Jerdine C.Bragg MI~UTES December 27, 1976 10:00 a.m. - Meeting called to order by Chairman B.G. Brown, with all members present. Prosecuting Attorney William Howard appeared re: Letter received from Attorney Thomas P. schlosser in relation to Shorelines Hearing Board Appeal of Substantial Development Permit on Kala Point Archaeological Site. Schlosser suggested in his letter that the proceedings before the Shorelines Hearings Board can be avoided by the Board of Jefferson County Commissioner's taking action to rescind the permit. Schlosser's letter further stated the basis for revoking the permit woUld be for the following reasons: (1) the penni.t application and attached environmental checklist contain inaccurate and decipti ve statements regarding compliance with the Shoreline Master program and the Archaeological significance of the site. (2) the decision to grant the permit on October 25, 1976 was clearly erroneous because the Camlissioners failed to consider. the applicability of perfonnance . standards for developneuts affecting archaeological and historic sites. (Chap.5 Shorelines Master. Program, Sub-section 5.420) (3) the procedure leading up to grant this Substantial Developrent Penni. t did not comply with the requirements of the Master program relating td burden of proof for secondary uses, . notice of public hearings ,or notification of Department of Ecology and Attorney General's offices. Howard stated it is his understanding tha Kala Point is trying to have the appeal rescinded due to the fact it was untimely filed, by not making the thirty day filing period. According to Kala Point's calculations the appeal was filed on the thirty-first day. The Board concurred that they would attend the Shorelines Hearings Board meeting on March 3rd & 4th in the Commissioners Chamber before any determination will be made. >5.'" BUSINESS FROM COUNTi DEPARTMENTS: PlanpingDepartment: Army Corp Notice: (a) Port of Port Townsend - #OYB-l-003706 Motion by Commissioner Mercer second by Commissioner O'Meara to sign notice to Corp that applicant has applied for a Shoreline Management Permit. Unanimous. Forest Practice Permit Application: (a) #FP-02-0l242; RichardHordberg Clear.-cut logging with Timberjack skidder for conversion t.o residentual use. Moved by Commissioner Mercer, second by Commissioner O'Meara to sign notice of no objections'to the Department of Natural Resources. Unanimous. Letter from Gunnar Bersos was discussed. Board read letter from Mr.. Gunnar Bersos, SEattle re: His confusion in relation to an application of the Shoreline Management Act to his property at the Cape.George Colony. Bersos complained the Planning Director Cunningham visited his property and oVer-exerted his authority by claiming Bersos had exceeded the $1,000.00 limit of the Shorelines Management. Bersosfurther complained that Cunningham intimidated him by stating his soil was bad. Bersos requested that Cunningham be dismissed from his position and replaced. Page 2 Planning Department, Con't. with propertyowners, prospective developers, and your constituents in general in a fair and impartial manner. Mer. Bersos has been no exception." The Board unanimously decided Cunningham has always acted in a very professional way and has had a respectful attitude at all times toward the public. They requested that a response be writted to Bersos advising that Cunningham would not be dismissed for these reasons. Mi utes of December 6th and 13th were unanimously approved by motion of Commissioner Mercer second by Commissioner O'Meara. Th re being no further business before the board, meeting was adjourned.
