WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Bernt Ericsen; and
WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the road vacation
petition on December 14, 2007; and
WHEREAS, the Jefferson County Hearing Examiner considered testimony of lhe public, comments
from applicable departmenls, agencies and offices, and recommendation from the Jefferson County
Engineer and Jefferson County Department of Community Development at the public hearing; and
WHEREAS, the Jefferson County Hearing Examiner determined that the public will benefit from
the vacation of this right of way and such vacation complies with thejefferson County Comprehensive
Plan and other applicable plans, policies or ordinances; and
WHEREAS, the Jefferson County Board of Commissioners considered said Hearing Examiner's
report of the public hearing and his recommendation for the vacation request and hereby adopts the
Findings of the Jefferson County Hearing Examiner dated January 2, 2008,
NOW, THEREFORE BE IT RESOLVED that the following be vacated and abandoned pursuant to
RCW 36,87.140 and Jefferson County Code 12.10; 111e entire platted alley being approximately 15 feet
wide by 225 feet in length lying adjacent 10 and between Lots 19 through 29, Block 114, lrondalc
Division No.5, as recorded in Volume 2 of Plats at Page 135, records of Jefferson County, Washington.
Situated in the Northeast quarter of Section 34, Township 30 North, Range 1 West, W. M, This vacation

SUMMARY OF REQUEST:
The petitioner is requesting approval to allow vacation of the entire platted alley located in
Block 114, lrondale Division 5 as recorded in Volume 2 of Plats at Page 135, records of
Jefferson County, Washington, Situated in the Northeast quarter of Section 34, Township
30 North, Range 1 West, W.M.
SUMMARY OF RECOMMENDATION:
It is hereby recommended that the Board of Jefferson County Commissioners vacate the
entire width of a platted alley which extends between Lots 19-29, Block 114, lrondale
Division No.5, as recorded in Volume 2 of Plats at Page 135 records of Jefferson County,
Washington.
PUBLIC HEARING:
After reviewing the Jefferson County Department of Community Development and
examining available information on file with the application, the Examiner conducted
a public hearing on the request as follows:
The hearing was opened on December 14, 2007,
Parties wishing to testify were sworn in by the Examiner.
The following exhibits were submitted and made a part of the record as follows:

WILL BUTTERFIELD, right-of-way representative from the Jefferson County Public Works
Department, appeared and presented the Department of Public Works Staff Report, The

applicant requests vacation of a 15 foot wide, 225 foot long, unopened alley for the
purpose of creating two viable building sites on 16 lots, Proper notice was given and all
agencies responding recommended approval. Staff received no testimony from the public
and recommends approval of the vacation,
BERNT ERICSEN, petitioner, appeared and testified that he agrees with the staff report
and the presentation by Mr. Butterfield, and that he has no issues with the appraised value
of the pa rce I.
No one spoke further in this matter and the Examiner took the matter under advisement.
The hearing was concluded,

FINDINGS. CONCLUSIONS AND DECISION:
FINDINGS:
1. The Hearing Examiner has heard testimony, admitted documentary evidence into
the record, and taken this matter under advisement.
4, The applicant owns lots 19-29 of Block 14, Irondale Division No.5, in
unincorporated Jefferson County. Lots 20-28 abut the north side of Prospect
Avenue and are oriented in a north/south direction, Lots 19 and 29 are oriented in
an easUwest direction and abut Willison Street and McLellan Street respectively to
the south of lots 20-28. A 15 foot wide, 225 foot long alley extends between Willison
and McLellan Streets and separates lots 19 and 29 from lots 20-28.
5. The applicant requests the Board of Jefferson County Commissioners to vacate the
entire alley so that it will no longer separate his ownership. Such will provide one or
more building sites. All County departments responding recommend that the Board
vacate the alley.
6, Section 12.10.080 of the Jefferson County Code (JCC) requires the Examiner to
hold a public hearing on all petitions for road vacations, review said petitions in
accordance with the criteria set forth in Section 12.10.110 JCC, and provide a
written recommendation to the Board to grant or deny the petition along with any
recommended conditions of approval. Findings on each applicable criteria set forth
in Section 12.10.110 JCC are hereby made as follows:
A. Based upon the recommendations of approval from County departments the
proposed road vacation complies with the Jefferson County Comprehensive
Plan and applicable plans, policies, and ordinances. The Department of

Community Development (DCD) has reviewed the request and found the
proposed vacation in compliance with the Transportation Element of the
comprehensive plan. While the comprehensive plan identifies a bike route on
Prospect Avenue, the alley vacation would not affect said proposal.
B. The alley has not served as a means of providing area circulation. The
vacation will have no impact on any abutting parcel since all have access
from a County right-of-way. Furthermore, the applicant owns all abutting
parcels,
C. The East Jefferson Fire Rescue aka Jefferson County Fire Protection District
No. 1 has reviewed the petition and "has no issues with those alley
vacations". Therefore, the vacation will not impair the effectiveness of fire,
medical, law enforcement, or other emergency services.
D. The alley does not presently serve as a utility corridor and neither Public
Works nor DCD recommends retention of utility easements, Furthermore,
Puget Sound Energy recommends approval.
E. The alley cannot serve as a circulation route and no Jefferson County plan or
policy proposes its use for either a trail or pathway. Furthermore, the
Jefferson County Parks and Recreation Advisory Board has determined that
the alley has no significance to parks and recreation and therefore does not
object to approval of the petition,
F. The alley does not abut a body of salt or freshwater and is located within the
Rural Residential designation of the comprehensive plan. Therefore, the
parcel is not zoned for industrial purposes,
G. The proposed vacation will not landlock any parcel of property as all parcels
in the area abut County rights-of-way,
7. In accordance with Section 12.10.120 JCC, Donna J. Bauman, a certified appraiser,
submitted a land appraisal report valuing the property at $1,000, The applicant does
not challenge said valuation,
8. The alley lies just north of the future Tri-Area Urban Growth Area (UGA) and is also
in close proximity to an Airport Noise Overlay District. However, the applicant owns
all abutting parcels which also lie just north of the future UGA and overlay district.
CONCLUSIONS:
1 . The Hearing Examiner has jurisdiction to consider and decide the issues presented
by this request.

