designation. The following Jefferson-Port Townsend Shoreline Management Master
Program sections are applicable to this ''evelopment:

SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT 15-81
CONDITIONS OF APPROVAL
1. The permittee will ensure that any remaining storage tanks are uncovered and
removed prior to the placement of fill material .
2. The permittee shall remove all debris from the site prior to placement of the fill .
3. The fill material shall be clean soil , sand, or gravel . Clean soil , sand, or
gravel is that which is substantially free of sod, debris, and vegetation. Once
placed, the fill shall be covered with topsoil and planted with vegetation as soon
as conditions permit.
4. In the event that rip-rap is not placed, other erosion control methods such as
sloping and planting shall be employed.

SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT APPLICATION
PROPOSED PROJECT
The proposed project is the demolition and removal of wooden pilings and concrete
foundations and the placement of 7,500 cubic yards of landfill and approximately 150
feet of rip-rap. The project site is south of the intersection of Water Street and
Sims Way between Scott and Walker Streets and described as that part of Tideland
District 94 of the tidelands of the first class in front of the City of Port Townsend,
now platted as all of Block 19 of L.B. Hastings First Addition to the City of Port
Townsend.
Surrounding properties are developed with commercial uses and public streets.
The site is currently covered with low vegetation and small shrubs in addition to the
presence of old building foundations.
FINDINGS
1. The following sections of the Jefferson-Port Townsend Shoreline Management Master
Program apply to the proposed project: 1.20 "Purposes", 2.40(7) "Secondary Uses" ,
4.20 "Urban", and 5.210 "Landfills. "
2. The proposed project has been administratively classified as a secondary use in an
urban shoreline.
3. The proposed project is site preparation for eventual construction of multi-family
residences, possibly containing some commercial uses.
4. The City of Port Townsend Zoning Ordinance designates the site C-3 commercial ,
which requires a conditional use permit from the City of Port Townsend.
5. The proposed project will not be fill:inq wetland and does not require a U.S. Army
Corps of Engineers permit.
6. The proposed project has been processed and reviewed in accordance with the Wash-
ington State Environmental Policy Act Guidelines by the City of Port Townsend as
lead agency. The city has issued a declaration of non-significance thereby declar-
ing the anticipated environmental impacts do not merit the preparation of an
environmental impact statement.
7. Notice of the application was made by publishing legal notices in the August 12
and 19, 1981 editions of the Port Townsend Leader, posting the subject site with
notices on August 21 , 1981, and notifying immediate adjacent property owners and
appropriate agencies by mail .
8. Notice of the public hearing scheduled for October 21, 1981 was made by publishing
a legal notice in the October 14, 1981 edition of the Port Townsend Leader and
notifying by mail appropriate agencies, :immediate adjacent property owners , and
parties requesting notification.
SUGGESTED CONDITIONS OF APPROVAL
Issuance of a shoreline management substantial development permit requires compli-
ance with the Washington State Shoreline Management Act and the applicable policies
and performance standards of the Jefferson-Port Townsend Shoreline Management Master
Program and the following conditions:
1. The permittee will ensure that any remaining storage tanks are uncovered and removed
prior to the placement of fill material .
2. The permittee shall remove all debris from the site prior to placement of the fill .
3. The fill material shall be clean soil , sand, or gravel . Once placed the fill shall
be covered with topsoil and planted with vegetation as soon as conditions permit.
4. The permittee shall seek and obtain permission from the City of Port Townsend prior
to the placement of any rip-rap on city property.
5. In lieu of rip-rap, erosion control measures such as sloping and planting shall be
employed.
SHORELINE COMMISSION ACTION
At their regular monthly meeting October 21, 1981 the commission held a public
hearing on the proposed project and reviewed the findings and the suggested conditions
of approval . The commission, by formal motion, approved the stated findings. The

