MINUTES
June 5, 1978
10:00 a.m. Meeting called to order by Chairman Carroll M. Mercer with
Commissioner Brown present. Commissioner O'Meara is on
vacation.

Motion by Commissioner Brown, second by Chairman Mercer to
accept the Paint-a-Line bid at $18,766.20 if it is found correct by
Engineer Becker. Becker advised that the figures are correct as presented.
2) Repairing and Restoring of the Courthouse
Clocktower Roof
No bids were submitted. The bid call will be advertised again.
Motion by Commissioner Brown, second by Chairman Mercer to set bid opening
for June 26, 1978 at 10:00 a.m. to be advertised in the Leader and in the
Daily Journal of Commerce.
Proposed Budget Extension Hearing; Health Department.
No one appeared for or against. Motion by Commissioner Brown, second by
Chairman Mercer to approve and sign Resolution No. 44-78 to adopt the budget
extension of $31,061.00 in unexpended funds for the Health Department to be
reimbursed through the Comprehensive Employment and Training Act to provide
home health care, and the Washington State Department of Health to establish
a Maternal Child Health Program in Jefferson County.
Proposed Road Vacation; portion of 7th Avenue between Belle
and Margaret Streets, Chalmers Second Addition, Irondale, Raymond H. and
Mildred Johnson, petitioners. Mr. and Mrs. Johnson appeared. Belle Street
encroaches upon lots owned by the petitioner. Engineer Becker recommended
that Belle Street and 7th Avenue be properly located and that the vacation
be denied. The Planning Commission recommends the road vacation of 7th
Avenue is not relevant to the problem of the petitioner and recommends the
road vacation be tabled until Engineer Becker can prepare a comprehensive
road plan of this area. Mrs. Johnson stated that she would like the present
road which crosses her property closed. It has been open 5 years. The
Public Works Department can relocate Belle Street in about 3 weeks. Motion
by Commissioner Brown, second by Chairman Mercer to deny the vacation and
for Engineer Becker to relocate the road.
BUSINESS FROM COUNTY DEPARTMENTS:
Planning re: 1) SEPA Threshold Determination, Shoreline permit application;
Ray Buchmannfor a loading and unloading facility at the
South Point ferry landing. Mr. Buchmarnappeared. It's
a permanent facility to load gravel onto barges which
includes placement of two, 3 pile dolphins and 2 single
piles to act as supports for a conveyor belt, including
moorage of tug boat and barges. Primary use to serve
Trident Construction; project includes 12' x 12' float
for recreational purposes. The Board reviewed the
environmental checklist and some changes were made.
Planner Tom Aumock will make the changes before the
Board takes any action.

2) Gary and Joe Engman reo Shoreline application for
Dungeness Farms and Sea Farms. Gary and Joe Engman
appeared for Dungeness Farms and Sea Farms. Eleven
persons appeared in opposition.
a) Dungeness Farms: Planner Tom Aumock reviewed
the project for a permanent location of seasonal
moorage of barges for loading and unloading of
oyster cultch, oysters and clams. The proposal
would be at the former Pope and Talbot log
dump north of Brinnon. Engman reported that
a new lease with the Department of Natural
Resources (DNR) was assigned for ten years for
his aquaculture project. The Board requested a
copy of the DNR lease. Brinnon residents objected
to odors left by goeduck shells, noise problems,
with survey lines, trespass and concern that if
the application is approved it will set up a
situation for continuing past violations. Engman
was not aware of the need for a permit. The
Planning Commission recommends approval subject
to seven conditions. The Board delayed action until
Monday, June l2, 1978 at lO:30 a.m.
b) Sea Farms, Planner Tom Aumock reviewed the project to
convert a temporary oyster and clam hatchery to a
permanent facility south of Brinnon on Hood Canal.
The Board discussed the intake line. A portion of
the line extends beyond the Mean Low Water Line.
Therefore, it may put the project within state
lease requirements. Two pilings will support the
8' x 8' intake structure. The Shoreline Management
Advisory Commission recommends 3 in favor, and 2
abstaining, to approve the project subject to 8
conditions. The Board reviewed the minutes of the
Shoreline Management Advisory Commission.
A Brinnon resident expressed concern over the size
of mesh on the intake line which might cause
damage to the baby shrimp by taking them in
through the screen.
Aumock reported that the Department of Fisheries
and Ecology have reviewed the application and that the
Fisheries Department has regulated the size of the intake mesh.
Another Brinnon resident complained that the
unloading and loading of shells at all hours inter-
fers with sleep of residents. Mrs. Ward of Brinnon
asked how long the permit is for. Aumock stated that
the project must be completed within five years.
He also stated that if there is a violation the
process to revoke it is for the Planning Department
to make a site inspection and present it to the Board
for review. with the advice of the Prosecuting
Attorney the Board can rescind the permit.
Regarding concern about noise levels the Shoreline
Management Advisory Commission based their recommen-
dation of the Department of Ecology studies on dba
levels. The dba levels are to be measured at the
periphery of the property.
CommissionerBrown stated that loading at daylight
hours could be a condition. The Board discussed
concern about the bright lights at night. Engman
said the lighting could be turned off. Motion
by Commissioner Brown, second by Chairman Mercer
to postpone decision until June l2 to allow time
to put conditions together.

