RESOLUTION NO. 51-08
WHEREAS, our organization has approved a comprehensive plan that includes this project
area; and
WHEREAS, under the provisions of WWRP, state funding assistance is requested to aid in
financing the cost of land acquisition and/or facility development; and
WHEREAS, our organization considers it in the best public interest to complete the land
acquisition and/or facility development project described in the application;
NOW, THEREFORE BE IT RESOLVED, that:
1. The Water Quality Program Manager of Public Health be authorized to make formal
application to the Recreation and Conservation Office for funding assistance;
2. Any fund assistance received be used for implementation of the project referenced above;
3. Our organization hereby certifies that its share of project funding is committed and will be
derived from an application to the Federal Farm and Ranch Land Protection Program
(FFRP) for the remaining project costs;
4. We acknowledge that any property acquired or facility developed with financial aid from
the Recreation and Conservation Funding Board (RCFB) must be placed in use for the
funded purpose and be retained in such use in perpetuity unless otherwise provi8ded and
agreed to by our organization and RCFB.
5. This resolution becomes part of a formal application to the Recreation and Conservation
Office; and
6. We provided appropriate opportunity for public comment on this application.

DESCRIPTION:
Jefferson County and Jefferson Land Trust are applying for grant funds to purchase a conservation easement on the
50 acre Brown Dairy, located at the Chimacum crossroads. The Brown Dairy is a critically important signature farm in
the fertile Center Valley, located adjacent to Glendale Farm. The Brown Dairy has been a working farm since the
1850's and has a long history of dairy production. The milking facility has been idle for four years after several losses
in the family, and a portion of the farm has already been sold off. This area is agriculturally zoned, though proximity to
the commercial Chimacum intersection is a potential future threat from commercial and residential creep. Local
organizations have been negotiating with the landowners for long term preservation of this highly visible, cornerstone
property. Jefferson Land Trust is negotiating an option agreement to purchase the property, and is working with the
local Mt. Townsend Creamery for eventual purchase after an easement has reduced the market value of the property.
The creamery produces regionally recognized cheeses and is interested in operating its own milking facility and
milking herd. The Brown Dairy includes three platted parcels, the historic farmhouse, barns and milking facility, nearly
45 acres of prime pastureland and approximately 2000 ft of mainstem Chimacum Creek running through the property.
Protection of this historically significant farm will add to the viability of Chimacum crossroads as a hub of our local
agriculture community.

The Brown Dairy project includes purchase of a ~nservation easement on tlJe 50 acre property.
The County will co-hold the conservation easeme . t with Jefferson Land Trust and the Land
Trust will have responsibility for stewardship and onitoring of the easement. The Land Trust is
the only local organization or agency that has a s wardship and monitoring program for .
conservation easements, developed with the gui~ance of the Land Trust Alliance and utilized
effectively for almost 20 years. The stewardship ~nd monitoring program includes annual
monitoring to determine compliance with the terms of the easement, volunteer help with
restoration and enhancement efforts. The Land iust Stewardship Director and trained
community volunteers conduct monitoring and en ancement efforts. Staff, partner agencies
and trained professionals provide guidance with r gard to best agricultural management
practices,

The Brown Dairy has not yet been investigated for archeological or cultural significance, The
Jefferson County Historical Society has quite a lot of information on,the history of the Chimacum
Crossroads area.

The Brown Dairy is currently in pastureland. The property is agriculturally zoned 1 residence per
20 acres, however, the property is currently platted into 3 separate tax parcels that can each be
developed as residential units according to existing county regulations. The Brown Dairy may
also be eligible for increased density through Planned Rural Residential Development
provisions.

Jefferson land Trust is negotiating the purchase of a 30 month option agreement for fee simple
purchase of the Brown Dairy. As soon as the option agreement has been finalized, a before
and after appraisal will be initiated that will provide the fee simple value of the property as well
as the value after the conservation easement has been purchased. The option agreement
timeframe is expected to begin sometime this spring and will extend into 2010. The
conservation easement grant funding will help offset the purchase price and will ultimately help
the conservation buyer be able to afford the property and continue its' agricultural uses.
5 of 8 Will this acquisition project cause the displacement of individuals, families, businesses, cr

The current landowner is elderly and anticipates selling the farm within the next several years,
either on the open market or in the interim to Jefferson Land Trust. As a result, the landowner
anticipates moving away from the the property anyway, Ideally the conservation project will
allow the historical dairy operation to get up and running again.

