No magic bullet there. We've worked hard to balance shoreline protection and private property rights and provide many 'flex points' in the proposed SMP to accommodate the variety of on-the-ground situations we know are out there in the County. Take a look at Section 6 of Article 10 - Non-conforming Development starting on Page 10-6 of the PDSMP. If someone's existing home becomes non-conforming as per the new SMP (i.e. 150' buffer), and then is damaged by fire, flood etc, they can rebuild as described depending on the degree of damage (75% threshold). Some expansion of the footprint may even be allowed w/o a Conditional Use Permit or Shoreline Variance, as per the criteria listed. Also, we've had many calls from landowners who've received a mailing from your WAVES real estate business. There seems to be confusion on several points about the SMP Update project (effective date, buffers, etc). It would help us better answer the public's questions if we understood the information you've provided to them. May we please have a copy of any materials you've provided to your clients and other landowners regarding the SMP Update?
