MINUTES
October 17, 1977
10:00a.m. Chairman Mercer called the meeting to order with all members
present.
Mr. Clarence Jennings and concerned citizens re: Domsea Farms,
Inc., fish rearing pens. 12 persons appeared in protest of the pens and
one person favoring the pens. Appearing also were Planners Dave Cunningham
and Tom Aumock and Health District Sanitarian Randy Durant. Mr. Jennings
reported he was dissatisfied with the declaration of non-significance. He
submitted a letter of opposition addressed to the Shoreline Advisory
Commission for the Board's consideration. Chairman Mercer read the letter
as well as letters of opposition from Marjorie Davis and Guy Rudolph. A
copy of a letter from the Department of Army to Domsea was read. It acknow-
ledged cancellation of Domsea's application for fish pens off Hadlock.
The following concerns were again brought up: 1) possible impact
on clams; 2) noise levels regarding pumping fish in and out of pens and
for maintenance of the nets; 3) inquiry whether a permit application for
the processing plant has been received by the county; 4) what is the process
of restricting the permit if no EIS is required.
Members of the Board responded to the inquiries as follows:
Commissioner Brown clarified his response of the previous week
that the bay belongs to the people of the state of Washington and that it's
managed by the Department of Natural Resources (DNR). The Commissioners
can protect the environment, but if the quality of the bay doesn't deteriorate
then it's DNR's perogative to lease it.
Commissioner Brown stated that there is already an approved fish
processing plant in lower Hadlock. He also reported that Domsea just needs
to provide enough information to allow the Board to make an intelligent
decision and that all kinds of restrictions can go on the permit without
an EIS.
Chairman Mercer reported that according to an acquaintance who
works at the Manchester site, the clams are extremely good in that area.
Commissioner Brown reported that these concerns have been fairly well
answered by Domsea and probably why people of Hadlock feel left out is
because they didn't participate in the dialogue.
Mr. W. C. Henry, attorney who lives in Hadlock, questioned the
Board on why the Final Declaration of Non-significance is being acted on
prior to the Shoreline hearings and suggested postponing action until after
the hearings when all the information is brought out. Planner Dave Cunningham
explained that they are acting in accordance with SEPA Guidelines by waiting
15 days to act on the final declaration. The guidelines state that the
Board, after the 15 days period may do one of 3 things: l)ask for an EIS,
2) sign the final declaration, or 3) ask for more information. Later in
the meeting he further read that if a final declaration is issued the only
way to change it is if a) the project changes, or b) if the information given
was given under false pretenses. So, the Board could clearly ask for more
information at this state, but it's important that if that is done the Board
should be making some progress toward making a decision on whether or not
to make an impact statement. The Shoreline Commission can still meet and
take testimony and see if a permit should be issued in light of the
policies of our shoreline program.
Commissioner Brown stated that he can't find a reason for an EIS
which serves to expand on a particular item. Chairman Mercer said that the
cost of an EIS is so great and it was his understanding the same information
would come from the Shoreline hearings.
Health District Sanitarian Randy Durant reported he has requested
information from Domsea Farms about sewage disposal, but no response yet.
Mr. Henry stated that the question of human sewage seems to be a
serious enough consideration to delay the final declaration. Commissioner
Brown replied that it was answered when the Board reviewed the checklist.
They intend to put it in holding tanks and have it pumped.

Commissioner Brown stated that the objection by the Tugboat
Association needs to be addressed and the Board needsto look over the
letters and see if the concerns are properly addressed in writing.
Motion by Commissioner Brown that we need to request points of
special concern from Domsea Farms and agencies before the Final Declaration
of Non-significance is signed. Commissioner O'Meara seconded the motion
with the stipulation that both the Corps and Domsea are contact about the
traffic situation.
BUSINESS FROM COUNTY DEPARTMENTS:
Planning re 1)
SEPA Threshold Determination; Building Permit for Hadlock
Mini-Storage; C & DConstruction Co, for 20 storage units
in a one story structure located at the end of "E" Street.
Herb H. Doss of C & D, and Ed Croom, contractor appeared.
It's more than 4,000 square feet so it comes under SEPA
guidelines. Planner Torn Aumock and the Board wentover
the environmental checklist and found no significant
impacts. Motion by Commissioner O'Meara, seconded by
Commissioner Brown to sign the proposed declaration of
non-significance.
2) SEPA Threshold Determination; Building Permit for 10-unit
apartment in Hadlock, located at the end of Pine Street,
C & D Construction Company. Herb H. Doss of C&D and
contractor Ed Croom appeared. The Board reviewed the
environmental checklist and found no significant impacts.
Motion by Commissioner O'Meara seconded by commissioner
Brown to sign the declaration of non-significance.
3) Mr. Quigley re: Killapie Beach Plan Water System. Question
is whether or not a geological report is required of
Mr. Quigley for a permit to install a water system. Mr.
Quigley appeared along with Planner Dave Goldsmith.
Mr. Quigley reported that the installation of the water
system is to be in the unplatted portion and isn't
affected by the resolution requiring a geological report
plus the understanding that the water system was not a
part of this resolution. The minutes of May 9, 1977 were
read which stated "Prosecuting Howard feels a soil report
should not be required for the installation of water lines
due to the request being filed prior to the adoption of the
resolution." The Board advised that the building permit
is OK, but a new permit application would fall within the
resolution.
Motion by Commissioner Brown, seconded by Commissioner O'Meara
to approve and sign Resolution No. 75-77 amending Shoreline Management
Substantial Development Permit No. 33-76; Kala Point Development Company
to include as an additional condition of approval the terms and conditions
set out in that contractural agreement dated April 4, 1977 between Kala
Point Development Company and the Snohomish Tribe of Indians, Inc.
Sheriff Hansen reported a 19 foot glass ply boat with trailer
and 150 horse motor outdrive located at Lake Samamish for $1200. Motion
by Commissioner O'Meara for Sheriff Hansen to look at the boat and purchase
it if it's in good condition. Seconded by Commissioner Brown.
Motion by Commissioner O'Meara, seconded by commissioner Brown
to approve and sign the Treasurer's statement of receipts and disbursements
from July 1, 1977 to September 30, 1977 and of cash on hand as of October 1,
1977 .
Bid award for labor and material to install new 1250 gallon
septic tank and drain field for the Quilcene Community Center. Motion by
Commissioner Brown, second by Commissioner O'Meara to award bid to Frank
D. Hyde. Bids submitted were: Frank D. Hyde $1,045.32 incl. tax
McClanahan Const. $1,250.00 plus tax

Conclusion on Anders Steinsvik request re: Opening of county
road, Block 55, Irondale. The Board concluded that the work can proceed
as per the work permit issued by the county engineer's office with only
the north seven marked trees opposite Lots 1 through 6, Block 55 to be
removed for street access.
Motion by Commissioner

Final Declaration of Non-significance for puget Sound Power
and Light proposed project of Irondale substation approved and signed.
The minutes of October 10, 1977 were approved and signed by
motion of Commissioner O'Meara. Second by Commissioner Brown.
The Board agreed to send a letter to Dr. Deer's attorney,
Charles Mertel re Bridgehaven suggesting that a portion of the property
be deeded to Jefferson County to be held in escrow for the completion of
the Bridgehaven water system may be acceptable to the Board.
The Board approved that Chairman Mercer sign a notice of
application for Liquor License for Reed's Enterprises, Inc.
