So I thought it best to go directly to the source, which I believe is you! My parents purchased a waterfront property in the Cape George Colony (on Discovery Bay) in 1971 when they were teachers in Quilcene. To this day, the property has remained unbuilt, but it's always been my parents intent to build the retirement home of their dreams one day. In fact, I believe it is one of the only unbuilt bay front lots in Cape George Colony. The lot is approximately 8,000 sq. ft. and is roughly 100x80'. Houses were built on the adjacent lots many years ago, and the Colony itself has several hundred residences in high density configuration (i.e. most all the lots are < 10,000 sq. ft.) My questions: 1. Should we be worried that this parcel has suddenly become unbuildable because of SMP? No, we've taken great care to balance shoreline protection and private property rights. The law does not allow us to 'take' property via regulatory limitations. Take a look at the Preliminarv Draft SMP proposal online: See Article 6 to learn about the standard buffer on marine shorelines (150' + 10' building setbackL opportunities for Buffer Reduction (up to 25% administratively, or more via a Shoreline Variance), Buffer Averaging, Alternative Protections (via stewardship plansL and the Non-Conforming Lots provisions to allow development on 'shallow' lots w/o a Variance. Also see Article 8 for the Residential development policies and regulation that could apply to your parents' dream home if adopted as written, and Article 9 about Non-conforming development and other permitting issues. (we're getting a blizzard ofletters from local Realtors suggesting as much.) We've had many calls from others who've received such mailings but we've not seen the letters/postcards ourselves. From what we've heard, they are not completely accurate. If you're willing, we'd appreciate getting a copy of what you received as it will help us better inform landowners and interested citizens. 2. At this juncture, is there some deadline when development suddenly becomes more difficult under the new SMP guidelines? The new SMP is anticipated to take effect sometime in 2010. See the review process timeline diagram online. Once we submit to the State, there's no way to tell how long it will take. If so, is 2 there a 'grandfathered' opportunity for building permits submitted before this date certain? Yes, some land use and building permits may be vested based on date of complete application. Learn more from our Development Review Division permitting portal online or by calling 360/379-4450. 3. In reading some of the online literature, it appears there are exemptions granted for 'small lots' and for 'single family residences,' but it's not clear to me exactly what this exemption covers and what it does not. Could you elaborate a bit on this? See Article 9 for Exemptions, including Single Family Residences (SFR). Please note, this section only means the activities described are exempt from obtaining a Shoreline Substantial Development Permit, but would need to get an Exemption Approval. The Non-conforming lots provisions are not exemptions, but an administrative option that allows SFR development w/o getting a Shoreline Variance by meeting all the criteria established.
