. Ninety, per cent of the area of the outside of-plain pipe shall show web. The pipes shall have the factory name or trademark plainly impressed thereon, and shall be marked as reinforced pipe where such marking is necessary to distinguish the reinforced from the plain pipe. The date of manufacture of the pipe and the letter "R" for reinforced pipe shall be stamped in the con- crete. Joints of reinforced pipe if of the bevel, overlapping or butt type shall have a positive metal con- nection of a design approved by the Engineer. Reinforced pipe may be of they bell and spigot type, in which case metal connections will not be required. All joints .shall be thoroughly sealed, both inside . and outside, with a mortar composed of one part Portland cement and one part sand. The bevel, overlapping or butt type of joint without metal connections may be used for reinforced pipe with the addition of a mortar collar, composed of one part Portland cement and one part sand, M2 a G. {~ ~~ ~ and having a width of six (6) inches and a thickness equal to the thickness of the wall of the pipe less one-half inch, placed during construction. ~'. ,. Joints of plain (unxeinforced) pipe shall be of the bevel, overlapping or bell and spigot type and shall be thoroughly sealed. A mortar collar, composed of one part Portland cement and one part sand, and having a width of six (6) inches and a thickness equal to the thickness of the wall of the pipe less one-half inch shall be placed around the pipe at joints of the bevel or overlapping type. CONSTRUCTION A trench shall be excavated to grade and line, as given by the Engineer or to one (1) foot below grade, if required, and backfilled with gravel or other approved material, and tamped to grade to in- sure an unyielding foundation. Compensation for additional excavation will be made at the contract price per cubic yard for "Excavation for Structures." Compensation for the backfilling and tamping to the grade of the bottom of the pipe will be made by Force Account except where the backfilling is called for on the plans. While laying the pipe the joint shall be sealed as specified above, care being taken to protect the joints until the mortar has thoroughly set. All pipe shall be laid with the bell or larger end up stream. Pipe having a bevel, butt or overlapping joint shall be thoroughly cleaned before the mortar collar is placed. A form shall be used to hold the mortar in place on the lower two-thirds of the collar or wet earth shall be carefully packed around the lower two-thirds of the mortar collar as it is placed. After the pipe is placed, the trench shall be backfilled with gravel or other suitable material and thoroughly tamped as backfilling progresses. Special attention shall be given to tamping joints. Concrete pipe, thirty-six (36) inches or more in diameter, to be placed under embankment of .eight (8) feet or more, shall be reinforced during construction of embankment with four by four posts placed in a vertical position. The posts shall be lightly wedged in place at three-foot intervals- where the em- bankment is six (6) feet or more over the pipe. If there will be water in the pipe' during the construc- tion of the embankment, the posts and wedges shall be soaked in water twenty-four (24) hours before being placed. VITRIFIED CLAY CULVERT• PIPE: Vitrified clay culvert pipe shall be of .the best quality, double strength and salt-glazed. They shall be sound and well burned throughout their thickness, impervious to moisture, with a clear ring, smooth and well glazed on the interior and exterior surfaces, free from cracks, flaws, blisters, fire-checks. or other imperfections, Any pipe which varies between any two diameters more than three per cent (3 Jo) or which betrays in any manner a want of thorough vitrification, or the use of improper or insuf- ficient materials or methods in the manufacture shall be rejected. TESTS: Vitrified clay culvert pipe shall comply with the specifications of the American Society of Testing Materials, Serial Designation C13-24 and all subsequent amendments thereof, unless otherwise stated in these specifications, and all tests shall be made in accordance with the A. S. T. M. specifications. The State Highway Engineer shall be permitted to select specimens, mark pipe, etc. as outlined in the above specifications. M3 INSPECTION: All pipe shall be subject to inspection at the-point of delivery. All pipe shall be free from fractures, large or deep cracks and blisters, laminations and surface roughness and shall be subject to rejection on account of the following (a) Fracture or cracks passing through the shell or socket, except that a single crack at either end of a pipe not exceeding two (2) inches in length or a single fracture in the socket not exceeding three (3) inches in width nor two (2) inches in length will not be deemed cause for rejection unless these de- fects exist in more than five per cent (5%) of the entire shipment or delivery. (b) Blisters where the glazing is broken or which exceed three (3) inches in diameter, or which project more than one-eighth (1/8) inch above the surface. (c) Laminations which indicate extended voids in the pipe material. (d) Fire cracks or hair cracks sufficient to impair the strength, durability or serviceability of the pipe. (e) Glaze which does not fully cover and protect all parts of the shell and ends, except that glaz- ing will not be required on the outer surface of the barrel at the spigot end for a distance from the end equal to two-thirds (2/3) the depth of the socket or