In the Matter of the Establishment of a
"No Shooting" Zone in Irondale to be
known as the Chimacum Creek No Shooting Zone

} ORDINANCE NO. 11-1208-08
}
WHEREAS, on July 27,1995 Ordinance No. 03-0227-95 was adopted by
Jefferson County which allows residents of specific, defined areas in the County to
petition the Board of County Commissioners ("the Board") to establish a "No Shooting"
zone, and;
WHEREAS, under the Health and Safety provisions of Jefferson County Code
Section 8.50, the establishment procedures and boundary descriptions for "No Shooting"
zones are codified, and;
WHEREAS, on March 26,2007, a petition was received from residents of the
Irondale area located in voting Precinct #305 which was found to be sufficient, upon
review by the County Auditor, for the purposes of considering the establishment of a "No
Shooting" zone by this ordinance, and;
WHEREAS, on April 16, 2007, Ordinance No. 02-0416-07 was adopted by
Jefferson County which specifies the process for the establishment of new "No Shooting"
areas in specifically described unincorporated areas of Jefferson County, and;
WHEREAS, on June 11,2007, the Board held a duly advertised public interview
process, following which it appointed three "members at large" to an advisory Review
Committee to research and make recommendations to the Board on "No Shooting" zone
petitions, and;
WHEREAS, the Board makes the following Findings of Fact with respect to this
particular petition and review process:
I. The Review Committee appointed by the Board conducted public meetings on the
following dates: June 19,2008; July 10,2008; August 12,2008; and September
9,2008, to research and review the Chimacum Creek "No Shooting" zone petition.

These meeting included public comment periods with meeting minutes prepared
and posted on the Jefferson County web page.
2. Additionally, the committee conducted a field trip to examine the proposed area of
the petition on August 12,2008.
3. On September 9.2008 the Review Committee recommended to the Board that the
Board approve the Chimacum Creek petition as submitted through the citizen
petition. The motion of the committee passed 5-1 with no abstentions. The
committee included findings of fact stating there is a high density of current and
existing residential and commercial uses in the area and this density makes the
subject area incompatibible with shooting of firearms.
4. On November 10,2008, the Board approved a legal notice announcing a public
hearing to be conducted on November 24, 2008 in the Jefferson County Superior
Courtroom.
5. On November 24, 2008, the Board held the public hearing on the Review
Committee's recommendation regarding the Chimacum Creek "No Shooting"
zone petition boundary. Oral and written testimony was received by the Board.
6. Upon conclusion of the public hearing the Board reviewed the record, deliberated
and voted 3-0 to accept the Review Committee recommendation to establish the
Chimacum Creek "No Shooting" zone boundary.
7. The creation of the Chimacum Creek "No Shooting" zone has been completed in a
manner consistent with Ordinance #03-0227-95 as amended and replaced by
Ordinance #02-0416-07.
NOW, THEREFORE, BE IT ORDAINED as follows:
Section One: The following language shall be added to the Jefferson County Code at
Chapter 8.50 JCC:
Chimacum Creek: The area described below is hereby established as a
no shooting area as provided in Article I of this chapter.

8.50.180 All of the following described lands, being a portion of Sections 34 and 35,
Township 30 North, Range I West, W.M. and Sections 2 and 3, Township 29 North, Range I
West, W.M. lying within the follow bounds:
Beginning at the intersection of centerline of as built Prospect A venue extended Easterly to the
westerly shoreline of Port Townsend Bay said point being the True Point of Beginning of this
description;
Thence Westerly along the centerline of as-built Prospect A venue to the intersection of said road
with the centerline of State Route 19, also known as Airport-Cutoff Road;
Thence Southeasterly along the centerline of said State Route 19 to the intersection with the
centerline of lrondale Road;
Thence Easterly along the centerline ofIrondale Road to the intersection with the centerline of
platted Market Street as said road is platted in the plat of Harrisburg recorded in Volume 1 Page
16 records of Jefferson County, Washington;
Thence Easterly along said centerline of Market Street to the centerline of Maple Street as
platted on said plat;
Thence continuing Easterly along the centerline of platted Market Street lying North of Block 40
and Reserve A, as platted in the plat ofIrondale, recorded in Volume 3 Page 5 records Jefferson
County, Washington and the extension of said Market Street to the Westerly shoreline of Port
Townsend Bay;
Thence Northerly and Westerly, upland of the 0.0 low tide mark, within Port Townsend Bay to
the True Point of Beginning.
All lying and being in Jefferson County, Washington.
Section Two: The following map is hereby made part of the Jefferson County Code
at Chapter 8.50. See: Attachment A - Chimacum Creek No Shooting Zone Map
Section Thee: Should there be any discrepancy or disagreement between the metes
and bounds description found in Section One above and the boundary of the Chimacum
Creek No Shooting Zone as reflected on the map made Attachment A to this Ordinance,
then the text of the metes and bounds description shall be deemed controlling.
Section Four: This Ordinance shall take effect immediately.

Chimacum Creek No Shooting Area
STATEMENT OF ISSUE: A citizen petition to establish a No Shooting Area in Irondale near Chimacum
Creek was received by Jefferson County on March 26, 2007. The petition was forwarded by the BOCC to
the No Shooting Zone Review Committee to engage the public and formalize a recommendation. The
Review Committee conducted public meetings and a field inspection. The committee recommended
approval ofthe original petition boundary to the BOCC. The BOCC conducted a public hearing on
November 24, 2008 and subsequently by motion ofthe BOCC approved the petition. This ordinance
memorializes the legislative action of the BOCC.
ANALYSIS/STRATEGIC GOALS: Consistent with Jefferson County code provisions for receiving
petitions and processing to a decision point.
FISCAL IMPACT: Staffing for processing this petition was accomplished through the long range planning
division of the Department of Community Development. Adoption of this petition may increase the number
of complaint calls to the Sheritr s department.
RECOMMENDATION:
The department recommends signing this ordinance as it reflects the November 24, 2008 decision of the
BOCC.
