MINUTES
Week of February 11, 2008
Chairman Phil Johnson called the meeting to order in the presence of Commissioners David
Sullivan and John Austin.
PUBLIC COMMENT PERIOD: The following comments were made by citizens: Several
people commented on the security in the Courthouse; Security Services Northwest is having to turn away
business due to ongoing legal issues with the County; a webcam should be installed in the Commissioners
Chambers so that people don't have to drive to the Courthouse to attend the meetings; next January when
the Board approves proclamations honoring the School Boards, the Sequim School District should be
included because the children in Gardiner attend Sequim schools; concerns were expressed about the
removal of a citizen from the Board's meeting on February 4; several people commented on Commissioner
Phil Johnson's announcement to run for re-election; the County and the residents of Qui1cene worked
together to put in a community water system and now there is a need for a large onsite sewer system because
several septic systems are failing; the State Department of Ecology (DOE) is ignoring the public input over
the last two years regarding the low flow regulations; and several people do not attend public meetings to
give their input because they are intimidated due to the current polarization in the County.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Austin
moved to delete Item #2 and #3 and approve the balance of the Consent Agenda as presented.
Commissioner Sullivan seconded the motion which carried by a unanimous vote.

HEARING NOTICE re: Proposed Critical Areas Ordinance (CAO): (Item #2 on the
Consent Agenda) Director of Community Development AI Scalf submitted a revised hearing notice for the
Board to review. He explained that wording was added to clarify that written comments on the CAO will
be accepted by the Board from February 13, 2008 to March 5, 2008.
Commissioner Sullivan moved to approve the revised hearing notice for the draft CAO setting the hearing
for Wednesday, February 27,2008 at 6:30 p.m. at Chimacum High School Auditorium. Commissioner
Austin seconded the motion which carried by a unanimous vote.
AGREEMENT re: Nursing Services for Jail Inmates: (Item #3 on the Consent Agenda)
Commissioner Austin pointed out a spelling error on page 6 of the document and requested that it be
corrected. He moved to approve the revised agreement for nursing services for jail inmates with Patricia
Wiggins, RN. Commissioner Sullivan seconded the motion which carried by a unanimous vote.
COMMISSIONERS BRIEFING SESSION: The following items were discussed:
. Commissioner Sullivan rode the new Port Townsend/Keystone ferry last week on a fairly calm day.
It rides higher and catches the wind more than the old boats. It appears that the legislation for State
funding for the new ferries will be passed.
. There are WRIA 17 and WRIA 18 meetings this week, and next Friday there may be a final WRIA
20 meeting.
. There was a discussion about the proposed State legislation to assist counties with Clean Water
District funding.

. Chairman Johnson has an Olympic Region Clean Air Agency (ORCAA) meeting in Olympia on
Wednesday.
. There was a meeting about the Port Townsend Post Office facility last week. Chairman Johnson
reported that providing ADA access to the building would be difficult and would require some
creative thinking. It was clear to Postal Service representatives that the community values the
building.
. The Board discussed a request to revise their Monday meeting agenda to schedule the County
Administrator Briefing in the morning so that citizens who attend the Public Comment Period don't
have to spend most of the day at the Courthouse. The Board agreed to wait and see what the new
County Administrator wants to do.
APPROVAL OF MINUTES: Commissioner Austin moved to approve the minutes of the
December 10, 2007 regular meeting and the December 12,2007 Special Meeting as presented.
Commissioner Sullivan seconded the motion which carried by a unanimous vote.
Matt Tyler, Parks and Recreation Manager re: Parks and Recreation Advisory Board
Study Circles: Matt Tyler introduced Parks Advisory Board member Liz Coker who reviewed the history
of study circles and explained how they work. The results of a study circle conducted at a Parks Advisory
Board meeting were reviewed. The subject was: What makes you use a park? The study circle came up
with several suggestions to make parks more "user friendly."
The Parks Board is looking for people who are willing to go out into their communities to facilitate the
study circles. Approximately 10-12 neutral facilitators will take part in a 4-day training. They are
estimating that there will be a total of60 study circles. When they have finished that phase of the project,
an action forum will be scheduled at a large venue like Chimacum High School auditorium. Each study
circle will review three actions they recommend on an individual, collective and policy level.
This is a grant funded activity which includes the training of facilitators. The process will take about 4
months. Matt Tyler stated that the Parks Advisory Board took unanimous action to use this process. He
presented the Board with a letter describing the proposal and asked the Board to support the process.
Commissioner Austin moved to have the Chair sign the letter showing the Board's support for the project.
Commissioner Sullivan seconded the motion which carried by a unanimous vote.
Eve Dixon, Jefferson County Noxious Weed Control Board Coordinator re: Noxious
Weed Board Vacancies and Possible Appointment: Eve Dixon reported that the Weed Board has several
vacancies. The open positions were advertised twice last year and five applications were received. These
applicants have been validated by the Auditor's Office. According to State law, the Weed Board members
must serve until their replacement is appointed. A quorum ofthe Weed Board is required to hold a public

