Marlow called the meeting to order at 10:30 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. DETERMINATIONS Marc Mauney & Lynne Rogerson 2133 Oak Ray Road Port Hadlock, W A 98339 BOE: 07-35-R PN: 921182012 After considering all the information submitted by both parties, the Board concurred that the Assessor's valuation represents fair market value of this parcel. While the appellant contends that there should be a reduction given for the "stigma" associated with this property being located in a geological land slide hazard area, there was no market evidence presented specifically on that issue. Furthermore, since the house was constructed based on the recommendations from a geological study, the Board finds no reduction for this issue is warranted. Vice-Chairman Broders moved to sustain the Assessor's valuation of $1,036, 740 ($609,940 for the land and $426,800 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. The sales of comparable properties indicate the value of this parcel is fair and equitable. The Assessor's office has given a 10% reduction in the land value for the lack of view and steepness ofthe driveway. Without specific evidence showing these issues have a further negative impact on the market value of this parcel, the Board feels that the adjustment adequately addresses those issues and finds the amount of reduction is reasonable and fair. Box 521 Chimacum, W A 98325 BOE: 07-38-R PN: 990603 111 After considering all the information submitted by both parties, the Board concurred to reduce the improvement value by 15% for economic obsolescence due to the condition, size and age of the house. The land value will remain unchanged. Vice-Chairman Broders moved to overrule the Assessor's valuation of the improvements only and reduce it from $212,660 to $180,760 for a new total property valuation of$275,760. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of September 26, 2007) Richard & Sylvia Timmerman 173 Lagoon Lane Port Ludlow, W A 98365 BOE: 07-39-R PN: 968700104 The Board considered all the information submitted by both parties. It was agreed that the usable land area of this parcel is limited, however, other nearby parcels that are situated in front of the salt marsh are also limited in use. Even though a portion of the property is restricted, it does add value, and that value is found to be reasonable and fair. Vice-Chairman Broders moved to sustain the Assessor's valuation of $747,960 ($432,500 for the land and $315,460 for the improvements). Bay Way Port Ludlow, W A 98365 BOE: 07-40-R PN: 976800010 The Board considered all the information submitted by both parties. It was noted that the Assessor's staff has already reduced the value of the back lots by 80% due to the septic system restraining the use of the property. The Board agreed that the percentage of reduction is adequate and that the current valuation is fair based on their necessary usage as area for the septic systemldrainfield. Vice-Chairman Broders moved to sustain the Assessor's valuation of$52l,745 ($364,800 for the land and $156,945 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of September 27,2007) Board of Equalization Minutes - October 17, 2007 Page: 3 Shirley Spencer & Johanna Wiseman 62 Laurel Street Port Hadlock, W A 98339 BOE: 07-43-R PN: 921063007 The Board considered all the information submitted by both parties. The residential appraisal report submitted by the appellants as evidence does not appear to represent fair market value of the property as its purpose was for refinancing. In addition, the appellants' purchase of the property in 2005 for $1,075,000 and the sales of comparable properties, support the current assessed value. Vice-Chairman Broder moved to sustain the Assessor's valuation of$I,069,840 (S517,415 for the land and $552,425 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales of comparable properties, it was agreed that the current assessment represents fair market value of parcel #721 093 024. Vice-Chairman Broders moved to sustain the Assessor's valuation ofS293,2l5 ($73,380 for the land and $219,835 for the improvements) for parcel #721 093 024. Chairman Marlow seconded the motion. The motion carried. (See also minutes of September 26, 2007) With regard to parcel #935 100 009, it was agreed that due to the fact that this parcel is located in a land slide hazard area, a reduction in the land value is warranted. The improvement value will remain unchanged. Vice-Chairman Broders moved to overrule the Assessor's valuation of parcel #935 100009 and reduce only the land value from $130,000 to $115,000 for a new total property valuation of $476,405. Chairman Marlow seconded the motion. The motion carried. (See also minutes of September 26, 2007) Wilfred & Dolores Schmidt 62 Shine Road Port Ludlow, W A 98365 BOE: 07-53-R PN: 994400104 The Board considered all the information submitted by both parties. Due to the poor workmanship and current unfinished condition of the house, the Board feels a further reduction of 5% off the improvement value for economic obsolescence is warranted. The land value will remain unchanged. Board of Equalization Minutes - October 17, 2007 Pa~e:4 Vice-Chairman Broders moved to overrule the Assessor's valuation of the improvements only and reduce it from $219,665 to $208,680 for a new total property valuation of $290,680. (See also minutes of September 26, 2007) Robert Schladetzky 2982 Beaver Valley Road Port Ludlow, WA 98365 BOE: 07-57-R 07-58-R PN: 901142043 821 073 001 After considering all the information submitted by both parties, the Board agreed that the base land of parcel #901 142043 should be reduced by 30% to reflect the limitations on this property caused by its proximity to Chimacum Creek. The improvement value will remain unchanged. Vice-Chairman Broders moved to overrule the Assessor's valuation of parcel #901 142043 and reduce only the land value from $50,000 to $45,000 for a new total valuation of $69,91 O. Chairman Marlow seconded the motion. The motion carried. (See also minutes of September 27,2007) With regard to parcel #821 073001 the Board agreed that the current valuation represents fair market value of this parcel. The appellant did not present sufficient evidence to warrant a reduction in value. Vice-Chairman Broders moved to sustain the Assessor's valuation of$578,170 ($170,540 for the land and $407,630 for the improvements) for parcel #821 073 00 I. Chairman Marlow seconded the motion. The motion carried. The land value will remain unchanged. Vice-Chairman Broders moved to overrule the Assessor's valuation of the improvements and reduce it from $216,000 to $194,400 for a new total valuation of$319,400. Chairman Marlow seconded the motion. Based on sales of comparable property, the Board agreed the current value is fair and equitable. (See also minutes of September 27, 2007) Arthur & Virginia Moyer 72 Harms Lane Port Ludlow, W A 98365 BOE: 07-89-R PN: 990603164 After considering all the information submitted by both parties, the Board concurred that the Assessor's valuation represents fair market value of this parcel and is supported by sales of comparable property. One issue presented by the appellant was that a depreciation factor of 9 years should have been applied to the valuation rather than a factor of 4 years. At the hearing it was explained by the Assessor's representative that the 4 year factor is actually "effective age", not "chronological age". Vice-Chairman Broders moved to sustain the Assessor's valuation of$487,765 ($160,000 for the land and 5327,765 for the improvements). Chairman Marlow seconded the motion. The motion carried. Based on sales of comparable property, the Board agreed that the current assessed value is fair and equitable. Vice-Chairman Broders moved to sustain the Assessor's valuation of 5 199,840 ($60,000 for the land and $139,840 for the improvements). Chairman Marlow seconded the motion. The motion carried.
