WHEREAS, after due consideration, it appears to this Board of County Commissioners that it is
in the public interest to vacate, as county road rights of way, the portions of the following County
Road Right of Way, described as follows:
Garden Club Road No. 585809:
All that portion of Garden Club Road No. 585809 defined as usage right of way lying Easterly of
Mile post 0.31, lying in the NW 1/4 of Section 9, Township 30 North, Range 1 East. W.
M., and adjacent to APN 921092014; being a distance of 0.03 miles and the terminus of
said roadway. The net result of the proposed vacation is to shorten the overall length
from 0.34 miles to 0.31 miles officially maintained on the County Road Log. Situate in
Jefferson County, State of Washington.
NOW, THEREFORE BE IT RESOLVED, and in contemplation of the language of statute
R.C.W. 36.87.010, the County Engineer is hereby directed to examine said roads and report his
opinion as to whether this county road right of way should be vacated and abandoned and all
other facts, matter and things which will be of importance to the Board, and that such report to be
filed as soon as possible. The hearing date for the proposed vacation is January 23, 2009 at the
hour of2:00 p.m., with the Jefferson County Hearing Examiner in the first floor conference room,
Courthouse, Port Townsend, W A.

A Resolution declaring an Intent to Vacate the following County Road Right of Way:

All that portion of Garden Club Road No. 585809 defined as usage right of way

maintained on the County Road Log.
Statement of Issue:
Public Works has examined this certain County road as to its current viability and usefulness
within the County Road system. At this time, the road listed above is considered by Public
Works to be unnecessary as part of the overall County road system. This resolution of intent
to vacate a portion of the public road directs the County Engineer to complete a formal
examination and report which includes comments from public agencies and adjoining property
owners prior to the public hearing with the Hearings Examiner.
Analysis/Strategic Goals:
This road has been selected to help insure that existing County roads on the Official County
Road Log continue to receive limited road resources and help reduce unnecessary County
liabilities and manage risk. By using the standard vacation process, the County can determine
that indeed this road is not useful, and it is in the public's interest to vacate it. This proposal
supports Strategic Goals 6. a. and 7. b.

Alternatives:
The Board could choose not to pass the Intent to Vacate and leave the road on the Official
County Road Log, or the Board may choose to direct Public Works to draft a resolution that
would reduce the maintenance level on this road so there is limited expenditure on this road.
Both of these alternatives would not substantially reduce the County's liability on this road.
Fiscal Impact:
The long term impact of the actual vacation of this road may help reduce future costs
associated with the management of unnecessary right of way and potential maintenance
expenditures.
Recommendation:
The Department of Public Works recommends the Board of County Commissioners adopt the
attached resolution of intent to vacate the County right of way, further directing the County
Engineer to examine said road and report his opinion as to whether this county road right of
way should be vacated and abandoned and all other facts, matter and things which will be of
importance to the Board, and that such report be filed as soon as possible. The hearing date
for the proposed vacation is January 23, 2009 at the hour of 2:00 p.m., with the Jefferson
County Hearing Examiner in the lower level conference room, Courthouse, Port Townsend,
Washington.
