Horton Street Port Hadlock, WA98339 SUMMARY OF REQUEST: The Petitioner requests vacation of the south half of the platted Anderson Street being approximately 25 feet by 75 feet, lying adjacent to and abutting upon Lots 1, 2, and 3 in Block 89, lrondale No.7, as per the plat recorded in Volume 2 of Plats at Page 144, records of Jefferson County, Washington. SUMMARY OF RECOMMENDATION: It is hereby recommended to the Board of Jefferson County Commissioners that the request to vacate the south half of the platted Anderson Street adjacent to Lots 1, 2, and 3 in Block 89, lrondale No.7 should be granted. PUBLIC HEARING: After reviewing the Jefferson County Department of Community Development and examining available information on file with the application, the Examiner conducted a public hearing on the request as follows: The hearing was opened on September 14, 2007. Parties wishing to testify were sworn in by the Examiner. The following exhibits were submitted and made a part of the record as follows: SEE ATTACHED INDEX LIST KELLI LARSON appeared, presented the Department of Public Works Staff Report, and testified that the applicant owns lots one through three, and then specified the reason for the vacation request. The assessed value equals $1,550 which Jefferson County finds appropriate. MICHAEL REGAN, petitioner, appeared and testified that he proposes to vacate a portion of the road which would allow his lots to meet the septic requirements. The road dead-ends at another plat and is not opened. His lots are zoned commercial and such uses are on both sides to the south and west. He agrees with the appraised value. No one spoke further in this matter and the Examiner took the matter under advisement. The hearing was concluded. NOTE: A complete record of this hearing is available in the office of Jefferson County Department of Community Development. FINDINGS. CONCLUSIONS AND DECISION: FINDINGS: 1. The Hearing Examiner has admitted documentary evidence into the record, and taken this matter under advisement. 2. The applicant, Michael Regan, has a possessory ownership interest in lots 1, 2, and 3 of block 89 in Irondale No.7. All three lots abut Anderson Street which, even though platted, has never been opened. Mr. Regan's lots are presently unimproved and the vacation would add approximately 1,800 square feet to his adjoining parcel. Such would allow the lot to meet the requirements for an on-site septic disposal system. 3. Mr. Regan's present address is 291 West Horton Street, Port Hadlock, and he is requesting the Board of Jefferson County Commissioners to vacate the south half of Anderson Street adjacent to his three lots. The record of survey shows that Anderson Street, a 50 foot wide right-of-way, extends west from 10th Avenue along the north property line of the applicant's lots which measure approximately 25 feet in width for a total of 75 feet. The survey shows that an existing house located on lots 1 and 2 encroaches into the 10th Avenue right-of-way by 2.79 feet (25.37 square feet). The unopened Anderson Street extends to a built-out subdivision where it terminates. All County departments either recommend that the Board vacate the south half of Anderson Street or have not responded. 4. Section 12.10.080 of the Jefferson County Code (JCC) requires the Examiner to hold a public hearing on all petitions for road vacations, review said petitions in accordance with the criteria contained in Section 12.10.110 JCC, and provide a written recommendation to the Board to grant or deny the petition along with any recommended conditions of approval. Based upon the recommendations of approval from all County departments, the proposed road vacation complies with the Jefferson County Comprehensive Plan and applicable plans, policies, and ordinances. The Department of Community Development (DCD) has reviewed the request and found the vacation in compliance with the Transportation Element of the Comprehensive Plan. B. The road has not served and cannot serve as a means of providing area circulation. The vacation will have no impact on any abutting parcel since all such parcels have access from a County right-of-way. Fire Protection District No. 1 has not responded and therefore the Examiner assumes that the vacation will not impair the effectiveness of fire, medical, law enforcement, or other emergency service providers. C. The road does not presently serve as a utility corridor and neither Public Works nor DCD recommend retention of utility easements. Jefferson County PUD No. 1 likewise did not respond to the request. D. The remaining right-of-way cannot effectively serve as a trail or pathway since it terminates in the middle of a block at a residential subdivision. Furthermore, the Jefferson County Parks and Recreation Advisory Board considered the petition at its regularly scheduled meeting on September 5, 2007, and determined that the right-of-way has no significance to Parks and Recreation and therefore does not object to the vacation. E. The right-of-way proposed for vacation does not abut a body of salt or freshwater and