t fer the West Valley raad design. Sanstrem explained the tepagraphy ef.the
area, 'plans relating ta the bicycle and harse trails (estimating appreximately
$5,000 per mile), and new curve design. Becker advised that all .of the survey
data pertaining te the praject has nat been received, and therefare, requested
that Beard's actian be delayed. Actian delayed until all pertinent infermatien
is available ta the Baard. .
H.B. Hansen came be fare the. Board te obtain infarmatian relevant te his pre-
pesed Shert Subdivisien. He purchased a five acre piece .of praperty and intends
te subdivide it inte three pieces. Stated he was unaware .of the subdivisien
.ordinance when he beught the preperty and the Plan. Dept. teld him divisien
wauld be permissable. Plan. Dir. Cunningham said that wh~n this infarmatien
was given ta Mr. Hansen it was nat knewn that the praperty was recently sub-
divided by the seller.
After further discussian it was maved by Cemmissianer O'Heara and
secended by Cemmissiener Mercer that Mr. Hansen either has ta camply with
"Leng Plat" previsians .or retain the preperty fer five years befere re-subdivid-
ing, therefare denying deviance fram the .ordinance. Unanimaus
Mr. Hansen asked if the Baard weuld delay actien until he cauld retain
an atterneydue ta his being misinfarmed by the Plan. Dept. Cemmissiener
O'Meara said their interest was in the pratectien .of the praperty within the
ceunty, that capies .of the Subdivisian Ordinance are available ta the public,
and his metien would stand as stated. Cammissieners Brewn and Mercer cencurred.
Questien aresewhether Mr. Hansenweuld be required to previde a 60'
right-ef-way te short plat in five years. Beard stated it weuld be cOnsidered
when plat is presented.
Plan. Dir. Cunningham advised that the 1160' easement" requirement had
been discussed by the Planning Cemmissien and they feel it is net feasible for
all five acre plats. Chairman Brown said it is the county's pelicy te encour-
age all develepers te previde 60' easements within their plats.ferprotection
fer future development. .
Business fram the Plan. Dept:
y - Final Shert Plat, David M. Thompson - Cunningham advised that the
plat meets all requirements and has received approval frem the Planning, Health,
and Engineering Departments. Meved by Cemmissiener O'Meara and secended by
Commissiener Mercer te approve and sign final plat. Unanimaus

able te reappeintment, hawever, Mr. Shert stated he would submit. his resignation

sianer O'Meara and secanded by Cammissioner Mercer ta reappoint Chet Dalgleish
and Nerris Shart to a new three year term, effective Sept .1, 1975 through
Sept. 1, 1978. Unanimous

submitted a list .of all pending applicatiens as .of this date far Board's in-
formatian.