Howard Haakinson reo Barrier on corner at Paradise Bay.
Mr. Haakinson requests the County place a guardrail 75' long at the
corner because of the high number of accidents. He is concerned that a
car might crash into his house. The Board will inspect it before taking
action.
Auditor Betty Anderson submitted a petition for the formation of
a Cemetary District at Quilcene certifying that the l44 registered voters
whose names appear on the petition represents over l5% of the electors
residing within the territory described as school district No. 48.
The Board recessed until Tuesday, June 6 at lO:OO a.m.

The Board reconvened to continue regular business.
Bill Lindeman reo Review of bonding for well *3 distribution
system; Kala Point. Mr. Lindeman and Prosecutor Howard appeared. Lindeman
requests permission to submit a "letter of credit" instead of bonding for
200% of the estimated cost of installation of well *3. Howard feels it would
be satisfactory security. He will draft something to attach to the banks
form.
Planning re: l) SEPA Threshold Determination, Jefferson County Comprehen-
sive Plan. The Board reviewed the environmental check-
list with Planning Director Dave Cunningham. Motion
by Commissioner Brown, second by Chairman Mercer for
Chairman Mercer to sign a declaration of significant
impact and that an Environmental Impact Statement be
prepared.
2) Shoreline Management Substantial Development permit
application of Horace Eveland *9-78. Planner Aumock
reviewed the application and showed slides of the project
to place approximately 600 feet of rock rip-rap along
the Ordinary High Water Line (OHWL), upland grading,
installation of draintile, and upland landfill, and
removal of miscellaneous trees. The Shoreline Management
Advisory Commission recommends approval subject to 7
conditions. Mr. and Mrs. Joe Daniels appeared against
the project. Mr. Eveland and his attorney, Chuck Henry
appeared. They challenged the location of the OHWL
and questioned whether the project would substantially damage
the environment of the area. Henry explained that the
applicant needs a variance in order to make use of
lot 33. There would be no harm to any resource. It
would stop erosion, enhance the shoreline and permit
desirable development. Aumock explained that a variance
requires approval or denial of the Board and the Depart-
ment of Ecology. The Department of Ecology would have
to concur our approval or denial. At that point if
there's an objection to the final outcome, Eveland can
file an appeal to the Shorelines Hearings Board within
30 days. Motion by Commissioner Brown to approve with
the conditions and recommendations of the Shoreline
Management Advisory Commission and that a map of the
OHWL is given to Eveland as designated on the attached
map. Second by Chairman Mercer.
The Board recessed until Wednesday, June 7, 1978.