commission, by formal motion, approved the suggested conditions of approval subject to
the following revisions:
1. Condition 3 was changed to read: "The fill material shall be clean soil , sand, or
gravel . Clean soil, sand, or gravel is that which is substantially free of sod,
debris, and vegetation. Once placed, the fill shall be covered with topsoil and
planted with vegetation as soon as conditions permit. "
2. Conditions 4 and 5 were deleted.
3. A new Condition 4 was added which would read: "In the event that rip-rap is not
placed, other erosion control methods such as sloping and planting shall be
employed."
The commission determined the proposed project was consistent with the policies
of the Washington State Shoreline Management Act and the goals, policies , and applicable
performance standards of the Jefferson-Port Townsend Shoreline Management Master
Program. Based on this determination, the commission, by formal motion, recommended
approval of the project subject to the stated conditions as revised.
CITY COUNCIL ACTION
At their meeting November 3, 1981, the Port Townsend Council reviewed the proposal
and the findings and suggested conditions of approval recommended by the shoreline
commission. The council , by formal motion, approved the findings after determining
the project did not require a conditional use project as stated in Finding 4. The
council , by formal motion, issued the permit subject to the conditions of approval
recommended by the shoreline commission.

APPENDIX A
/4. The purpose of this proposal is to prepare the subject
site for eventual construction of a multi-family residential
project, perhaps containing mixed commercial.
The site is the former location of the Theriault Building
warehouse and the Harper Oil Company bulk plant and fuel
transfer facility. Both previous uses have been removed, with
the exception of on-shore wooden support pilings, concrete
foundations, and a small pier.
This project will remove the wooden pilings, demolish the
concrete foundations, and place clean, sandy-gravelly fill to
an average depth of three ( 3) feet. Where necessary in the
southern section, a low-level rock rip-rap perimeter will be
placed to contain fill overspill. All aspects of the project
will be above the line of Ordinary High Water and Mean Higher
High Water.
The property is zoned C-3 Commercial. The Shoreline
Management designation is "Urban" which permits landfill as a
Secondary Use. The proposed project will be accomplished in
compliance with Section 5. 210 of the Jefferson-Port Townsend
Shoreline Master Program and is expected to be completed by
December of 1982.

ATTACHMENT A
6. The proposed project is to remove the wooden pilings,
demolish concrete foundations, and place clean, sandy-gravelly
fill to a maximum volume of 7 , 500 cubic yards. The landfill
will average roughly three ( 3) feet of depth over the site,
and will be bounded in the southerly sector by a low-level
rock rip-rap retainer. All work will be accomplished above
the intertidal area and above the line of Ordinary High Water.
The subject site is slightly less than one ( 1) block in area.
7 . The proposed project is located immediately south of
the intersection of Sims Way ( S.R. 20) and Water Street. It
is bounded on the west by unconstructed Scott Street; on the
east by partially-constructed Walker Street; and on the south
by unconstructed Front Street. The southeastern and
southwestern corners of the property are the only portions
having frontage on Port Townsend Bay.
All surrounding property is utilized for commercial
business, parking areas and streets.

Substantial Development Permit 15-81
Dear Mr. Needham:
Your request to build a deck over a portion of the pavement area running
behind the Port Townsend Plaza complex (Blocks 11 and 12 and portions of vacated
Fillmore and Front Streets within the Original Townsite of Port Townsend) has
been reviewed by this office. We find your project to be (1) minor new construc-
tion; (2) substantially behind the ordinary high water line, and consistent with
traffic needs.
Based on these findings, your proposal has been determined to be consistent
with Section 3.40 of the Jefferson-Port Townsend Shoreline Management Master
Program and thereby exempt from the permit requirements of the Washington State
Shoreline Management Act.
Additionally, the work you performed on May 30, 1984 validates Shoreline
Substantial Development Permit 15-81. Please keep in mind that this permit
expires on November 3, 1986.

for the work to be done .
We have delayed proceeding on the project in-as-much as the
property abutting the area that the permit covers deteriorated
with the winter storms to the point that eminent structural
damage would result if steps were not taken to protect the
Tides Inn from further erosion .
On January 3, 1984 , Shold Excavating Inc. is proceeding as
the tides and weather permits to coordinate both jobs and
complete phase one of the work by removing the old concrete
foundations and storage tanks and then installing the first
segment of rip-rap.
Phase two of the project of completing the rip-rap and fill
will be commenced at such time as a "best useage" survey and
report is completed and the exact plot plans are issued to us.

work report on our progress in the near future.

