Sullivan District No.3 Commissioner: John Austin Interim County Administrator: Frank Gifford Clerk of the Board: Lorna Delaney MINUTES Week of February 19, 2008 Chairman Phil Johnson called the meeting to order in the presence of Commissioners David Sullivan and John Austin. PUBLIC COMMENT PERIOD: The following comments were made by citizens: County Officials and staff need to make sure they follow the correct procedures for open government; a larger venue may be needed for the On-Site Sewer System Ordinance deliberations and the Board of Health needs to listen to the hearing comments and reach a middle ground with property owners; one of the County parks has open pit toilets within 100 feet of the saltwater; the vision statement in the Comprehensive Plan describes it as a "living document" with an emphasis on an affordable, liveable community, but a recent UW study shows that GMA regulations have increased housing prices by $200,000 throughout Washington; proposed regulations need to be absolutely necessary; one ofthe recommendations that was ignored in the draft Critical Areas Ordinance (CAO) is the need for County funding for a monitoring program; the Board should send letters of appreciation to all the people who worked to develop the draft critical areas regulations; any volunteer on a County board or committee should be required to read the Open Public Meetings Act and sign a statement that they understand it; if people ask for information during the Public Comment Period, they should receive a response from the County during the week; a webcam should be installed in the Commissioners Chambers; is there proofthat critical areas in Jefferson County are in danger?; Fire Districts need to do background checks on employees, and the County should do background checks on employees every two years; the shoreline should not be included in the Paradise Bay No Shooting Area; the Commissioners' staff does a good job; and two people stated that the County finds ways to create emotional and financial hardship for people. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Austin moved to delete Items #3 and #4 and approve the balance of the Consent Agenda. Commissioner Sullivan seconded the motion which carried by a unanimous vote. 1. He understands she does press releases. Interim County Administrator Frank Gifford noted that last year the work she did for DCD and the County Administrator was combined under one contract with DCD for $20,000. This year DCD chose to separate the contracts. The DCD contract for 2008 is $12,000. She also writes articles for the County Administrator for various community publications such as the Port Ludlow Voice. Any work is requested by the department and is done on an hourly basis. Commissioner Austin moved to approve the contract for 2008 public outreach services for DCD with Christina Pivamik, CP Communications. Commissioner Sullivan seconded the motion which carried bya unanimous vote. AGREEMENT re: Community and Public Outreach Consultant Services for Jefferson County Administrator: (Item #4 on the Consent Agenda) After hearing the Interim County Administrator's explanation, Commissioner Austin moved to approve the contract for 2008 public outreach services for the County Administrator with Christina Pivamik, CP Communications. Commissioner Sullivan seconded the motion which carried by a unanimous vote. COMMISSIONERS BRIEFING SESSION: The following items were discussed: . Chairman Johnson reported that he will be attending the Hood Canal Coordinating Council meeting in Silverdale on Wednesday afternoon, go on to Olympia for a Washington State Association of Counties (WSAC) Rural Counties Subcommittee meeting that evening and the WSAC Legislative Steering Committee meeting on Thursday morning. . Commissioner Austin stated that the Clean Water District Task Force is having their first meeting this week to work on funding options for the Jefferson County Clean Water District. Commissioner Sullivan noted that the proposed State bill to assist in funding clean water districts was not approved in this session. . Commissioner Sullivan stated that he attended the Dungeness River Management Team meeting as a WRIA 17 representative. They want to coordinate WRIA 18 planning with WRIA 17. WRIA 18 has just begun working on the instream flow rule. He is concerned that the instream flow rule will have a larger monetary impact on the County than other State mandates. . Commissioner Austin noted that he thinks Jefferson County has been under-represented on the Olympic Workforce Development Council. Team Jefferson is the County's designated Associated Development Organization (ADO) for economic development and he would like to see them represented on the council. . Commissioner Austin stated that the proposal to locate an aquatic center near the Port Townsend Park and Ride will be discussed at the Transit Board meeting today. Chairman Johnson reviewed the history of development at Kai Tai Lagoon. Commissioner Sullivan suggested that the local governmental entities should meet to discuss the future of commonly held properties. . There will not be a County Administrator's Briefmg this afternoon due to the Transit Meeting. . Chairman Johnson stated that County board and committee members need to know that they must follow the Open Public Meetings Act requirements. APPROVAL OF MINUTES: Commissioner