Hello,
I have been reviewing the Draft Six-Year Transportation Improvement Program.
I am quite interested in Project #23, the Rick Tollefson Trail - Ballfield Connection.
I am a property owner of land to the north of this intersection improvement, namely APN
901111005 and APN 90111019 to the north of that.
This intersection improvement has been on hold since 1993.
Since then the traffic in and around the intersection of Elkins Road and Chimacum Road, Old
Hadlock Road and Chimacum Road and Lopeman Road and Chimacum Road has increased
significantly.
As regards the Pomwell Road/Chimacum Road intersection. In testimony before the Hearings
Examiner on January 5, 1993; "Robert Nesbitt, Jefferson County Public Works Department,
County Engineer, testified to the following: The Public Works Department considers the
intersection to be a hazardous intersection. Based on its accident history, it has a rating
of 11, " which places it near the top of the list of hazardous intersections in the county"
I can personally testify that this intersection, 31 years latter is still indeed hazardous.
There is really no lane markings or "channelization." In the Jefferson County QUIMPER
PENINSULA TRANSPORTATION STUDY Prepared for: Jefferson County Public Works January 2012, pg
39-40 is the following:
"Chimacum Road Improvements The intersection of Chimacum Road with Elkins Road is located
just west of the County Sheriff's office and north of Bob Bates Fields. The west approach
intersects with the Old Hadlock Road and Pomwell Road. At its present state, the
intersection is awkwardly designed with the west approach having no defined channelization
or lane markings which makes it a potentially unsafe location for vehicles as well as
pedestrians and bicyclists. The intersection is also a likely crossing location for the
Rick Tollefson Trail. Reconstruction of the intersection will provide improved
channelization on the west approach and a center left-turn lane along Chimacum Road to
improve mobility, safety, and access. The improvements at the intersection will also
include pedestrian crossing enhancements as part of the Rick Tollefson Trail and gateway
features to identify the entrance into the Port Hadlock UGA. This intersection also could
be the main access location to the proposed sewer treatment facility to the west and
currently provides access to a gravel pit, so future designs will need to consider the
needs and movements of heavy vehicles."
I have several proposals to alleviate this situation.
1. The complete elimination of Pomwell Road and the road approach. I would access Lopeman
Road to the north for APN 901111019 and the new Intersection of Old Hadlock Road to the
south for APN 901111005. Shold Excavating and Cotton Redi-Mix already has a road approach
onto Lopeman Road. This would provide the best solution to the users of the Rick Tollefson
Trail.
2. The installation of a roundabout at the intersection of Elkins Road and Chimacum Road.
This would also include a turn lane to the north with median strip to access Powell Road
but restrict traffic from shooting across Chimacum Road.

Currently the trucks going to and fro to the Shold/Cotton property and the Shold pit have a
tendency to shoot across Chimacum Road at an angle; sometimes they do not stop!
Either of the two solutions above would end this practice as would finalizing the vacation
of Old Hadlock Road that has been languishing since 1993.

Dear Mr.Gribben:
This letter follows up on our recent phone conversation regarding the vacation of Old Hadlock
Road in Jefferson County, Washington. This response has been developed in consultation with
Philip Hunsucker, the County's Chief Civil Deputy Prosecuting Attorney and presents the steps
in the process for seeing the vacation through.
Background
In 1993,the Jefferson County Bearing Examiner conducted a hearing regarding the potential
vacation of a section of Old Hadlock Road shown on Exhibit#1. The Hearing Examiner issued a
report which concluded that this section of road could be vacated, if certain conditions were met.
The Board of County Commissioners voted to approve the road vacation on February 16, 1993,
pending satisfactory completion of the conditions in the Hearing Examiner's report.
Hayden Development Company, Inc. (Hayden), the property owner at the time of 61 Pomwell
Road, Port Hadlock, WA 98339(Parcel No. 901111005),deeded property to the County(now
generically labeled Parcel No. 000000230—the common code for road rights-of-way) for
relocation of the Old Hadlock Road intersection and a pedestrian path along Chimacum Road,
which were conditions set forth by the Hearing Examiner. Shortly after that, the process stalled,
the intersection relocation project was never completed,and the road vacation was not
completed. Hayden sold Parcel No. 901111005 in 1998 to Thomas and Victoria Truston.
Through a series of sales over years,the Craig E. Durgan Living Trust became the current owner
of Parcel No. 901111005 in 2006. The Craig E. Durgan Living Trust never has had a property
ownership interest in the land deeded by Hayden to the County.