2. The request to vacate the entire width of a 225 foot long, platted alley extending
between Willison and McLellan Streets adjacent to lots 19-29 of Block 114, lrondale
Division No, 5, satisfies all criteria set forth in Section 12.10.110 JCC and therefore
the Board of Jefferson County Commissioners should vacate said alley subject only
to the compensation required by Section 12.10.120 JCC.
RECOMMENDATION:
It is hereby recommended that the Board of Jefferson County Commissioners vacate the
entire width of a platted alley which extends between lots 19-29, Block 114, lrondale
Division No.5, as recorded in Volume 2 of Plats at Page 135 records of Jefferson County,
Washington.

In accordance with Ch 36.87 RCW, I have examined the above referenced right of way, and
submit the following report,
I. The right-of-way requested for vacation was dedicated in the plat of lrondale Division
No.5 which was recorded in Volume 2 of Plats at Page 135 on or about April 2, 1910,
and therefore is not statutorily vacated under Chapter 36,87,090 RCW, The request is to
vacate that portion of the platted alley, being approximately 15 feet wide by 225 feet long,
lying adjacent to and between Lots 19 through 29, Block 114, lrondale Division No.5, as
recorded in Volume 2 of Plats at Page 135, records of Jefferson County, Washington,

The Jefferson County Department of Community Development has reviewed the proposal and
submits the following information and comments:
Background:
1. lrondale #5 was recorded on April 2. 1910 under AFN 29795 Volume 2 Page 135.
2. The alley proposed to be vacated is located within Block 114 ofIrondale No.5.
3. The lots lying directly north and south of the proposed alley vacation are vacant The
parcel to the west and further north have existing residences, The parcels directly east of
North Willson A venue at the alley vacation request are vacant
4. County records identify that the petitioner own Lots 19-29, Block 114 of lrondale #5.
4. The proposed alley vacation and surrounding parcels are designated/zoned as Rural
Residential 1 :5 under the Jefferson County Comprehensive Land Use Map, effective
August 28, 1998.
5. Said alley lying in Block 114 has GlS mapped elevations ranging from 145 feet at the
northwestern corner to 136 feet at the southeastern corner.

6, Said alley lies just north of the future Tri-Area UGA,
7, An Environmentally Sensitive Area (ESA) review was conducted using the County GIS
mapping system and the following mapped features exist either within the platted alley
right-of-way or in the immediate vicinity:
. SARP A aquifer recharge area
. Coastal SIP Z
Development Review Division Comments:
. The Transportation Element of the Comprehensive Plan identifies a proposed on-road
bike route on Prospect Avenue. (The proposed alley vacation would not be affected by
on-road bike route).
. Special Aquifer Recharge Protection Areas are critical aquifer recharge areas and are
subject to protection regulations under Section 18.15,240(3) of the Jefferson County
Code. Some land use activities are considered high impact and may be prohibited.
. Although the specific ally associated with the vacation does not lie within the specified
Airport Noise Overlay District, it is in close proximity, Per Section 3.6.11, Airport
Essential Public Facility District identifies the "Airport Noise" area of influence.
Proponent should be aware that "The property is near an airport where a variety of airport
dependent uses occur that are not compatible with development. Potential discomforts or
inconveniences may include, but are not limited to: noise, aircraft take-offs and
landings."
. Coast SIPZ requirements would not apply to the lots adjacent to that portion of the alley
to be vacated, as PUD #1 water is available throughout the area.
Recommendation:
Based on the above findings and in the public interest, this Department supports the proposal and
recommends the Hearing Examiner approve the requested alley vacation as previously described.

Notice is hereby given that a public hearing will be held by the Jefferson County Hearing Examiner
on Friday. December 14, 2007 at 2:00 p,m. in the Commissioner's Chambers at the Jefferson
County Courthouse in Port Townsend, Washington, for the purpose of taking testimony concerning
the vacation of the entire platted alley lying adjacent to and between Lots 19 throuqh 29, Block 114,
lrondale Division No, 5, as recorded in Volume 2 of Plats at Page 135, records of Jefferson County,

Statement of Issue:
Road Vacation petition submitted by Bernt Ericsen for the entire platted alley being
approximately 15 feet wide by 225 feet in length lying adjacent to and between Lots 19
through 29, Block 114, Irondale Division No.5, as recorded in Volume 2 of Plats at Page 135,
records of Jefferson County, Washington, as shown on the attached diagram. This alley
vacation was heard before the Jefferson County Hearing Examiner on December 14, 2007 and
his report and recommendation for approval of this vacation request is attached.

Analysis/Strategic Goals/Pro's & Con's:
The Board is asked to consider the Hearing Examiner's Report and Recommendation (Exhibit A
together with Attachments A through J of the staff report), including the report and
recommendation of the County Engineer and resolve to either accept or deny the petition for
vacation in accordance with Jefferson County Code 12.10. No testimony has been received
for this vacation and the Board may, at its discretion, take testimony at this time.
Fiscal Impact/Cost Benefit Analysis:
There is no fiscal impact as this is an un-opened and un-maintained right of way that is not
needed for area circulation.
Recommendation:
The Hearing Examiner recommends approval of the request and the petitioner has met the
compensation requirement and paid all fees. The County Engineer recommends that the
Board approve the request by signing the attached resolution.
