MINUTES
Special Meeting
July 25, 2008
Chairman Phil Johnson called the Special Meeting to order in the presence of Commissioner
John Austin. Commissioner David W. Sullivan had an excused absence.
The Board met in Executive Session from 3:05 p.m. to 3:35 p.m. with the Interim County
Administrator, Civil Deputy Prosecuting Attorney, Central Services Director, Director of Community
Development, and an Associate Planner regarding the exemption as outlined in the Open Public Meetings
Act, RCW 4230.110(1 )(i) Potential Litigation.
The Board came out of Executive Session and took the following actions.
Discussion and Possible Action re: Fred Hill Materials, Inc. and GeoEngineers:
. Commissioner Austin moved to direct the Department of Community Development staff to lift the
work suspension on the Fred Hill Materials Pit to Pier project. Chairman Johnson noted that the
County has received their payment and he seconded the motion. The motion carried.
. There was a brief discussion about the payment process for the work being done on the project by
GeoEngineers and ifthere is an outstanding invoice. Commissioner Austin moved to direct
Department of Community Development staff to ask GeoEngineers to lift the work suspension on
the Fred Hill Materials Pit to Pier project. Chairman Johnson seconded the motion which carried.
. Commissioner Austin stated that the letter from the County Administrator dated July 22, 2008 had
started an enactment of the 60-day termination clause and he would like the Board to continue a
discussion on this at the next meeting when Commissioner Sullivan will be present. Commissioner
Austin moved to continue the discussion on the 60-day termination clause in the contract with Fred
Hill Materials until the July 28,2008 meeting. Chairman Johnson seconded the motion which
carried.
. Commissioner Austin moved to direct Interim County Administrator Dennis Richards to send a letter
to Fred Hill Materials and GeoEngineers regarding the actions taken by the Board today to lift the
work suspension and that the Board will be discussing the 60-day termination clause on Monday.
Chairman Johnson seconded the motion which carried.