The minutes .of August 11th were appraved by mation .of Cemmissioner O'Meara
and second by Cammissianer Mercer. Unanimaus
~ Tany Vivenza, Legal Service Directer & Attarney, appeared te request support
fer the Legal Aid Office here in Part Tawnsend. He advised that recent Federal
statues require they be separated fram the Cemmunity Actien Ceuncil within a
year, and unless they can .obtain lacal support, they will be forced ta merge
with a large city such as Seattle, Tacama, .or Everett. He said he still has
nat received any natice .of .funding fram Olympia, but was tald the county ceuld
apply ta Washingtan D.C. far a grant in their behalf. Chairman Brawn said he
had talked te the Legal Aid people in Olympia and they maintain that all funds
have nat been allacated, and will send the necessary informatian and appli-
catians, but any..grant wauld be en a 50/50 match basis which the county may
net be able te make available, depending en the budget.
~ Cenwissioner O'Meara informed that Jeffersan Ceunty has received Na.l priority
far funds thraugh the Regienal Law & Justice PlanDi~g Cauncil far jail .
renavatian and a $4,000 grant far a relay statian. Renevatien plans will be
drafted by Sheriff Hansen far presentatian te the Ceuncil.
\- As per Baard's request, Hamer S. Smith Jr. Ins. sent a letter centaining infer-
matian on lIErrors and Omissiens Coveragell, stating in part that I-West has a
special public entity policy which pravides special caverage fer the Cemmis-
sian members and emplayees, but their ather seurce far such ceverage wauld
not submit a quate withaut financial statements. The feasibility .of the
caunty .obtaining this type .of coverage was discuss~d with Pres. Attny. Heward
and he advised that fer cemplete understanding the Board shauld have Smith
explain what benefits ceuld be derived fram this additianal insurance caverage.
~ Geerge Huntingferd came in te request that ceunty te apply far an extensien of
the Dept. .of Fisheries permit ta allew fer cantinuance .of ditch clearing
prejectin his area. Chairman Brewn said the caunty ceuld net pay fer any
additional werk, but they wauld apply far the permit extensien. Huntingford
agreed ta pay far the balance e~ the clearing.
Charles (Chuck) Mertel, Ceuncil for Evergreen Bnviranmental Develapment Corp.~
appeared ta address himself in respect to the preceedings .of both the Planning
Cammissian and the Shareline Management Advisory Cemmissiem meetings and the
recammendatians they have presented. He presented a letter te serve as a
fermal petitien and appeal ta the Board "for the Jeffersen Ceunty Shereline
Cammittee fer an impartial and camplete hearing by that Cemmittee at the
earliest pessible date .or, in the alternative, an appeal ta this body relative
ta the actian taken by the Shereline Cammissien"; alsa, lIfar an .order directing
the Jeffersan County Planning Cammissian ta complete its deliberations in a
timely manner and te present te this body its findings as required by law".
TIle balance .of the petition outlines the reasons and issues an which they base
taeir appeal. He further stated thevate, with respect ta what the Shareline
Carnraissien entered into their recammendatian te the Beard, is impraper insafar
as tt uaes not centain specific findings as te why they are setting farth a
negative recommendation. In regard te the Planning Cemmissien, he said that
"basically they are refusing te da their jab because .of prejudice against the
preject".
The Baard cammended bath the Planning and Shoreline Advisory Cammis-
sians far their previaus perfarmances and said they wauld nat accept Mertel's
claim as fact that they were being derelict in their. duties. Also, the Plan-
ning Commissian is net obligated ta make their findings within a certain
peried .of time.
Plan. Dir. Cunningham said the Plan. Cammission has tried very hard
ta rruake the precedures en this matter ga as quickly and smoathly as passible,
but because .of the camplexity .of the matter the presures have become very acute.

the members are meeting with Pras. Atnny. Heward an how ta preceed so that
a decisian can be made.
Prase Attny. Howard stated the bulk of the Plan. Camm. meetings have
been taken up with their (EEDC) presentatians and have left ne time fer the
members ta deliberate .or came ta a canclusian. In his epinian, the Plan.
Cernrn. has praceeded satisfactarily.
Ed Richey., Chairman, S.M.A.C. said Mertel's cancern is with the cen-
sistency of the vote, and refers ta the "pressures" that .one .of the members
stated he was under. He explained that the questiannaire which they use as
a "taal" far making their decisons is taken directly fram the RCli and the
Shareline Master pragram and was nat designed with the idea .of ceming up
with a "yes" or "na", but is to be used as a guide. He recommends the Beard
review the questiannaire far better understanding. And, as fat'? as the "pressure
is cancerned, one member had net studied the preject as well as oe threught
he shauld and was there fare hesitant ta vote. Consequently, he, as Chairman
was.guilty .of pushing this"member ta vate sa the final decisien ceuld be
made far presentatien te the Baard. .
At the cenclusian .of the discussion it wasmaved by Commissiener O'Meara
and secanded by Cammissianer Mercer ta delay decisien an the Shareline Advisery
Camnlissian's recemmendation until all informatian is received fram the Plan.

Chairman Brewn alse stated that Pres. Attny. Haward will review the
precedures .of the S.M.A.C. meetings and if there has been errers the necessary
steps will be taken fer cerrectien.
.~ Mrs. Ed Kream appeared in relatien to the final acceptance of Kala Point Div.l.
After a lengthly discussian between Mrs. Kraam and Pros. Attny. Haward in
reference ta the dedicatian and/ar maintenance of Kala Point Drive, the Baard
stateo that campliance .of raad canditians specified on August lIth and agreed
ta by the Project Engineer had nat transpired, and signing .of the final plat
caulri not take place until the canditions are campletely satisfied.
~ hng. Becker and Rex Aldrich, .owner .of Olympic Disposal, presented a preposed
agreement for the transperting and emptying of the drep baxes at a regianal
sanitary landfill as required under the Selid Waste Management Plan. Said
agreement was thoroughly reviewed w:j..th a critical point by paint discussion en
toe rate scnedule far hauling and emptying of the bexes lecated at Hadeck,
