Ordinance # disposed of at the County Transfer Station 09-0922-08 WHEREAS, Jefferson County (County) entered into an lnterlocal Government Agreement with the City of Port Townsend (City) on October 8th, 1992 for the purpose of allowing the City to "construct and operate a biosolids and yard waste compo sting facility with associated system within the site of the Jefferson County landfill"; and WHEREAS, the County has adopted a Solid Waste Management Plan dated April, 2008 that provides for the composting of yard debris and biosolids from the City's Secondary Wastewater Treatment Facility at the County landfill site; and WHEREAS, the disposal of yard debris at the facility was encouraged when facility operations began in December, 1993 by waiving a fee for this service; and 'f '~\ 1=" 1'1,1 r :;' . WHEREAS, yard debris volumes began to exceed the facility's designed capacity for material throughput in 1999; and WHEREAS, managing yard debris at the County Transfer Station has a significant budget impact on the County's Solid Waste Division; and WHEREAS, the County's cost of managing yard debris at the County Transfer Station has been passed through to Solid Waste customers; and WHEREAS, County and City yard debris customers contribute volumes on a near-equal basis; and WHEREAS, the Solid Waste Advisory Committee, in a letter dated June 30, 2006, suggested to the Board of County Commissioners (Board) that a study of yard waste management and a fee structure be undertaken, that a joint task force be formed, and that a workshop with the Board be conducted; and, WHEREAS, County and City staff jointly conducted an analysis of yard waste management and a fee structure and have summ(l!ized their analysis in an issue paper; and . WHEREAS, County staff presented this analysis to the Board at a workshop on August 8, 2007; and . Ordinance No. 09...,0922-08 Amendments to Jefferson County Code WHEREAS, a second workshop was convened on June 25, 2008 at which City and County staff presented their analysis and a draft County Ordinance and Amendment to the Interlocal Agreement to a representative of the City Council and the Board; and WHEREAS, the Board completes this process by the adoption of this ordinance and Amendment to the Interlocal Agreement and now makes the following findings of fact: 1. The Solid Waste Advisory Committee has discussed issues related to yard debris handling at the transfer station facility at regularly scheduled meetings between 2005 and 2008 and all meetings were duly-noticed and open to the public. Staff analysis has been shared With local mediaqutlets and articles covering a proposed yard debris tipping fee have appeared in the Port Townsend & Jefferson County Leader and the Peninsula Daily News. 3. A Final Draft Amendment to the Interlocal Agreement was adopted by the City on July 24th, 2008. 4. The Final Draft Ordinance and Amendment to the Interlocal Agreement were presented at a workshop with the Board of County Commissioners on September 2nd, 2008 and this workshop was open to the public. 5. The Final Draft Ordinance and Amendment to the Interlocal Agreement were presented to the Board of County Commissioners at a Public Hearing on September 22nd, 2008 and this Public Hearing was duly-noticed and open to the public. 6. The Department of Public Works has proposed changes to the Jefferson County Code (JCC), specifically amending the JCC to specify a fee for yard debris collected and managed at the Jefferson County Transfer Station, codified at Appendix FEE SCHEDULES ot1the. JCe, NOW THEREFORE BE IT ORDAINED, as follows: SECTION 1. The current version of the Jefferson County Code, Appendix FEE SCHEDULES, is hereby repealed and replaced with the attached version of Jefferson County Code, Appendix FEE SCHEDULES, marked as Exhibit A. SECTION 2. If any section, subsection, or sentence, clause, phrase, or figure of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance or the application to other persons or circumstances shall not be affected. The purpose of this section is to establish a fee schedule for the solid waste division of the Jefferson County department of public works. This schedule shall apply to all fees required by the solid waste division. [Ord. 6-93 S 1] 111-020 Jacob Miller Road transfer station - Commercial and noncommercial rates. Base fee plus applicable solid waste refuse tax: Base Fee (1) Solid waste disposal rate per ton $110.00 (2) Asbestos disposal rate per ton (properly contained only) 143.40 (3) Refrigerators 19.12 (4) Minimum charge 4.78 (5) Yard Debris Flat fee of$5.00 for loads of200 pounds or less $48.00 per ton for loads over 200 pounds "Yard debris" shall only include grass clippings, leaves, tree branches not over eight to 10 inches in diameter and less than eight feet long and other plant material excluding stumps, kitchen scraps, food waste, lumber, rocks, gravel, dirt, lawn furniture, tools, or other nonvegetative material. Acceptable yard debris shall be dropped off at a point designated by the scale attendant. In the event the weight scales are inoperative, the rates for drop box sites listed in Section IV-030 shall apply, except that commercial compacted waste shall be charged at the rate of$52.58 per cubic yard, plus tax. Hearing to amend Ordinance No. 06-0726-93 and.to adopt a related amendment to an Interlocal Agreement allowing for the collection of a fee for the dumping of yard debris at the County's Transfer Station. Description: Public Hearirlg to take public comment and potentially adopt a fee ordinance and related Third Amendment to an Interlocal Agreement allowing for the collection of a fee for the dumping of yard debris at the County's Transfer Station. Statement of I$sue: Under an Interlocal Government Agreement between the City o.f Port Townsend and Jefferson County, the City manages a Biosolids Composting Facility at the County Transfer Station Facility. The facility utilizes yard debris (which includes residential, commercial landscaping and large-scale land clearing debris) as feedstock for its biosolids operation. County and City residents generate yard debris brought to the facility on a roughly equal basis. The amount of yard debris materials being received has exceeded that needed for the composting facility operation since about 1999 and has continued to rise. This has created a financial burden for the County in terrns of accou~ting, scale . facility maintenance and site upgrading. Responsibility for addressing the issue is shared by the City and County due to the nature of the Interlocal Government Agreement and because yard debris is being Department of Public Works Regular Agenda Page 2 of 2 generated by a nearly equal split of city and county residents. The County and City Public Works staff recommends that a fee be charged for the dumping of yard debris at the Compost Facility in order to offset these expenses and to encourage onsite and/ or private sector management of yard debris. Analysis: The Port Townsend City Council has agreed on a proposed tipping fee of $48 per ton with a minimal charge of $5. The County would receive a share of the fee based on a fixed cost per transaction. The County's costs for material throughput would be offset by the proposed per transaction share. Alternatives: The Commissioners may recommend a motion to adopt the Third Amendment to the Interlocal Agreement between the City of Port Townsend and Jefferson County for Biosolids Composting and to amend Ordinance No. No. 06-0726-93 to establish a tipping fee for yard debris managed at the County's Transfer Station. The Commissioners may recommend adoption of the Third Amendment and ordinance with conditions if any substantive public comment is received before or during the Hearing, or may postpone adoption until such substantive comments are resolved.