A Phase I Environmental Assessment will be conducted to determine if clean-up of hazardous
materials is required.
7 of 8 What agricultural activity (ies) currently occurs on the land? Will it continue?
Currently the pastureland is being grazed by cattle owned by family members and is also leased
to a local farmer for grazing by 50 head. If acquisition of the Brown Dairy and conservation
easement are successful, there will be a dairy herd of up to 100 head grazing on the property
and utilizing the milking facilities.
8 of 8 Are there structures (i.e. residences, shops, barns, etc.) on the property proposed for
acquisition? If yes, what are your plans for those structures (i.e, demolition, relocation, auction,
etc.)?
The Brown Dairy farmsite includes the historic farmhouse built in the 1890's, a milking barn,
shop, feed barn, two grain silos and other outbuildings, These structures have historic, scenic
and community significance, and are an important component of the project and for the future
agricultural operations of the dairy.

Description:
The Brown Dairy includes approximately 50 acres of productive agricultural soils, Chimacum Creek habitat and
the historic farmsite and milking facility, Acquisition of the conservation easement will permanently protect the
conservation values of the farm and support the agricultural viability of this key property. Current development
potential would allow for at least 3 additional homesites. Current owners have already sold off a portion of the
farm to meet family needs, Jefferson Land Trust has negotiated an option for purchase of the farm, with the intent
to sell the property a conservation buyer, most likely thet Mt. Townsend Creamery, a local cheese manufacturer,
with an easement in place, Funding for the conservation easement is a critical component of the purchase
package for the Creamery.

Dairy.
STATEMENT OF ISSUE:
On April 21, 2008 Jefferson County Water Quality Division and the Jefferson land Trust
(Jl T) presented an informational workshop about the Brown Dairy Project and the
Washington Wildlife and Recreation Program (WWRP) farmland category
(http://www.rco.wa.gov/rcfb/grants/farmland.htm). The primary focus of this grant program is to
provide funds to preserve economically viable farmlands in Washington State and to
enhance ecological functions on those lands. The Brown Dairy Project would acquire a
conservation easement on this 50-acre farm south of Chimacum that would permanently
reduce the development potential of the property.
A preliminary application has been available for public review at the Commissioner's
Office since April 24. No comments on the application have been received. Staff now
requests that the BoCC consider the accompanying resolution, developed by the WWRP,
to authorize submission of the final application for the Brown Dairy project for funding
consideration by the Recreation and Conservation Office.
ANAL YSIS/STRATEGIC GOALS:
Staff was provided text for the Authorizing Resolution by the WWRP. The Resolution
expresses a commitment to seek additional funds to complete the project and
documents that an appropriate opportunity for public comment has been provided.

This resolution does not commit Jefferson County to sign the grant agreement with the
RCO, or to necessarily pursue the project further, should the application be successful.
If this application is successful,

from the Federal Farm and Ranch Land Protection Program

. Water Quality would work with granting organizations and JL T to finalize the
conservation easement language to ensure that agency requirements are met
and long-term stewardship is provided.
. Once all of the requisite matching funds are secured, a professional services
contract with JLT would likely be developed to enable JLT to carry out the
acquisition process and hire necessary subcontractors.
The total acquisition and restoration costs of Brown Dairy are estimated to be $790,580.
The WWRP will be requested to provide $395,290 of this amount.
FISCAL IMPACT:
The Jefferson Land Trust has completed the application to the WWRP for funding for the
Brown Dairy Project. The costs to the County for applying to the WWRP are minimal.
RECOMMENDATION:
The final deadline for all application materials to be submitted to the WWRP is July 25.
Staff recommends that the BoCC approve the Authorizing Resolution in the interest of
preserving Brown Dairy and the rural character of Jefferson County.
