Removal or destruction of overhanging bankline vegetation shall be limited to that necessary for the construction of the bulkhead. 18. Intertidal wetland vascular plants shall not be adversely impacted due to project activities (e.g. , barge shall not ground, equipment shall not operate, and other activities shall not occur in intertidal wetland vascular plants) . If such vegetation is adversely impacted, it shall be replaced using proven methodology. 19 . All natural habitat features on the beach larger than 12 inches in diameter including trees stumps, logs, and large rocks shall be retained on the beach following construction. These habitat features may be moved during construction if necessary. 20. Bed material, other than material excavated for base rocks, shall not be utilized for project construction or fills. 21. Excavated materials containing silt clay, or other fine grained soil shall not be stockpiled below the ordinary high water line. 22 . If stockpiling of sand, gravel, and other coarse excavated material is conducted below the ordinary high water line, it shall be placed within a 25-foot work corridor waterward of the base rocks. 23 . All excavated or stockpiled material shall be removed from the beach within 72 hours of bulkhead construction. Upon removal of the excavated material the beach shall immediately be returned to the pre-project natural grade. 24. Beach area depressions created during project activities shall be reshaped to preproject beach level upon project completion. 25. All trenches, depressions, or holes created in the beach area shall be backfilled prior to inundation by tidal waters. Trenches excavated for base rocks may remain open during construction, however fish shall be prevented from entering such trenches. 26. The beach waterward of the bulkhead shall be graveled in compliance with the following specifications: a) Gravel shall be clean round "pea gravel", not crushed. b) At least 80 percent of the gravel shall be sized between 1/16 inch and 1/4 inch in diameter. LEGAL DESCRIPTION: Parcel 002 352 010 in Section 35, Township 30 North, Range 2 West, WM. The property is located at 691 Bachelor Rd in Gardiner. FINDINGS: 1) The proposal is considered exempt from a shoreline substantial development permit, per RCW 90. 58 . 020 (i) and (ii) . 2) A Hydraulic Project Approval was issued under Control Number 1Z0►4 — 0 1 . The HPA expires on iptgru * lW 3) The shoreline bank at the subject property eroded as a result of the damaging storms of winter 1997 . 4) An existing stairway was damaged and will require replacement. 5) In order to prevent further upland erosion, the applicant shall implement the surface water drainage system as indicated on the plans submitted by NTI on August 20, 1997 . 6) A follow-up site inspection was made of the subject property due to the need to verify proper placement of the bulkhead and the landscape plantings. 7) The applicant requested that Permit Center staff consider alteration to permit number XMP97-0046, dated August 29, 1997, for the purpose of placing the stairway east of the approved location. The proposed alteration seems logical and as conditioned is permited. 8) Permit Center discussed the proposed change of the placement of the stairs with WDFW staff and determined that as long as the stairs land on top of the bulkhead, and vegetation is not disturbed, there is consistency with the HPA and shoreline permit(s) . NOTICE: This exemption does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development. Conditions of Approval - Permit no. : XMP97-0046 For: CARL SCHABER • Page: 3 1) This approval pertains to Jefferson-Port Townsend Shoreline Management Master Program requirements only. The approval of any other agency with jurisdiction or any other required permits shall be obtained prior to undertaking the project. 2) Work within the jurisdiction of the Shoreline Program other than as described above shall receive separate review from this office. 3) No fill or other material may be placed in the waters or intertidal areas of Jefferson County. 4) The proponent shall notify the Jefferson County Permit Center, (360) 379-4450, Development Review Division 48 hours in advance prior to commencing construction in order to allow monitoring and ensure conformance with project conditions. 5) The bulkhead shall be placed into the shoreline bank as and in substantial alignment with the ordinary high water mark. The ordinary high water mark shall be determined by Permit Center staff and staked out in the field. 6) The proponent shall comply with conditions as set forth in the Critical Area Waiver (CAR97-0219) . 7) Prior to construction of the stairway, the applicant shall obtain a building permit to meet Uniform Building Code requirements. 8) The applicant shall fully implement the surface water drainage system plans as submitted on August 20, 1997 . 9) In order to place the proposed bulkhead and stairway, removal of the x concrete block shall occur and the concrete shall be properly disposed of to an off site location. 10) The stairway may be placed along the drainage area east of the original location as the applicant requested on October 29, 1997 . The stairway shall land on top of the bulkhead and, as such, shall not be located waterward of the bulkhead. 11) No overhead vegetation shall be cleared or removed for the placement of the stairway, and any groundcover removal shall be re-planted. 12) The applicant shall remove the section of old stairway located at the top of the bank, and re-vegetate that area as needed. Mailing Addr: 2728 FAIRVIEW AVE E tydtj/ 5eFrin-E wfr 9 WO a -3 I37 Critical Area Review Case NO. : CAR97-0219 Project Description: BANK PROTECTION IN CONJUNCTION WITH A SINGLE FAMILY RESIDENCE stormwater drainage system Parcel 002352010 S-T-R: 35-30-02 W Site Addr: 691 BACHELOR RD SEQUIM, WA 98382 FINDINGS In accordance with the authority provided under subsection 4 . 101 and the requirements contained in Subsection 5 . 402 of the Jefferson County Interim Critical Areas Ordinance, the following are findings of fact relating to the referenced application: 1) A shoreline pre-application was reviewed by Jefferson County Permit Center staff on March 3 , 1997, for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: fish and wildlife habitat associated with the shoreline, landslide and erosion hazard. 2) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on April 2 , 1997, and confirmed the existence of the following critical areas and/or their associated buffers on the property: erosion and landslide hazard, fish and wildlife habitat associated with the shoreline. 3) In order to protect the eroded bank, plantings of native vegetation shall be incorporated into the proposal. Erosion control blankets should be used until vegetation is established. 4) Permit Center staff have determined that the proposed route to bring the bulkhead material down to the beach from above the steep slope bank is hazardous and would cause damage to the shoreline; therefore, the materials for the proposed bulkhead will need to brought in via barge from the waterward side. 5) The applicant submitted detailed plans on June 27, 1997 with updates on July 27, 1997 . Joesph Donisi,P. E. of Northwestern Territories, Inc. designed the project proposal. 6) Vegetation at the site includes:Douglas-fir(Pseudotsuga menziesii) , ocean spray (Holodiscus discolor) , sword fern (Pteridium spp. ) , trailing balckberry (Rubus ursinus) , and salal (Gaultheria shallon) . a Page: 3 CAR97-0219 CARL SCHABER CONDITIONS OF APPROVAL 1) The applicant shall submit a planting plan which illustrates the area that will be revegetated.