4) Army Corps Notice 07l-0YB-l-00493l, Hjelvik, Eivind H.
to construct a ramp, drive piling and install float at
Right Smart Cove, for a commercial boat launch.
Planner Tom Aumock reviewed the project and reported it
to be within shoreline jurisdiction and requires
a permit for which Hjelvik has already made application
for. See No. 3 above. Motion by Commissioner BroWn,
second by Chairman Mercer for Chairman Mercer to sign
a notice to the Corps that a permit will be withheld
until a Shoreline Substantial Development Permit
application has been reviewed.
5) SEPA Final Threshold Determinations:
a) Shoreline permit application, Byron Swigard,
Bridgehaven. Project: to put moorage buoy on
water and l2' x l2' anchored float for water-
skiing. Planner Tom Aumock reported that there
has been no response from public agencies. Motion
by Commissioner Brown, second by Chairman Mercer
to approve and sign a final declaration of non-
significance.
b) Building permit, Kenneth Brown for mobil home
court. Planner Tom Aumock reported that there has
been no adverse comment from public agencies.
The Department of Transportation reports that a
state highway access permit is required. Motion
by Commissioner Brown, second by Chairman Mercer
to approve and for Chairman Mercer to sign a
final declaration of non-significance.
6) SEPA Notice of Action, Shoreline permit *9-78,
Horace Eveland. The Board approved the notice for
publication and that it be submitted to the Department
of Ecology.
7) 1977 HUD Flood Report - update of building permits
that were issued within flood zones to maintain
County eligibility in the federal flood insurance
program.
8) Proposed revision of County Subdivision Ordinance.
Motion by Commissioner Brown, second by Chairman
Mercer that the Planning Department prepare a final
copy for signing and formal adoption.
9) Forest Practices Permit Application *FP-02-0l823,
Tony Stroeder to select cut log 8 l/2 acres.
Property is short platted into 4 tracts. Motion
by Commissioner Brown, second by Chairman Mercer
for Chairman Mercer to sign a notice of no objection
to be sent to the Forest Practices Administrator.
Irene Bersagel re: Annual Traffic Safety Plan, Emergency
Medical Services. Irene Bergsagel reported that in order to get
communications equipment funding the County has to turn in a
County Safety Plan to form the funding base for items such as
plectrons and pocket pagers. Motion by Commissioner Brown, second
by Chairman Mercer to approve and for Chairman Mercer to sign the
Annual Traffic Safety Plan.
Prosecuting
Attorney re: l)
Personnel Policy - annual leave. The Board discussed
the computation of annual leave. Prosecutor Howard
will redraft the section of the Personnel Policy
on annual leave based on the employee's anniversary
date.
2)
Septic Tanks and Drain Fields - Alternative Design.
Prosecutor Howard discussed his letter to Randy Durant,
County Health Sanitarian regarding a way of dealing
with alternative systems. The Board felt that it
should be clearly understood that if an alternative
system becomes a health hazard it should no longer
be used.

3) Conveyance of Real Property for Security Purposes -
One Percent Affidavit. Prosecutor Howard submitted
a letter to the Board regarding the necessity for
execution of an affidavit in those instances where
the conveyance is for security purposes and not for
sale. No comment by the Board.
The Board received a letter of resignation as a member of the
Shoreline Management Advisory Commission from W. E. Seton. The Board
advised that the opening for the vacant position should be advertised.
Release of County reservation for right-of-way by Resolution and
Quit Claim Deed, Catherine May Miller. By contract for Treasurer's
Deed dated September 22, 1906, certain real property was purchased
from Jefferson County by J. H. Peterson. This deed included a reserva-
tion of right-of-way for all public highways. Engineer Becker reported
that Jefferson County has no plans for construction of a highway on
said property. Motion by Commissioner Brown, second by Chairman Mercer
to approve and sign Resolution No. 46-78 and to convey by Quit Claim
Deed it's easement for highway purposes over and across real property
as described in Resolution 46-78 to Catherine May Miller, as her
separate estate.
Washington State Liquor Control Board - application for transfer
of .license for Village Store in Quilcene. The Board approved that
Chairman Mercer sign the notice of no objection.
The Board received the Building Department's monthly report
for May, 1978: total permits 36; total fees $4373.60.