spigot for the corresponding size of the pipe: (f) Failure to give a clear ringing sound when placed on end and dry tapped with a light ham- mer. A trench shall be excavated to grade and line, as given by the Engineer or to one (1) foot below grade, if required, and backfilled with gravel or other approved material, and tamped to grade to in- sure an unyielding foundation. Compensation for the additional excavation will be made at the con- tract price per cubic yard for "Excavation for Structures." Compensation for the backfilling and tamping to the grade of the bottom of the pipe will be made by Force Account except where the back- filling is called for on the plans. Particular attention shall be paid to excavation for the bells. of the tile, to prevent the bell from bearing on the foundation. Clay pipe shall be laid with the bell end up stream and all joints shall be cemented with Portland cement mortar mixed in the proportion of one (1) part cement and one (1) part sand. Vitrified clay culvert pipe shall be backfilled with sand, gravel, clay or loam which is free from large rock. The backfill shall be brought up to a depth of one (1) foot over the bell ends of the culvert and shall be tamped as backfilling progresses, to insure full support under the pipe. Payment. Culvert pipe will be paid for at the, contract price per linear foot of pipe in place, which shall be full compensation for furnishing the pipe, cementing joints, backfilling and tamping, and all other incidental work except as stated under Construction, on Page M-3. Excavation of the trench will be paid for at the contract price per cubic yard for "Excavation for Structures." See Page D 2 for re- moval of structures. Headers or End Walls. Headers or end walls shall be constructed where called for on the plans and of the materials and ,dimensions indicated on the plans. REMOVING PIPE CULVERTS: Where shown on the plans or designated by the Engineer, the contractor shall take up existing pipe culverts and place them on the edge of the right of way. If not fit for further use, the pipe shall be disposed of as directed by the Engineer. For compensation see "Removal of Structures," page D 2. Where the removed culvert is not replaced by a new structure, compensation for removal of the pipe shall be covered by the contract price per cubic yard for "Structure Excavation." RELAYING PIPE CULVERTS: Removed culvert pipe shall be relaid where shown on the plans or where designated by the Engi- neer. The contract price per linear foot for relaying culvert pipe shall be full compensation for all labor,. materials, tools and equipment employed in connection with the transportation and relaying of the pipe. M4 TILE DRAINS DESCRIPTION fit. such places as shown on the plans, or as designated by the Engineer, pipe drains shall be con- structed. They shall have suitable outlets into culverts to drain water entirely away from the road. They shall be constructed to the line and grade furnished by the Engineer and in accordance with the plans. POROUS TILE: Porous Clay Drain Tile shall be burned from clay or shale, free from pebbles and other foreign substances which impair its strength or durability. The the shall have a smooth interior and square ends. It shall not vary from circle more than ten per cent of its internal diameter. Concrete Drain Tile shall be composed of one part of Portland cement and three parts of sand of the quality and grading specified under Concrete Structures. The the shall be dense and free from rough or porous pockets. It shall be straight and shall have a smooth interior and square ends. It shall not vary from a true circle more than five per cent of its internal diameter. A trench shall be excavated six (6) inches below grade of tile. and .baekfilled to grade line with fairly clean gravel. The ends of the the shall be laid in close contact, covered with a piece of burlap six (6) inches wide and long enough to wrap one and one-half (11/2) times around the pipe, giving double thickness to the top half. The trench carrying the pipe shall then be baekfilled with gravel or other suitable material. If located within the shoulder lines of the roadway the backfili shall be thoroughly tamped. PAYMENT : Pipe drains shall be paid for at the contract price per linear foot of pipe in place, which shall be full compensation for furnishing the materials, laying, and all other work incidental thereto, egeept baekfilling with gravel, and excavation. Excavation for the trench will be paid for at the contract price per cubic yard for "Structure Ex- cavation." Backfilling with gravel will be paid for at the contract price per cubic yard for "GFravel Back- fill." N1 GUARD RAIL DESCRIPTION Guard rails shall be constructed where indicated on the plans or directed by the Engineer, and shall conform in all respects to the requirements of the Standard plans for same. MATERIALS Materials shall be as indicated on the Standard Plan for guard rails for the type of guard rail to 'be used. Timber post and guard rails shall conform to the specifications for "Timber Structures." Cement, sand, gravel and reinforcing steel shall conform to the specifications for those materials as specified under "Concrete Structures." The timber shall be Select Common Douglas Fir. Concrete posts shall be precast to the dimensions shown on the plans. The concrete shall be made up of one part cement to two parts fine aggregate and three and one-half parts of coarse aggregate (1:2:31/2). The surface shall be smooth and true. The posts shall be given a Class "B" finish