Austin moved to approve the minutes of the December 17, 2007 regular meeting and December 28, 2007 special meeting as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Matt Tyler, Parks and Recreation Manager and Representative of the Parks Advisory Board re: Washington State Surplus Property as a Proposed Park: Davis Steelquist, Parks Advisory Board member, explained that the State Parks and Recreation Department has offered Jefferson County 3 acres on the east side of Pula Ii Point in the Brinnon area that was given to the State in 1976 by H.J. Carroll. In 2005, the State determined that they did not want to develop the property. Jefferson County received a letter in February, 2008 offering the property at no cost. The Parks Advisory Board reviewed the letter and decided that it is in the County's interest to accept the offer. The property has a basalt and cobble beach and there is an abandoned beacon on a small parcel of Navy property to the north. The Boy Scout camp owns the property on the west side and there is an overgrown access road that was installed by the Navy. The management of the Boy Scout Camp is very particular about who comes on their property and the County would not be able to put in a hiking trail to the beach. There is private property to the south and an eagle's nest on the north boundary. The Parks Advisory Board envisions the park as a boat and kayak day use park. There are very steep banks that preclude the use ofthe bluff, however there is a steep Navy-built stairway. Davis Steelquist spoke with the caretaker at the Boy Scout camp and he said that they would monitor the property and clean up the trash. The agreement with the State wouldn't allow much development. A solar powered compo sting toilet would need to be installed. A request would need to be made to have the Navy remove the remainder ofthe beacon, but they may be willing to give the County the small parcel where it is located. The County would also have to put up signage to show the park boundaries and usage rules. The Nature Conservancy supports this acquisition. Matt Tyler stated that the Parks Advisory Board is requesting that the Commissioners send a letter to the State asking for 6 more months before the property is sold to allow more time for the County to research the boundaries, if there are any possible toxics, neighborhood issues, and ifit is important to the general public. Davis Steelquist added that he hopes to attract a kayak business to the south County. Commissioner Austin moved to have Chairman Johnson sign a letter of interest in acquiring this property to the Washington State Parks and Recreation Commission Lands Program and asking them for a 6 month extension. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Workshop re: Draft Critical Areas Ordinance: Director of CommunityDevelopment Al Scalf reviewed the calendar of events from February 11 to March 18 for the review of the Planning Commission's final draft of the Critical Areas Ordinance (CAO). The goal ofthe workshop is to familiarize the Board with the document and its development and to discuss some of the outstanding issues that they will need to address in their deliberations. He reviewed the history of the Critical Areas Ordinance over the past several years, the appeals before the Western Washington Growth Management Hearings Board and settlement agreements with Washington Environmental Council (WEC). Presentations were made on the Planning Commission's majority report, the Planning Commission's minority report, and the staff report. The issues that need further discussion are the stewardship plans, wetlands, channel migration zones and buffers. The Board agreed that another workshop should be scheduled on the February 25 agenda to review these issues in more detail. The public hearing on the CAO is scheduled on February 27 at 6:30 p.m. at the Chimacum High School Auditorium. Discussion and Possible Adoption re: Resolution Regarding Removal of Persons Who Disrupt the Public Meetings of the Jefferson County Commission: The Interim County Administrator explained that staff from several departments met last week to work on a draft resolution to provide clarity for the public, the Board, and Sheriffs Office staff about when disruptive citizens may need to be removed during Commissioners' meeting. Sheriff Brasfield added that he thinks the draft resolution is consistent with the declaration and the intent ofthe Open Public Meetings Act. He also thinks it enhances the ability ofthe public to participate in public meetings and allows public business to be conducted. It creates a standardized process that can be posted. Page 4 Commissioners Meeting Minutes: Week of February 19, 2008 Commissioner Austin stated that Section 6 ofthe draft resolution echos RCW 42.30.050 but doesn't include the part about the press or other news media. He suggested adding the sentence .......then the Chair may order the meeting room cleared per RCW 42.30.050. He thinks that would make it clear that the press, unless they are participating in the disruption, would be allowed to stay in the meeting room. Commissioner Sullivan asked if Commissioner Austin would rather just add the RCW language to the section? Commissioner Austin revised the suggested language in Section 6 to read: If after removal of the offending person or persons the Chair of the County Commissioners concludes