We disagree with the Iifiting of the two acre floating aquaculture limitation. We disagree with the lifting of the prohibition on overwater aquaculture product processing. Waste organic material, such as mussel beards, has proven to be a problem. In areas where large operations are in place, material has beached and decomposed, thus creating an environmental problem. We disagree with the permitting of land based bouylvessel retrieval systems. They represent a potential danger to navigation of small boats and a threat to protected marine mammals due to entanglement. Anecdotally, we have personally observed an incident in Oak Bay in which a gray whale appeared to strike an underwater line running from the beach to a bouy about 100 feet offshore. The whale was about 75 feet offshore. Its initial reaction was one of violent fright. It sounded immediately and disappeared from the area in which it had been feeding. We have not observed a gray whale in the area since that incident. We maintain that current owners of properties developed over time under any and all present and previously existing permitting procedures, acts, codes, plans and rules should be allowed to retain all rights to those uses including the rights to enjoy, maintain, update and repair all past and current uses and aspects of their property dating from time of purchase.