is not zoned for industrial purposes. F. The proposed vacation will not landlock any parcel of property as all parcels in the area abut County rights-of-way. 5. In accordance with Section 12.10.120 JCC Ralph Erickson, a certified appraiser, submitted an appraisal certificate valuing the property at $1 ,550. The applicant does not challenge said valuation and Public Works finds it appropriate. CONCLUSIONS: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. FINDINGS 1. The right of way requested for vacation was dedicated in the plat of Irondale No.7 and recorded on October 14, 1910, and therefore is not statutorily vacated under Chapter 36.87.090 RCW. The request is to vacate that portion of the South one-half of platted Anderson Street, being approximately 25 feet by 75 feet, lying adjacent to and abutting upon Lots 1,2 and 3 in Block 89, Irondale No.7, as per the plat recorded in Volume 2 of Plats at Page 144, records of Jefferson County, Washington. 2. This is an undeveloped right of way for which the County has made no expenditures. 3. The Department of Community Development has reviewed the request and provided a report that the vacation has been found to be in compliance with the Transportation Element of the Comprehensive Plan. 4. The right of way requested for vacation does not provide for area circulation or utilities. 5. The effectiveness of emergency services will not be impaired by this vacation. The Jefferson County Parks and Recreation Advisory Board has reviewed the request and found the right of way to have no significance to Parks and Recreation. 7. The Right of way does not abut a body of water. 8. The proposed vacation will not land lock any parcel of property. 9. There is no current or anticipated future public need for the right of way to provide for. the public road circulation network, nor for public access. The public may benefit by this vacation by reducing the County's liability for un-opened and un-maintained right of way. The portion of Anderson Street to be vacated is located between Blocks 89 and Block 90 of Irondale No.7, 3. The lots (Lots 1,2, & 3 of Block 89) lying directly south of the proposed vacation are owned by Michael Regan and according to the Jefferson County Assessor's records the lots have an existing residence located on them. 4. County records identify the owner of Block 90 Lots 1-6 as Donald Forker and that the lots are vacant. 5. The parcel to the immediate west (APN 001343012) is owned by S/G Properties L P and has direct access off of Rhody Drive. The parcel has several mini-storage buildings constructed on it as well as DOC building, residence, and commercial storage lot for used vehicles, boats, R V s, etc. for sale. The proposed street vacation is designated/zoned as General Crossroads (GC) under the Jefferson County Comprehensive Land Use Map, effective August 28, 1998. The parcel was subject to a comprehensive plan amendment under ZON02-0008 that was finaled on January 31, 2003. The amendment changed the parcel from RR 1:5 to General Crossroads. 7. The GIS mapped elevations north and south of the proposed vacation range from 127 feet to 124 feet. 8. An Environmentally Sensitive Area (ESA) review was conducted using the County GIS mapping system and the following mapped features exist either within the platted alley right-of-way or in the immediate vicinity: . SARP A & SUSC aquifer recharge area . Seismic . Airport Noise Overlay Type 2 (in the vicinity to the northwest). Development Review Division Comments: . The Transportation Element of the Comprehensive Plan identifies an existing on-road bike route on Irondale Road, but nothing as existing or proposed on Anderson Street. . Special Aquifer Recharge Protection Areas are critical aquifer recharge areas and are subject to protection regulations under Jefferson County Code (lCC) Title 18, Section 18.15.240(3). Some land use activities are considered high impact and may be prohibited. . Although the specific street associated with the vacation does not lie within the specified Airport Noise Overlay District, it is in close proximity. Per JCC Section 18.15.405, identifies area of influence. Proponent should be aware that "The airport Overlay II includes areas that lie beneath the FAA mandated traffic pattern for aircraft ascending or descending from the JCIA. As such, this area is subject to routine aircraft over-flights. It is acknowledged that areas lying outside the delineated Airport Overlay II zone may also be subject to aircraft over-flights." Recommendation: Based on the above findings and in the public interest, this Department supports the proposal and recommends the Hearing Examiner approve the requested street vacation as previously described. Analysis/Strategic Goals/Pro's 8: Con's: The Board is asked to consider the Hearing Examiner's Report and Recommendation (Exhibit A together with Attachments A through I of the staff report), including the report and recommendation of the County Engineer and resolve to either accept or deny the petition for vacation in accordance with Jefferson County Code 12.10.