hearing to review the applications and make a recommendation for appointment to the County
Commissioners. She explained that she ran into a problem trying to get a quorum of members whose terms
were expired because one member has moved from the area, one member would not attend a meeting, and
one member is out oftown for several weeks. When she contacted the State Weed Board Executive
Secretary she was told that the law also allows the County Commissioners to appoint a person to fill a
vacancy. She contacted Jim Storey, who represented District #3, and he submitted a letter of resignation.
She asked the Commissioners to accept the resignation and appoint Linda Davis to the District #3 position.
If Linda Davis is appointed, there will be quorum of the Weed Board and they will be able to hold a public
hearing to approve the nominations of the other members.
Commissioner Austin moved to appoint Linda Davis to the Noxious Weed Control Board representing
Commissioner District #3. Commissioner Sullivan seconded the motion which carried by a unanimous
vote.
COUNTY ADMINISTRATOR BRIEFING: The following items were discussed:
. The draft Critical Areas Ordinance information binders were distributed and the process was
reviewed.
. Interim and Permanent County Administrator hiring process update
. Building security and policy discussion
HEARING re: Proposed Paradise Bay No Shooting Area: The Chair opened the public
hearing in the Superior Courtroom and reviewed the hearing procedures. Assistant Planner Karen Barrows
reported that the No Shooting Area Review Committee met four times from July through October, 2007.
They made their final recommendation at a publicly noticed meeting on October 25. The first meeting was
organizational. The members of the core review committee were present: Al Scalf, Director of Community
Development, then Undersheriff Tim Perry (Sheriff Brasfield's designee), Ray Hunter, John Ebner and
Henry Werch, the Planning Commission representative. Henry Werch was elected Chair. Representative
stakeholders for Paradise Bay are Ken Merritt and Pat Bowen. They attended the second meeting. The
third meeting was a site visit.
Karen Barrows reviewed several maps showing the boundaries ofthe original petition area and the smaller
area that is recommended by the committee. She also presented a legal description and zoning map of the
area. The recommended boundaries are: Andy Cooper Road, Teal Lake Road, Paradise Bay Road and Fir
and Shore Drive. The boundary in the committee's recommendation is contiguous with the Port Ludlow
No Shooting Area. Tala Shores is not included.

Henry Werch explained that the committee set ground rules that the no shooting area would be based on
strict public safety guidelines, easily recognized on a map, and easily posted. They wanted to limit it to an
area that clearly demonstrated a hazard. After reviewing comments, the committee agreed that the area in
their recommendation met the criteria. Certain areas were excluded from the original proposal for the
following reasons:
. There was no history of endangerment.
. There wasn't a significant petition from the property owners.
. There are currently laws on the books that denote the water towers as a no shooting area and protect
them from vandalism.
. The County doesn't have jurisdiction over State lands.
Karen Barrows noted that DCD has received approximately twenty comment letters on no shooting zones
within the past few months and half objected to the committee's recommendation. The other half have
been about the proposed Chimicum Creek No Shooting Zone.
There was a discussion about where signs would be posted The Board asked why the shoreline was not
included in the no shooting area? Several ofthe committee members stated that defining a line would be
difficult because ofthe tide, the Sheriff s Office has not received complaints about shooting incidents on
the beach, it is private property and can be posted by the owner, and the topography of the slope ofthe land
between the road and the beach and the groundcover would prevent endangerment.
The Chair opened the public hearing.
Pat Bowen, Paradise Bay, stated that he is a Water District Commissioner. The waterfront on Paradise Bay
is a private beach and the property owners tell strangers to leave. It is important to protect the well heads.
It isn't locals that are shooting.
Commissioner Sullivan asked ifthe well heads are fenced? John Ebner replied that they are fenced and
posted with no shooting signs.
Ken Merritt, Port Ludlow, stated that the well heads are protected by State and Federal laws. The
committee looked at the terrain and the timber density. There were a few petitioners on the original
petition who lived near SRI04. There is a gravel pit in the area that has been used for target practice but he
couldn't find where a bullet could travel more than 35 yards from the pit without being stopped by a large
tree. The nearest house is a mile away. The committee also discussed the need to educate people.
Tom Thiersch, stated that he is concerned about the process, especially the first several committee meetings
which were not noticed publicly. The law says all meetings are declared open. Any testimony, discussions,
or deliberations during those meetings are void and the Board has to disregard any recommendations that
resulted from them. At the fourth meeting, the Undersheriff was asked ifthere were any statistics on the
number of shooting complaints that the Sheriffs Office had received in the proposed area. The Board
should have that information before they make a decision. The Board should consider facts and numbers,