that the business of the County Commissioners cannot be transacted and states that conclusion for the record, then the Chair may then order the meeting room cleared and continue in session or may adjourn the meeting and reconvene at another location selected by a majority vote of the members. In such a session, final disposition may be taken only on matters appearing on the agenda. Representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this section. Commissioner Austin added that the change to Section 6 makes Section 7 redundant. The Board agreed that Section 7 could be deleted. Commissioner Austin moved to approve RESOLUTION NO. 14-08 as revised, regarding the removal of persons who disrupt the public meetings of the Jefferson County Commissioners. Commissioner Sullivan seconded the motion which carried by a unanimous vote. We are especially concerned about protecting our water district facilities, including but not limited to our above ground water storage tanks. It is our understanding that they would no longer be included in the no shooting zone under a pending proposed amendment. We recognize that federal protection under the Homeland Security Act may exist on paper, but as practical matter, we would feel more secure with local law enforcement of a no shooting zone. Your attention to this matter is requested. Perhaps the "no shooting zone" boundaries could be drawn is such a manner that would protect our facilities and still not unduly restrict firearm use by our residents. Adams PO Box 65223 VED Port Ludlow, WA98365 RECE\ February 5,2008 Jefferson County Board of County ~BmiisliJ@~ 621 Sheridan Street Port Townsend, W A 98368 COUNTY JEFFERSON Dear Jefferson County commi~QM~'SS'ONERS It has come to my attention that the Board of County Commissioners (BoCC) is currently taking public comment on the proposed criteria for "No Shooting Areas" contained in Jefferson County Code Title 8 Health and Safety, Chapter 8.50 and has scheduled a public hearing for Monday, February 11, 2008 for discussion and review of a proposed Paradise Bay boundary as identified in the legal description located on the Jefferson County Department of Community Development as the, "Proposed Teal Lake No Shooting Zone." Through personal conversations with June Sinclair, Steve & Velde Elliot, Yuri Montgomery, Julie Hagensen and other residents of Seven Sisters Road and Hood Head, I have been made aware of a neighborhood petition circulating which requests that the Seven Sisters/Bywater Bay area also be identified as a "No Shooting Area." My wife and I personally own one parcel (ref. 994000068) in this area and our business, Shellfish Farm LLC, three (ref. 994000075, 994000077 and 994000095). The Seven Sisters / Bywater Bay area is a popular public access shoreline frequented by pedestrians, recreational and commercial shellfish harvesters, bird watchers and boaters. The area includes Wolfe Property State Park and Shine Tidelands State Park and a proposed marine trail site at Point Hannon. In addition, residences are in close proximity to the shoreline and are significantly threatened. Recently, shooting in the area has caused significant concern and has left neighbors without recourse when dealing with this critical public safety issue. As an active participant on the Jefferson County Shoreline Master Program, Shoreline Technical Advisory Committee (ST AC) and Chair of the Jefferson County Marine Resource Committee (MRC), I wholly support the creation of a, "No Shooting Area," for the Seven Sisters/Bywater Bay region. This region is a fully functioning pocket estuary with associated saltwater marshes and provides year-round public access to an incredible nearshore environment for residents of Jefferson County. It has been identified by the STAC as an area critical to protect and due to this area's sensitive habitat, including documented nesting areas for bald eagles (Haliaeetus leucocephalus), osprey (Pandion haliaetus), great blue herons (Ardea herodias), rhinoceros auklets (Cerorhinca monocerata) and other bird species, shooting is contradictory to the health of this ecosystem and therefore the general welfare of the County. Based upon the prior justifications, I propose the following area (designated in red in figure 1.1) be included in the County's "No Shooting Areas" per Jefferson County Code, Title 8 Health and Safety, Chapter 8.5: Beginning at the intersection of Paradise Bay Road and Section 22, Township 28 North, Range 1 East, W.M; thence easterly along said northern boundary of Section 22 to the mean lower low water boundary; thence continuing southeasterly and easterly along the mean lower low water boundary of the shoreline to Point Hannon; thence rounding Point Hannon and continuing westerly and southwesterly along mean lower low water Jefferson County Board of County Commissioners February 5, 2008 Page 2 boundary to the southern tip of Hood Head; thence rounding Hood Head and continuing northerly and westerly along mean lower low water boundary to the head of Bywater Bay; thence southerly southwesterly continuing along mean lower low water boundary to the intersection with the northerly margin of State Route 104; thence northeasterly along said northerly margin of SR-I 04 to the intersection with the easterly margin of Paradise Bay Road; thence northerly northwesterly to the point of beginning of this description.
