HomeMy WebLinkAbout04 0407 08 cc: :~~;w5 L/hio3 STATE OF WASHINGTON County of Jefferson In the Matter of the Establishment of a "N 0 Shooting" Zone in Paradise Bay to be known as the Paradise Bay No Shooting Zone } } ORDINANCE NO. 04-0407-08 } WHEREAS, on July 27, 1995 Ordinance No. 03-0227-95 was adopted by Jefferson County which allows residents of specific, defined areas in the County to petition the Board of County Commissioners (''the Board") to establish a "No Shooting" zone, and; WHEREAS, under the Health and Safety provisions of Jefferson County Code Section 8.50, the establishment procedures and boundary descriptions for "No Shooting" zones are codified, and; WHEREAS, on March 7, 2006, a petition was received from residents of the Paradise Bay area located in voting Precincts 502 and 503 which was found to be sufficient, upon review by the County Auditor, for the purposes of establishing a "No Shooting" zone by this ordinance, and; WHEREAS, on April 16, 2007, Ordinance No. 02-0416-07 was adopted by Jefferson County which specifies the process for the establishment of new "No Shooting" areas in specifically described unincorporated areas of Jefferson County, and; WHEREAS, on June 11, 2007, the Board held a duly advertised public interview process, following which it appointed an advisory Review Committee to research and make a recommendation on the Paradise Bay "No Shooting" zone petition, and; WHEREAS, the Board makes the following Findings of Fact with respect to this particular petition and review process: 1. The Review Committee appointed by the Board met on the following dates: July 12,2007; August 9,2007; and September 13,2007, to research and review the Paradise Bay "No Shooting" zone petition; and held a duly advertised public 1 Ordinance No. 04",,0407...08 Re: Paradise Bay No Shooting Zone meeting on October 25,2007, to accept public comment and formulate a recommendation on the Paradise Bay "No Shooting" zone petition. 2. On January 7, 2008, staff submitted to the Board the Review Committee's recommendation, which substantially reduced the size of the proposed Paradise Bay "No Shooting" zone. Staff recommended to the Board that it hold a public hearing. 3. On January 28, 2008, the Board approved a legal notice announcing a public hearing. 4. On February 11,2008, the Board held a duly advertised public hearing on the Review Committee's recommendation on the Paradise Bay "No Shooting" zone petition boundary. Eight members of the public testified. 5. Following public testimony, the Board remanded the recommendation back to the Review Committee, directing that the Committee reconsider its recommendation in light of public testimony. 6. On March 11, 2008, the Review Committee held a duly advertised public meeting to accept public comment and to review its recommendation. Following public comment and deliberations, the Review Committee voted 6-1-0 not to alter its original recommendation. 7. On March 24,2008, staff submitted to the Board the Review Committee's recommendation. 8. On March 24,2008, the Board accepted comment from the Review Committee, and held deliberations. The Board voted 2-1 to accept the Review Committee recommendation on the Paradise Bay "No Shooting" zone boundary, but also to extend it to include an additional area specified at the February 11,2008 public hearing. 9. Since the recommendation of the Review Committee did not change after the Board's public hearing of February 11,2008, there was no requirement for the Board to publicize and hold another public hearing. 2 O d. In accordance with Jefferson County Code Section 8.50,050(6), the Board has final say on what will or will not be included in the boundary of a "no shooting" zone and utilized that authority by including the additional area specified at the February 11,2008 public hearing. 11. The creation of the Paradise Bay "No Shooting" zone has been completed in a manner consistent with Ordinance #03-0227-95 as amended and replaced by Ordinance #02-0416-07. NOW, THEREFORE, BE IT ORDAINED as follows: Section One: The following language shall be added to the Jefferson County Code at Chapter 8.50 JCC: Paradise Bay: The area described below is hereby established as a no shooting area as provided in Article I of this chapter. All of the land lying within the following bounds: Beginning at the intersection of the most northerly line of Tract A of the Plat of Woodridge Village Division 1 as recorded in Volume 7 Pages 47 through 50 of Plats, Jefferson County, state of Washington and the easterly margin of Teal Lake Road; Thence northeasterly along said northerly line of said Tract A to the intersection of said line with the southerly margin of Crestview Drive as recorded in the Plat Amendment to Teal Lake Village Volume 6 Pages 186 through 197 of Plats, Jefferson County, state of Washington; Thence in a straight line northeasterly to the intersection of said line with a point located at the intersection of the southerly boundary of Tract C of the said plat of Wood ridge Village Division 1 and the northerly margin of said Crestview Drive; Thence northerly along the northerly margin of said Crestview Drive, said margin also being the westerly boundary of said Tract C, to the southerly margin of Outlook Lane as recorded in said plat of Amendment to Teal Lake Village, said line also being the northerly line of said Tract C; Thence easterly along the northerly boundary of said Tract C to the intersection of said line with the most easterly boundary of said plat of Amendment to Teal Lake Village; Thence northerly along the easterly boundary of said plat of Amendment to Teal Lake Village to the intersection of said line with the southerly margin of Paradise Bay Road; Thence along said southerly and westerly margin in an easterly and southerly direction to the intersection of said westerly margin of Paradise Bay Road with the North line of Section 22, Township 28 North, Range 1 East, W.M.; Thence easterly along the North line of said Section 22 to the mean lower low water boundary of Hood Canal; Thence southeasterly and easterly along said mean lower low water boundary to Point Hannon and the easterly mean lower low water boundary of Hood Canal in Section 25, Township 28 North, Range 1 East, W.M.; Thence following the mean lower low water boundary of Hood Canal through Sections 25, 26, 35 and 36, all lying in Township 28 North, Range 1 East, and Section 2, Township 27 North, Range 1 East, W.M., to the intersection with the northerly margin of State Route 104 with said mean lower low water boundary of Hood Canal; Thence northwesterly along the north margin of State Route 104 to the intersection of said margin with the easterly margin of Paradise Bay Road; 3 O d. Re: Paradise Bay No Shooting Zone Thence northerly and northwesterly along the easterly margin of Paradise Bay Road to the south line Section 23, Township 28 North, Range 1 East, W.M. Thence westerly along said south line of Section 23 to the intersection with the westerly margin of Paradise Bay Road; Thence southerly along the westerly margin of Paradise Bay Road to the intersection with the northerly margin of Andy Cooper Road; Thence westerly along the northerly margin of said Andy Cooper Road to the intersection with the easterly margin of Teal Lake Road; Thence northwesterly along the easterly margin of Teal Lake Road to the point of beginning of this description. All situated within Jefferson County, Washington. (See attached map) Section Two: This Ordinance shall take effect immediately.
