Chairman Brown called the meeting to order at 10:00 a.m.

Approval of Minutes: Commissioner Mercer moved

Drainage Problems, Oak Bay Road: Ken McMillen and Frank
Hart both appeared .to elaborate on intormation contained in letters
from them. Both believe that unstable soil conditions on their prop-
erty and attendant problems are due to a change in drainage patterns
caused by the County road. Milt Sanstrom, Engineer, discussed
possible solutions to the problem which would probably involve inter-
cepting surface water where it comes off the face and channeling it
away in drainage ditches. Mr. Sanstrom, with the approval of the
Board, will contact owners around the slide area to obtain rights of
entry, then make a soils and geologic investigation before making a
definite recommendation regarding solutions.
Contract; Canteen Service Inc.: This agreement for place-
ment of two vending machines in the courthouse was signed by the
Chairman following a motion by Commissioner O'Meara, seconded by
Commissioner Mercer.
CRP #520; Annie Christney Road: By motion of Commissioner
Mercer, seconded by Commissioner O'Meara, Resolution No. 45-82 was
approved and signed. Unanimous.

Contract; Jemco Insulation, Inc.: The Board unanimously

Herbicide Spraying: Alice Lumbard presented her concerns
and a well-documented report on spraying in populated areas, particu-
larly in the Eaglemount area. Also stating opposition were 13 others
who attended the meeting, three who telephoned, and one who sent a
letter. Concerns, requests and responses were as follows:
Forest practices permits for timber companies to spray near populated
areas are in direct contradiction of the citizen-instigated roadway
spraying moratorium instituted in the County three years ago.
The Board of County Commissioners previously waived their rights on
all forest practices permits except those involving land use changes.

The Board agreed that it would be reasonable for spraying permits to
be added to those they are to review and that, upon receipt of the
permit, notification of planned spraying could be published in the
newspaper. However, individual notification would not be feasible
unless the residents themselves set up a network whereby one person
could be notified by the Commissioners and the information would be
passed on.
At the Board's suggestion that concerned individuals take up these
issues with the Forest Practices Board, it was reported that the
Forest Practices Board is still going through revisions and is not
responsive in a timely manner. It was further pointed out that none
of the residents has education background or "expert" certification
qualifying them to present an objection that would have adequate
impact, and that the Commissioners, representing the County, would
have more "clout". The Board agreed to write a letter to the Forest
Practices Board relating the residents' concerns.
Ms. Lumbard and several others requested clarification on the Board's
regulatory authority for public health. The Board responded that the
County does not have the resources to prove any danger to public
health and, therefore, is not in a position to issue a stop-work
order on that basis.
Problems of drift, volatization, and water contamination, and the
lack of monitoring to determine the extent of these problems in this
area, were discussed at length. Commissioner Mercer reported that
Mike Cronin, DNR, stated that the forest practices permits must be
granted, but that all precautions are being taken to protect residents.
The obvious was reiterated that precautions do not, by themselves,
preclude drift, etc. and, without monitoring, there is no way to know
if precautions are effective; that, even with good intentions, an
error is possible or the weather could change the conditions. Com-
missioner O'Meara stated that the Board could probably get water
samples taken from lakes within the spray area that is populated with-
in a couple of days after spraying.
The Board reported that, a couple of years ago when similar concerns
were voiced, the timber companies agreed to a buffer zone
along roads and populated areas. The Board agreed to contact Pope
and Talbot, the company presently scheduling spraying, to see if t:ley
will institute a buffer zone, and they further agreed to transmit
information regarding the location of home sites to the DNR, which
supervises spraying. (Following the meeting, Commissioner Mercer did
call Mike Crortin, DNR, to confirm his cooperation regarding buffer
zones. )
The frustration of the residents was apparent, in that they feel they
are not adequately protected from the dangers of spraying, which have
been documented in other geographic areas, and have little effective
recourse to obtain such protection. However, they are not against
spraying in the vast unpopulated areas of timberland, and ask only
that some action be taken to utilize other methods, possibly more work
intensive, for the comparatively small populated areas.
The meeting was recessed until Tuesday, May 4, 1982, at which
time all members were again present.
County Property Behind Hastings Building: Brent Shirley
and Phil Johnson, who is hoping to open a restaurant/bar in a building
facing this property, appeared before the Board to inquire about the
possibility of the County leasing this parking lot to the City for
5-10 years. The City, if a long-term commitment is made for use,
could then consider improvements to the lot and property owners and
businesses bordering the lot might be agreeable to installing lighting
and other improvements. They were not, at this point, making a
specific proposal but were, instead, asking about the Board's recep-
tivity to such a plan if the City Council and other property owners
agree to undertake the project. The Board indicated that they would
be receptive to such a proposal.