Current
Your client,the Craig E. Durgan Living Trust, who has been a property owner since 2006,has
expressed a desire to see this road vacation process completed. Public Works agrees that the
intersection relocation project should be completed and that the road vacation should occur once
the project is completed.
The area deeded by Hayden to the County in 1993 and the area to be vacated, as shown on
Exhibit#1, are close enough in size to be considered equivalent. As such, Public Works does not
believe that the professional appraisal services discussed in the 1993 Hearing Examiner's report
are necessary to complete this road vacation. Instead,the properties arc considered to have equal
value and therefore compensation for land is not due to either party in this transaction.
Furthermore,Hayden deeded their portion of Parcel No. 000000230 to the County in 1993 and
the Craig E. Durgan Living Trust never had a property interest in Parcel No. 000000230. The
County will incur significant expense in constructing the relocated intersection and pedestrian
path.
Steps Moving Forward
1) The County will initiate a project to relocate the intersection and construct the pedestrian
path on the land deeded by Hayden to the County in 1993. This work must be fit in with
other previously scheduled projects. We estimate it will take 18 months to complete this
work,absent any unknown complications.
2) Once the project is completed, a final resolution to vacate the subject portion of Old
Hadlock Road will be signed by the Board of County Commissioners. The resolution
will include a legal description of the area being vacated which will be recorded at the
Auditor's office by Public Works. Since the Board already voted in 1993 to vacate this
road pending completion of the Hearing Examiner's conditions, it will not be necessary
to conduct another hearing to complete the road vacation.
3) No monetary compensation for property will be provided by either the County or Mr.
Durgan to the other party since the land areas are roughly equivalent.
4) The County is responsible for the work to relocate the Old Hadlock Road intersection and
to develop the pedestrian path along Chimacum Road. Mr. Durgan has no shared
responsibility for these items.
5) The County will coordinate with the utility company for the relocation of the phone line
that currently follows Old Hadlock Road. It will be relocated to the new road alignment.
6) As part of the project,the County will remove the pavement from the road area to be
vacated. This is a gesture of good will and not a typical part of a road vacation process.
Any further restoration of the vacated road area is the responsibility of Mr. Durgan.
7) In order to vacate the small area at the north end currently being used by Mr. Shold for
access to Pomwell Road, it is Mr. Durgan's responsibility to obtain some form of written
consent from Mr. Shold indicating that he is not opposed to the vacation of this area.
This evidence will need to be provided to the County prior to the vacation. Otherwise,
the road vacation will proceed without including this small area.

8) If Mr.Durgan or Mr. Shold desires to relocate the intersection of Pomwell Road(a
private road),it shall be their responsibility. A right of way permit from the County will
be required for this work. The County will not undertake work to relocate Pomwell
Road.
9) If any work associated with the possible relocation of Pomwell Road requires relocation
of utilities, it shall be the responsibility of the private parties performing this work to
coordinate with the utility companies and pay any costs associated with this work. The
County will not undertake any work or bear any cost for utility relocation work to
accommodate shifting Pomwell Road.
10)Mr. Durgan is not required to make any frontage improvements as a direct result of this
road vacation process. Depending on how his property is developed in the future,he or a
subsequent property owner/developer could be required to make appropriate
improvements as determined through a typical development review process; however,
this road vacation would have no bearing on any future requirements.
We hope this letter serves to clarify the issues related to this matter and resolves any remaining
misunderstandings. For convenience,we have provided a place for your client to sign and date
this letter to indicate support for moving forward as outlined herein. Otherwise, if you have any
questions or comments, please contact me.
