MINUTES
Special Meeting
August 29, 2008
Chairman Phil Johnson called the meeting to order in the presence of Commissioners David
Sullivan and John Austin.
HEARING re: Proposed Ordinance Re-Establishing a System 0/ Assessment/or the Port
Ludlow Drainage District: Chairman Johnson opened the public hearing. Jim Pearson, Public Works,
stated that drainage districts are governed by RCW 85.38 which requires the Board of County
Commissioners to review their assessment systems periodically. He explained that the Port Ludlow
Drainage District was formed in 2000 and in 2001 the County Commissioners approved Ordinance No. 04-
0815-01 detailing the assessment system to be used. At the time, there was some controversy about large
lots in Port Ludlow #6 on the west side of the District. The District recognized the need to address these lots
and recommended an amendment to the assessment system. The County Commissioners approved the
revision in Ordinance No. 07-0825-03.
The Board of County Commissioners is required to approve the assessment every 4 years. Jim Pearson
clarified that the Commissioners are only approving the assessment system for allocating funds. The Port
Ludlow Drainage District sets the level of assessment when they adopt their budget. He added that no
revisions have been made to the assessment system. It is the same system that was put into place in 2003.
Chairman Johnson opened the public testimony portion ofthe hearing.
Carl Barton, Port Ludlow, stated that the letter he received regarding this hearing said there would be a map
included. There wasn't a map and he is not sure what zone his property is located in. He stated that he
thinks the mailing was a very poor communication.
Jim Pearson noted that there are 5 zones and most of the Drainage District is in Zone 1.
Barry Baker of Gray and Osborn, engineers for the Drainage District, reiterated that the assessment system is
the same as last year. He apologized for not including a map in the letter but said that it was in the
advertised hearing notice. He explained that Zone 0 is property that cannot be developed such as open space
or greenbelt, Zone 1 is the majority of the residential areas, and Zones 2, 3, and 4 drain in or out of the
District.

Commissioner Sullivan asked ifthe Drainage District has received comments on the assessment system?
Drainage District Commissioner Walt Cairns answered that they have received very few comments.
Hearing no further comments for or against the re-establishment of the assessment system, Chairman
Johnson closed the public hearing.
Commissioner Sullivan moved to approve ORDINANCE NO. 08-0829-08 in the matter of repealing and
replacing Ordinance No. 04-0815-01 and Ordinance No. 07-0825-03 and finalizing the assessment system
for the Port Ludlow Drainage District. Commissioner Austin seconded the motion which carried by a
unanimous vote.
NOTICE OF ADJOURNMENT: Commissioner Sullivan moved to adjourn the meeting at
10:15 a..m. to the next regular meeting on Tuesday, September 2,2008. Commissioner Austin seconded the
motion which carried by a unanimous vote.