"No Shooting" Areas Around Corrections Centers: John Duffy
and Howard Thronson reported that they have a problem keeping hunters
out of these areas. They feel tl"1~~_presents_il__safety hazard for
resiaeni's---and- corrections center personnel. They pointed out that
neither the Department of Corrections nor the DNR have the authority
to post the property. A map indicating the area they would like to
post was provided. It was clarified that this area would not be
closed to the public, but would only be restricted regarding taking
firearms onto the property. Holding of public hearings preliminary
to acting on an ordinance restricting these areas and permitting post-
ing were discussed, as were possible wording for signs and enforcement~
------------ Public Hearing: Setting'Maximum Jail-Capacity:----Per mot ion-
by Commissioner Mercer, seconded by Commissioner O'Meara, the Chairman
and the Sheriff signed a letter to the State Jail Commission
clarifying the capacities which they feel are necessary for the
current jail and the new facility, and notifying that they will not
attend the hearing.
Interlocal Agreement, Hadlock Launch Ramp Float: The Port
of Port Townsend requested an agreement allowing them to install a
float at the end of the public access to the water at this launch
facility. Commissioner O'Meara moved to approve installation of the
float and Commissioner Mercer seconded. Unanimous. An agreement will
be prepared.
Request for Road Restoration, Hoh River Road: The PUD of
Clallam County is requesting cooperation in the restoration of this
road which was washed out in last winter's flooding. The Engineer
will draft a response.
Dance License, Discovery Bay Tavern: Commissioner Mercer
made the motion, seconded by Commissioner O'Meara and unanimously
approved, to sign this license for May 1, 1982 to May 1, 1983.
Letter of Appreciation, Herbert Covert: With the approval
of the Board, Chairman Brown signed this letter recognizing Mr.
Covert's services on the Shorelines Management Advisory Commission.
The meeting was recessed. On Thursday, May 6, 1982,
Commissioners Brown and 0' Meara returned to conduct business.
Variance Extension; Landfall Restaurant: By instruction
to Randy Durant, Health Department, signed by both Commissioners,
this variance, granted by the Health Board, was extended by three
weeks.
Insurance Exclusion: Homer Smith presented a Personal
Injury From Law Entorcement Department Operations Exclusion which
Chairman Brown signed with Commissioner O'Meara's approval.
Courthouse Elevator Service Repair Proposal/Order: This
order for United States Elevator Corporation to inspect, make repairs
as necessary, and install an intermediate floor access device was
signed by Chairman Brown, approved by Commissioner O'Meara. This was in
compliance with State requirement for a 5-year load inspection.
BUSINESS FROM COUNTY DEPARTMENTS:
Planning re:

Off-Road Vehicle Plan: Rachel Nathanson reported that
State tunds are available for counties to do some work
in producing sites or plans regarding off-road vehicles.
Grants are being administered through the Interagency
Committee for Outdoor Recreation, and 100/0 funding is
available, apparently with no predetermined limitations
on the amount. It was further noted that a public
interest in providing controlled areas for off-road
vehicles has been apparent in inquiries to the Planning
Department. lAC is willing to provide funds for
approved grants for planning and studies, acquisition of

land, development and maintenance or management. Grant
applications must be submitted by June 1, 1982, with
funding becoming available after November, 1982. Com-
missioner Mercer moved to make the grant application.

Public
Works re:
5/4/82
Application to Open Right-of-Way: This application by
Anthony Stroeder regarding Rhododendron Avenue was
reviewed by Gary Rowe. It was agreed that the avenue
should be brought up to County standards by Stroeder
before the County takes it over, and it was further
decided that the application should be revised to the
middle of the right-of-way. The Board also agreed that
the park area platted down the middle of the road would
not be necessary.
Application to Open Right-of-Way: Lawrence Brulotte
submitted this application to open the platted right-
of-way on Lot 5 of Olson & Hambleton's Addition.
Following discussion with Gary Rowe, Commissioner
O'Meara made a motion for the Chairman to sign approval
of this application and Commissioner Mercer seconded
the motion. Unanimous.
Application to Open Right-of-Way: Anthony Stroeder's
application to open a street in the Eisenbeis Addition,
off Highway 20, was referred to the Planning Department
for a recommendation.
Monitary Responsiblity for Survey Work at FPD Coyle
Property: The Board read the letter from Fire Protection
District #2 refusing to pay this bill. Following dis-
cussion with Mr. Rowe, it was determined that Commissioner
Mercer will discuss the matter with the FPD Board.
Computer Terminal; Public Works Office: A remote term-
inal, which would increase availability of the Central
Services computer to the Department for inputting
vouchers and, later, in bookkeeping, was requested.
The Board will discuss the matter with John Achey.
Commercial Road Approaches: Mr. Rowe reported that he
has inspected those approaches which are onto major
arterials. Most are adequate, but a few are unsafe
and it is his intention to contact the owners about
making improvements, which the Board approved. He
asked for clarification about whether the County will
share any of the expense involved.
Proposed Vacation of Old Dabob Road: Milt Sanstrom
recommended against approving either the petition to
vacate a portion of the road presented by Mr. Iglitzen
or the intent to vacate initiated by the County. The
Commissioners decided against acting to vacate the
portion of the road specified in their intent to vacate,
and by motion of Commissioner Mercer, seconded by
Commissioner O'Meara, Mr. Iglitzen's petition was
denied. Unanimous.
Treasurer re:

Solid Waste Funds: Fran Hansen asked for, and received,
claritication on tunds to be distributed to the solid
waste account.
Petition for Property Tax Refund: This petition from
Delma House was approved tor a refund of $54.85 by
motion of Commissioner O'Meara, seconded by Commissioner
Mercer. Unanimous.