The No Shooting Zone Ordinance states that there has to be a "reasonable likelihood" that humans may be
jeopardized. He didn't hear this mentioned at the meeting he attended and that is the only evidence that
counts because that was the only public meeting.
John Ebner, Port Townsend, stated that the comments he is about to make do not necessarily reflect the
views of any organization to which he belongs or the opinions stated at the No Shooting Area Review
Committee. The Jefferson County Code (JCC 8.50) and RCW 9.41.300 state that there needs to be a
"reasonable likelihood" standard when reviewing legislation establishing no shooting areas that are not
already proscribed by the State. The area recommended by the review committee is a compromise at best.
He still has concerns about the "reasonable likelihood" standard ofthe recommended boundary. Physical
surveys conducted by the committee produced no evidence that people are in danger of being shot by stray
bullets. As a County resident, he asked the Board not to pass the ordinance due to the extraordinary costs
involved regarding the required signage and the cost of an investigation if a defined border couldn't be
perfectly established. There are current laws on the books already, such as the RCW that deals with
reckless endangerment. There are also several WAC regulations.
June Sinclair, Seven Sisters Road, submitted a petition signed by several people in the area who have an
alternate proposal. The Seven Sisters community was included in the original petition, but the
recommendation by the committee has removed it from the boundary. They are located south of Paradise
Bay and east of Paradise Bay Road. There is an 82 acre day use State park which runs along the beach and
joins Shine Tideland Park which goes to the Hood Canal Bridge. Seven Sisters Road and the these parks
are high density use areas and people who live on the island of Hood Head have to access the mainland
from the road and the beach. They have colleted signatures from almost every home north ofthe State park
to the top of the hill to SR104. A few years ago, they were awakened by rifle shots at midnight outside
their bedroom window on the beach and they called the Sheriff.
Yuri Montgomerv, stated that he has a cottage on Hood Head Island which faces Seven Sisters Road.
Approximately a month ago, they were awakened by high powered engines going into the bay at 2 a..m. in
the morning. Gunshots were fired at about 5 a.m. He had no idea what was going on. He got in his boat
and went to investigate and a shot went by him. He is aware of what pellets do. Later he found out that
hunters were shooting birds in the lagoon. People use that beach for walking, jogging and birdwatching
almost 24 hours a day. He asked the Board to include the shoreline in the no shooting zone.
Michael Adams, stated that he is the Chair of the Marine Resources Committee although he is not at this
hearing in that capacity. He owns four parcels on Hood Head and a small shellfish business at the head of
Bywater Bay. They are adjacent to the State park. He would like to see the no-shooting zone continued
along Paradise Bay to the Hood Canal Bridge and include all of Hood Head. There is sensitive habitat in
the area that is critical to protect. There is a heron rookery, an osprey nest, two bald eagles nests, and
rhinoceros auklets are breeding there. A large number of people use Seven Sisters Road to access the State.
park beach and use the spit for clamming. When hunters are shooting from the water, they are shooting
directly into cabins immediately across the bay. They haven't experienced any rifle shots but they have had
people on Hood Head who target shoot without sufficient backstops with .22 caliber rifles. People who