after they are set in place. The holes for the base of the posts shall be of the minimum dimensions shown on the plans. If round post holes are dug they shall have a minimum diameter of fifteen (15) inches. The concrete in the base shall be Class "C" concrete. The posts and the rail shall be set to the true line and grade of the highway. CONSTRUCTION: Timber posts shall first be creosoted for a distance of three and one-half (31/2) feet at their butt ends. Creosoting shall conform to the specifications for creosoting specified for "Timber Struc- tures," using dipped process. They shall then be set vertically, to the full depth shown on the plans, and accurately lined. The post holes shall then be backfilled, using especial care to see that only suitable material is used in the backfill and that it is thoroughly tamped. The top of .the posts shall be sawed to exact grade after the tamping of the backfill is finished. The railings shall be securely ,spiked in place and the entire guard rail, except the lower edge, shall be painted with two coats of white lead and linseed oil, as specified for "Priming Coat" and "Finish Coat." The paint shall conform to the speci- fications for painting specified for "Timber Structures." Joints in the rail shall be staggered and the pieces of lumber shall have a minimum length equal to two panel lengths except at the ends, where lumber of one panel length shall be used. Lumber for guard rails shall be kiln dried or if not kiln dried it shall be piled on or near the work and in a manner to facilitate drying. The layers in the piles shall be separated with narrow pieces of lumber and a clearance of approximately one-half inch shall be left between pieces in the same layer. The lumber shall be protected from rains and shall be left in the piles for a period of forty-five days. PAYMENT Guard rail will be -paid for at the contract price per linear foot of guard rail complete in place, which price shall include all materials and labor, excavating, backfilling, painting, and other work in- cidental thereto. 01 SPECIFICATIONS FOR GRAVEL SURFACING ONE-COURSE SUSGRADE: Immediately in advance of depositing the surfacing material, the subgrade shall be brought to the proper line, grade, and cross-section. Shoulders shall be formed true to line and grade, and free from humps, depressions or other inequalities. All ruts and inequalities shall be levelled and filled by means of a log drag, or other approved device. Any existing ruts which contain storm water shall be drained as far as possible in advance of the preparation of the subgrade. The Contractor shall constantly keep the subgrade in good repair, draining ruts, and shaping the subgrade by drag- ging or other means as may be found necessary in order to provide a uniform and well compacted subgrade. Any stones exceeding two (2) inches in the largest dimension which are found upon the subgrade in advance of depositing the surfacing material shall be removed by the Contractor and the cost of removing same shall be included in the contract price per cubic yard of surfacing material in place. DESCRIPTION: This surfacing shall consist of one course, having the dimensions and cross-section shown on the plans, being composed of screened gravel containing- natural soil as binder, constructed on the sub- grade as hereinbefore specified, in accordance with these specifications. MATERIAL The gravel to be used for surfacing shall be of reasonably uniform quality throughout, free from soft or disintegrated stones, or other objectionable matter, and shall be approved by the Engineer. The surfacing material shall contain such a percentage of clay or other binding material as the Engi- neer may direct, but if in the judgment of the Engineer there is an excess of such fine material, such excess shall be screened out and wasted. In no case shall the clay content including binding material exceed fifteen (15) per cent. The gravel shall be screened by means of a rotary screen to meet the following requirements Passing a one and one-half (11/x) inch rotary screen 100%. CONSTRUCTION METIiODS The surfacing material shall be deposited upon the subgrade to the amount, width, and cross- section, shown on the plans. The spreading shall be done as soon as the surfacing material is dumped, and the material shall be uniformly distributed. In order to secure a maximum amount of uniformly smooth and compacted surface the contractor will be required, as far as practicable, to do his hauling over the surfacing as it is placed; to construct the surfacing beginning at the point of loading and working away from that point; and to thoroughly drag the surfacing continuously during the course of construction, in a manner satisfactory to the Engineer. Clay or other suitable binding material shall be added in such quantities not to exceed the total clay content of fifteen (15) per cent as may be directed by the Engineer, so that the surfacing material will pack firmly under traffic. MEASUREMENT AND PAYMENT: The amount of surfacing material to be placed on the roadway may be increased or decreased at the option of the Engineer as the conditions may require. The gravel will be measured on the trucks or wagons at the point of delivery on the road. Payment for surfacing will be made at the contract price per cubic yard in place, which price will be full compensation for preparing the subgrade and constructing and finishing shoulders, furnishing all gravel, binder, and all tools, equipment, labor, and other incidentals necessary to complete the work.
