Brown with all members present. Hearing: Proposed Road Vacation, Southwest Corner of Lot 16, Block 35, Chalmers No.2 Addition to Irondale; Bud Ammeter, Petitioner. Mrs. Johnson appeared to say she was in favor of the proposed vacati.on, but she had previously asked Eng. Becker if 7th Avenue could be vacated and he said no vacations would be allowed in this plat. Chairman Brown advised this vacation was being considered in exchange for right-of-way being given to ;the county by the petitioner. After further explanation by Mrs. Johnson of her reason for wanting 7th avenue vacated (to make her property contiguous}, Chair- man Brown explained that no property would be vacated if it would be detrimental to further development, however, if she desires to submit a petition it would be considered. Eng. Becker recommended vacation of the exisitng right-of-way in exchange for the property being deeded to the county. Moved by Commissioner Mercer, seconded by Commissioner O'Meara to approve vacation subject to receipt of a quick claim deed from the petitioner, and to sign Resolution No. 52-75, Order of Vacation, as follows. Unanimous (Res. No. 52-75) Proposed extensions of the county's Mental Health & Drug Abuse, and Alcoholism Program.Grants and budgets extending the programs through Dece.ber 31, 1975, were received for approval. Moved by Commissioner O'Meara and seconded by Commissioner Mercer to set hearing date for September 8, 1975. Unanimous 'f The Board approved and signed the hearing notice for the boating ordinance re-setting the hearing date for September 15, 1975. Notice will be so published and posted. 1/ Business from the Planning Dept: Shoreline Management Application for Permit No. 13-75, Heyler Davis; land fill to being lot to level grade to support a trail; north_~ of Lot 9, Block 7, First Addition, Trail's Encl Homesites. Assistant Plan. Dir. Aumock described the proposed project and topography of the land. He advised that the Shoreline Advisory Commission recommends approval subj.ect to the following conditions: (3); and that due to the findings of the environmental worksheet, suggest that an environmental impact statement not be prepared. Moved by Commissioner Mercer and seconded by Commissioner O'Meara to approve S.M. Application No. 13-75 subject to the above mentioned conditions recommended by the Advisory CommiSsion, and that the project is not a major action having a signi~icant affect on the environment, therefore, an EIS need not be prepared. Unanimous Forest Practices Permit Application .No. FP-02-00695, Roy Dailey. Chairman Brown signed notice to the Dept. of Natural Resources that the pro- ject appears to come within the jurisdiction of the Shoreline Management Act and that contact should be made with the Co. Planning Dept. Copy of letter to Melvin Kively, from the Plan. Dept. re: ViOlation of the County's Subdivision Ordinance. (Presented for Board's information only) Dept. of the Army Corps of Engineers Public Notice 071-0YB-I-00282l, Pope & Talbot Development Inc. Chairman Brown signed response to the Corps that the applicant has applied for a shoreline management permit. J The Board received and read a copy of a letter to Monte Hester, Attny., from Pros. Attny. Howard re: Daryl Hedman's Claim for Refund of Timber. Pros. Attny. Howard recommends that the Commissioners deny Mr. Hedman's claim. Moved by Commissioner O'Meara and seconded by Commissioner Mercer to deny claim on the basis of the recommendation of the Pros. Attny. Unanimous Pros. Attny. Howard appeared to discuss his letter to the Board, dated Aug. 22+,. 1975, re: Lazy "c" Water System. The letter states that Mark Spahr, Dist. Howard advised there may also be problems relating to the bond because it was made to "Kimbal Constructior. Co.", whose owner is now deceased, therefore, the company and bond may no longer exist.