have property on Hood Head use it mostly in the sununertime. The State is pushing people to use public
beaches and this is an incompatible mix of people and guns in such close proximity. Sometimes they have
to be on the beach in the middle of the night because of their shellfish business and hunters don't
necessarily know that.
Steven Elliott, Seven Sisters Road, stated that he has a house on the beach and he walks the beach every
morning. One morning when he and his wife were walking, there were duck hunters shooting. His wife
yelled, "People walking on the beach, stop shooting." They want the no shooting zone expanded to include
the beach.
Hearing no further comment for or against the no shooting zone, the Chair closed the public testimony
portion ofthe hearing.
Chairman Johnson noted that the Board can approve, deny, or modify the recommendation or remand it
back to the review committee with specific instructions. He thinks that adding the shoreline and Hood
Head would be a major change in the proposal, although this area was included in the original petition.
Henry Werch stated that the first No Shooting Area Review Committee meetings were intended for the
committee to do the research to prepare for the public meeting. If the Board finds that the process was not
legal, they can meet again to reconsider the issues. They weren't trying to hold information back from the
public. The committee members have diverse opinions about no shooting areas and all of them were able
to express their opinion. It was important to focus in on public safety. They heard anecdotal reports of
shots being fired at various places in the area, but the Sheriffs Office was unable to provide substantial
evidence. Ifthere are additional petitions from areas outside the boundary, the committee can review them.
The original petition incorporated a very large area. The committee presented a compromise that addressed
the key issues.
Commissioner Sullivan reiterated that the area on Seven Sisters Road and Hood Head were included in the
original petition but the committee didn't have sufficient evidence from the Sheriffs Office that there was
a problem. Henry Werch replied that at the time, there was not a preponderance of petitions in favor of a
shooting zone in that area. Public awareness may have changed that. Karen Barrows added that when they
reviewed the original petition, federally managed saltwater was included which can't be covered by County
law.
Commissioner Austin said that he is impressed that the residents in the Seven Sisters Road area are
expressing concerns about gunshots and he feels that the Board needs to take this into consideration. The
public process lead to a change in the original boundaries. Most of the residents against the no shooting
area who attended the first hearing are located in the area south of Andy Cooper Road. He thinks that the
area east of Paradise Bay Road should be included. The boundary of the no shooting zone in Port Ludlow
goes to the water. He doesn't agree that property owners should have to post their property. Chairman
Johnson concurred.

Commissioner Sullivan reviewed the area on the map that the residents want added to the no shooting zone.
There was a discussion about having staff revise the boundaries. Chairman Johnson suggested that the
committee could also review the amended proposal. Henry Werch stated that one of the committee's
concerns is that a road in itself cannot be a no shooting area. A no shooting area must be a two dimensional
demarcated space on a map. This made it difficult to define the boundaries. He said that the committee
would like guidance from the Board as to how a no shooting area can be proscribed in ways other than a
two dimensional space.
Commissioner Sullivan noted that the water is a boundary in other no shooting zones in the County. He
doesn't think that someone has to get hurt before there is a reasonable danger.
Karen Barrows asked if the Board wants to remand the request back to the review committee?
Commissioner Sullivan replied that he wants to see the no shooting area expanded as the Board has
described. He doesn't mind the committee reviewing it also.
Commissioner Sullivan moved to direct staff and the No Shooting Area Review Committee to modify the
recommendation as the result of the testimony to consider a no shooting area east of Paradise Bay Road to
the water from SR104 north to the no shooting area at Port Ludlow and past Andy Cooper Road.
Commissioner Austin seconded the motion which carried by a unanimous vote.

It has come to my attention that the Board of County Commissioners (BoCC) is currently taking public
comment on the proposed criteria for "No Shooting Areas" contained in Jefferson County Code Title 8
Health and Safety, Chapter 8.50 and has scheduled a public hearing for Monday, February 11, 2008 for
discussion and review of a proposed Paradise Bay boundary as identified in the legal description
located on the Jefferson County Department of Community Development as the, "Proposed Teal Lake
No Shooting Zone."
Through personal conversations with June Sinclair, Steve & Velde Elliot, Yuri Montgomery, Julie
Hagensen and other residents of Seven Sisters Road and Hood Head, I have been made aware of a
neighborhood petition circulating which requests that the Seven Sisters/Bywater Bay area also be
identified as a "No Shooting Area." My wife and I personally own one parcel (ref. 994000068) in this
area and our business, Shellfish Farm LLC, three (ref. 994000075, 994000077 and 994000095).
The Seven Sisters / Bywater Bay area is a popular public access shoreline frequented by pedestrians,
recreational and commercial shellfish harvesters, bird watchers and boaters. The area includes Wolfe
Property State Park and Shine Tidelands State Park and a proposed marine trail site at Point Hannon.
In addition, residences are in close proximity to the shoreline and are significantly threatened.
Recently, shooting in the area has caused significant concern and has left neighbors without recourse
when dealing with this critical public safety issue.
As an active participant on the Jefferson County Shoreline Master Program, Shoreline Technical
Advisory Committee (ST AC) and Chair of the Jefferson County Marine Resource Committee (MRC), I
wholly support the creation of a, "No Shooting Area," for the Seven Sisters/Bywater Bay region. This
region is a fully functioning pocket estuary with associated saltwater marshes and provides year-round
public access to an incredible nearshore environment for residents of Jefferson County. It has been
identified by the STAC as an area critical to protect and due to this area's sensitive habitat, including
documented nesting areas for bald eagles (Haliaeetus leucocephalus), osprey (Pandion haliaetus),
great blue herons (Ardea herodias), rhinoceros auklets (Cerorhinca monocerata) and other species,
shooting is contradictory to the health of this ecosystem and therefore the general welfare of the
County.
Based upon the prior justifications, I propose the following area (designated in red in figure 1.1) be
included in the County's "No Shooting Areas" per Jefferson County Code, Title 8 Health and Safety,
Chapter 8.5:
Beginning at the intersection of Paradise Bay Road and Section 22, Township 28 North, Range
1 East, w.M.; thence easterly along said northern boundary of Section 22 to the mean lower low
water boundary; thence continuing southeasterly and easterly along the mean lower low water
boundary of the shoreline to Point Hannon; thence rounding Point Hannon and continuing
westerly and southwesterly aiong mean lower low water boundary to the southern tip of Hood
Head; thence rounding Hood Head and continuing northerly and westerly along mean lower low
water boundary to the head of Bywater Bay; thence southerly southwesterly continuing along

