The proposed use is consistent with the goals, policies and provisions of the Tri-Area Community Development Plan, and the Development Code. Subject to the conditions outlined in the attached Certificate of Compliance, project approval is hereby granted for the proposed development . The Certificate of Compliance is a binding document and commits the applicant to: ( 1) the proposed project as submitted, ( 2) the applicable development standards outlined in Section 6 of the Development Code and (3) the attached conditions of approval . The Certificate of Compliance also provides a basis upon which a building permit can be issued. Once a building permit is issue construction may begin. Prior to occupancy or use of the facilities a final inspection must be conducted to confirm that all conditions and requirements have been met. We reviewed the environmental checklist and have the following comments. Any groundwater withdrawals in excess of 5, 000 gallons per day or for the irrigation of more than one-half acre of lawn or noncommercial garden will require a water right permit from Ecology. The proponent is responsible for inspecting the site to de- termine the location of all existing wells. Any unused wells must be properly abandoned as described in WAC 173-160-415 through -465. This includes any dewatering wells installed during the construction phase of the project. Any water wells shall be constructed in accordance with the provisions of WAC 173-160 by a driller licensed in the State of Washington. Any wells that may be drilled must be a minimum of 100 feet from any potential source of contamination. The proposed building is 6,300 square feet in size and consists of approximately 50 rental compartments. Building number one consists of 5,700 square feet. Additional rental storage buildings are contemplated by the proponent. Prior to construction of improvements on the site, the applicant shall submit a stormwater management plan for the proposed project. The stormwater management plan shall be reviewed and approved by the Jefferson County Public Works Department. He has determined that all of the building lights are equipped with diffusers and are directed away from adjacent streets and properties. He is also of the opinion that the lights do not create a condition of glare to passing traffic. Both the shop and mini- storage units were previously determined to be consistent with the permits using the definitions commonly applied at the time the permits were issued. Subsequent development of the mini-storage facility will require Interim Zoning Approval and may require review under the State Environmental Policy Act. I will consider amending the Administrative Rules of the Interim Zoning Ordinance to define "hooded" lighting and remove any confusion about whether diffusion lenses qualify. Amending the definitions will require review by the Planning Commission and Board of County Commissioners, so I suggest that you inform them of whether you would support such a change. Ward : My name is Robert Hyskell. My wife and I purchased the dwelling at 120 West Eugene Street, Port Hadlock , in June of 1989. The former owners , Cindy and Harry Thayer leased the property back to us for a year and we took residence in June of 1990. I am enclosing four photographs for information purposes. Please direct your attention to the photograph marked "A" . This was the condition of the property in June of 1989 . The photo was taken looking directly west from our property. The automobile in the middle distance is parked in our driveway. The house to the right belongs to our neighbors , the David O'Kanes. The O 'Kanes house is next to 10th Street , as is ours. We are both at the intersection of West Eugene Street and 10th Street. At the time this photograph was taken , the trees formed a beautiful wall along 10th Street from West Anderson to West Eugene Street and beyond. Next , please look at the photo marked "B" . This is the same property as it looked after Mr . Forker clear-cut it, levelled all the trees, paid no attention to pleas by Mr. & Mrs . Thayer to "leave a buffer" at 10th Street ; and in 1992 erected these ugly, squat, orange monsters. Now, granted , Mr . Forker owns that property and he has every legal right to clear it . I would however like to point out that he demonstrates absolutely none of the qualities that are associated with a "good neighbor" ! Mr . Forker cleared the trees, left a mass of weeds and garbage, and is now proceeding to construct (according to the plans submitted to your office) , mini-storage buildings "A" through "Q" . Obviously I had no control over what was done previously . HOWEVER, I direct your attention to the photo marked "C" . This is the view from my living room at 10 PM of any evening ! The ugly monsters have bright orange lights that are visible as far as the eye can see. The photo marked "D" is the view from the upstairs bedroom window that faces west and overlooks the infamous "mini-storage" buildings . (The trees that you see are ours , Mr. Forker removed the rest) . - page 2 - Craig Ward - Now Mr. Ward , if your office has approved of Mr. Forkers plans for the future, I am going to be looking at SEVENTEEN squat, ugly buildings , each of which has a light on either end and an additional five lights on either side, a total of twelve lights per building times seventeen; a GRAND TOTAL of TWO HUNDRED AND FOUR miserable glaring orange lights ! ! ! How would YOU like to have this view from YOUR living room or bedroom