Dear Sir:
I am writing regarding the permit requested by the Washington
State Department of Transportation to dispose of dredge spoils from
the new Port Townsend ferry terminal . I understand the department
proposes a deep water disposal site.
I know from past experience there are many problems and environ-
mental concerns connected with disposal of dredge spoils in marine
waters . In some cases , objections and concerns have delayed approval
of dredge spoil disposal sites . If that should happen in this case,
it could affect the time schedule for completion of the ferry
terminal .
It should be noted that there is an alternative disposal site
available . About one year ago Rir. . Pickett of Community Investments,
Ltd. in Port Townsend, obtained a shoreline substantial development
permit for a landfill on property he owns on the Port. Townsend
waterfront. This property is located approximately one-quarter
mile southwest of the new ferry terminal . He was anticipating
the contractor doing the dredging on the ferry terminal project
might need a nearby disposal site . Although all of the dredge
spoils could not be placed on the approved site, Mr . Pickett has
other properties further inland that could r_ ecieve the excess
material . Those sites would not need a shoreline permit, since
they are beyond the Shoreline Act jurisdiction.
Mr. Pickett is still interested in having his property used for
dredge spoil disposal . It has an approved shoreline permit for
that purpose. It is conveniently close to the proposed ferry
terminal . Any objection the contractor or the State may have to
the use of Wr . Pickett ' s property can, I ' m sure, be overcome .
We would appreciate the opportunity to discuss the matter.

Dear Roger :
You have asked me about the meaning of the "Land fills ,
reclamation to improve steep, low or otherwise unusable
land. " A good question.
I am afraid that I will have to say that the Conditional
Use classification is an anomaly which must have arisen
from a misunderstanding . Filling and reclaiming is ,
obviously not a use at all. At least, not within the
definition of "use" as found in Ordinance No. 1625.
"2.100 Use. The purpose land or buildings or
structure now serves or for which it is occupied ,
maintained, arranged , designed or intended. "
Further , the definition of Conditional Use refers , to
nonconforming "uses. "
In 1975 , subsequent to the passage of Ordinance No. 1625
in 1971 , the City adopted the Uniform Building Code, which
sets down the requirements and standards for excavation
and grading. Even had 1625 provided for permit requirements ,
the UBC would have superseded it.
In short , what ever was meant by the section in question, it
cannot mean that a conditional use permit is required for
the filling and grading of unimproved land. For the moment,
we will assume that the drafters of the ordinance had some
possible use in mind which we do not now envision , but they
could not have been looking at the mere filling , grading , or
excavation of raw land. If they were, the UBC has rendered
their meaning void.

us to deny to a land owner the right to level and grade
his land for no reason. Obviously, 1625 does not give a
reason for treating grading asa use in the table of permitted
uses.

honored. Under the state statutes, a shoreline substantial development permit
must be completed within five (5) years from the date of issuance; a one time,
one year extension may be granted. The permit for 15-81 was issued
November 3, 1981, an extension was granted in November 1986, and the permit
with the extension expired on November 3, 1987.
You may wish to reapply for the same project or incorporate uncompleted

cation and professionalism on our county shoreline commission.
Your energies devoted to the shoreline and related matters , is
much appreciated.
As we have discussed, Service Activities Corp. , has a current
permit in effect for the adding of rip-rap to the water front prop-
erties at the Tides Inn. To protect , preserve and improve this
valuable natural water front area for the benefit of the community,
we have done a fair amount already in adding rip-rap and ap-