mean lower low water boundary to the intersection with the northerly margin of State Route 104;
thence northeasterly along said northerly margin of SR-104 to the intersection with the easterly
margin of Paradise Bay Road; thence northerly northwesterly to the point of beginning of this
description.
All situated within Township 28 North, Range 1 East, w.M., Jefferson County Washington.

A simple description of this area may be defined as all areas of Jefferson County east of Paradise Bay
Road, lying south of the northern boundary of Section 22, Township 28 North, Range 1 East, W.M. and
north of State Route 104. Sections 2, 22, 25, 26, 27, 35 and 36 included.

Through personal conversations with June Sinclair, Steve & Velde Elliol, Yuri Monlgomery,
Julie Hagensen and other residenls of Seven Sisters Road and Hood Head, I have been made
aware of a neighborhood petition circulating which requests that the Seven Sisters/Bywater Bay
area also be idenlified as a "No Shooting Area." My wife and I personally own one parcel (ref.
994000068) in this area and our business, Shellfish Farm LLC, three (ref. 994000075,994000077
and 994000095).
The Seven Sisters / Bywater Bay area is a popular public access shoreline frequenled by
pedestrians, recreational and commercial shellfish harvesters, bird watchers and boaters. The
area includes Wolfe Property Stale Park and Shine Tidelands State Park and a proposed marine
trail sile al Point Hannon. In addition, residences are in close proximity to the shoreline and are
significantly threatened. Recently, shooting in Ihe area has caused significant concern and has
lefl neighbors without recourse when dealing wilh this critical public safety issue.
As an aclive participanl on the Jefferson County Shoreline Masler Program, Shoreline Technical
Advisory Commillee (ST AC) and Chair oflhe Jefferson County Marine Resource Conunittee
(MRC), I wholly support the creation of a, "No Shooting Area," for the Seven SisterslBywater
Bay region. This region is a fully functioning pockel estuary with associated saltwater marshes
and provides year-round public access 10 an incredible nearshore environmenl for residents of
Jefferson County. 11 has been identified by the ST AC as an area critical to protect and due to this
area's sensitive habitat, including documented nesting areas for bald eagles (Haliaeetus
leucocephalus), osprey (Pandion haliaetus), greal blue herons (Ardea herodias), rhinoceros
anklets (Cerorhinca monocerata) and other species, shooting is contradictory to the heal1h of this
ecosystem and thcrefore Ihe general welfare of the County.
Based upon the prior justificalions, I propose Ihe following area (designaled in red in figure 1.1)
be included in the County's "No Shooting Areas" per Jefferson County Code, Tille 8 Heal1h and
Safety, Chapter 8.5:
Beginning at the intersection of Paradise Bay Road and Section 22, Township 28 North,
Range 1 East. W.M; thence easterly along said northern boundary of Section 22 to the
mean lower low water boundary; thence continuing southeasterly and easterly along the
mean lower low water boundary of the shoreline to Point Hannon; thence rounding Point
Hannon and continuing westerly and southwesterly along mean lower low water

boundary to the southern tip of Hood Head; thence rounding Hood Head and continuing
northerly and westerly along mean lower low water boundary to the head of Bywater
Bay; thence southerly southwesterly continuing along mean lower low water boundary to
the intersection with the northerly margin of State Route 104; thence northeasterly along
said northerly margin ofSR-104 to the intersection with the easterly margin of Paradise
Bay Road; thence northerly northwesterly to the point of beginning of this description.
All situated within Township 28 North, Range 1 East, W.M. Jefferson County
Washington.

A simple description of this area may be defined as all areas of Jefferson County east of Paradise
Bay Road, lying south of the northern boundary of Section 22, Township 28 North, Range I East,
W.M. and north of State Route 104. Sections 2, 22, 25, 26, 27, 35 and 36 included.