window? I submit to you that this is intolerable. Mr . Ward , I am a meek, peace loving individual . I respectfully request that you require Mr. Forker to provide hoods for his lights per the above stated Conditions Of Approval , (incidentally, the lights are mounted on the exterior wall, NOT under the eaves) and further, to provide some sort of reasonable landscaping other than weeds and dirt to make our neighborhood an attractive part of the northwest scene. I also insist that said landscaping be maintained per Item (2) of those conditions . To summarize: 1 . . . The lights mounted on the mini-storage buildings are NOT hooded , and they are NOT directed away from the adjoining public rights of way. Although this did not constitute an illegal act, we consider it inconsiderate to say the least. Further, had the trees been left along 10th Street , the complaints regarding the offending lights would be rendered moot. Our system of government provides us with people like yourself to turn to in times of need , when we are unable to find answers to our problems through normal one-on-one negotiation. I am hopeful that you will realize that this letter, although highly emotional , is well meant. Please let me know if I can be of further assistance in resolving this matter. In violation of Item 1 of your Conditions of Approval, none of the glaring lights on the east side of the buildings are hooded. Almost all of these objectionable lights adversely affect my property (Irondale No. 7, Block 86, Parcel No. 961-808-607) which is located across 10th Avenue . Most intrusive of the lights is the large yard light on the repair building. That glares into our bedrooms all night, every night. None of this would have been a problem had Mr. Forker not elected to cut all the trees on the lot bounded by 10th Avenue, West Anderson and West Eugene Streets two years ago. That desecration opened up a broad viev'of his commercial operations (repair garage, chain link fence, orange-doored storage units, junk vehicles, etc. , etc. ) from the Cedar Park residential area. This act on his part was done in spite of the objections of a previous owner here : Mrs. Cindy Thayer of Coldwell Banker Realty and violated the privacy of all the owners. Now the addition of more garish orange doors and more unhooded lights compounds the problem, adding insult to injury! I, therefore, request immediate relief from the offending lights. I located the residences of the two complainants, at 120 W. Eugene and 121 W. Eugene. Both residences are on the corner of a street perpendicular to 10th Avenue. The Hyskell residence is approximately 200 feet east of the closest mini-storage building. I noted the presence of an existing group of mixed trees along the west side of the Hyskell residence. This group of trees consists of a mixture of alder and cedar and includes assorted underbrush. It is an area approximately 25 feet by 50 feet and does provide a visual screen between the residence and the mini-storage buildings. The Hyskell residence is a two- story structure and appears to have a bedroom located on the second floor. It faces west, toward the mini-storage buildings. The O'Kane residence is approximately 250 feet northeast of the closest mini-storage building. The topography of the area places this residence at a lower elevation than the Hyskell residence and the mini-storage buildings located to the west. A small group of cedar and fir trees are located between the O'Kane residence and 10th Avenue. This group of trees covers an area approximately 20 feet by 40 feet. It provides some visual screening between this residence and the mini-storage buildings. 4. There are three other residences located in the immediate area. One residence is approximately 125 feet from the mini-storage buildings. The second and third are between 200 and 225 feet from the mini-storage buildings. A small grouping of cedar trees is located on the west side of the closest residence. Some small trees and brush are also located between this residence and the mini-storage buildings. Neither of the other two residences have any trees or other vegetation between them and the storage buildings. The area west of 10th Avenue and the mini-storage project is vacant land. This is an area approximately 75 feet by 250 feet. It is owned by George Forker. Mr. Forker stated that he had this area logged about five years ago. This area is bounded by a six foot security chain-link fence on the west. Mr. Forker stated that 18 inch fir trees spaced 10 feet apart have been planted along the west side of the chain-link fence. A copy of the staff field sketch is attached for reference purposes. The mini-storage buildings are single-story pre-fab concrete type construction with orange metal doors. Between 4 and 5 light fixtures have been placed on the side walls of each building. A single light fixture has been placed on the east end of the second mini-storage building. Each light fixture has a plastic lens cover which diffuses the light. These lights are high pressure sodium surface mounted lights. The bulbs are 70 watt and emit an amber colored light. A 50 and 90 watt bulb are also available. When the lights are on, the area between and surrounding the buildings is softly lite, and provides enough light for a tenant to access to a storage unit. Mr. Forker indicated that he would provide the manufactures specifications on the high pressure sodium light fixtures. A mercury vapor light has also been mounted on a adjacent shop building.
