Broders James A. DeLeo Chairman Vice-Chairman Member Chairman William S. Marlow called the meeting to order at 10:00 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. DETERMINATIONS Kenneth L. Schneider Family Rev. Trust 181 Pioneer Drive Port Ludlow, W A 98365 BOE: 07-45-R PN: 990 600 389 After considering all the information submitted by both parties, the Board concurred that the Assessor's valuation represents the fair market value of this parcel. The issue of poor upkeep and maintenance of nearby properties can certainly affect market value. However, the Board found there was insufficient evidence to prove the issue negatively impacts the market value of this parcel to such a degree that would warrant a reduction in value. The Board further finds that comparable sales data supports the Assessor's valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of 5297,695 ($95,000 for the land and 5202,695 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 15,2007) Miles & M. The appellant did not present sufficient evidence to warrant a reduction in the value. Vice-Chairman Broders moved to sustain the Assessor's valuation of $470,545 ($140,000 for the land and $330,545 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. While the comparable sales presented by the Assessor's representative were good examples of the general market activity, the appellant's argument for a reduction due to easements and view restrictions was compelling and supported by evidence. Therefore, a reduction of 10% off the base land value is given. Vice-Chairman Broders moved to overrule the Assessor's valuation of the land value only and reduce it from $210,000 to $190,000. The improvement value of$327,005 remains unchanged. The new total property valuation is $517,005. Member DeLeo seconded the motion which carried by a unanimous vote. Based on sales of comparable properties, the current assessment represents fair market value of this parcel. Vice-Chairman Broders moved to sustain the Assessor's valuation of$262,385 ($95,000 for the land and $167,385 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. Without supporting evidence showing the negative impact the issue ofthe neighbor's helicopter use has on the value of the property, the Board is compelled to uphold the Assessor's valuation. Vice-Chairman Broders moved to sustain the Assessor's valuation of$688,390 ($462,190 for the land and $226,200 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 15,2007) Timothy & Dianne Jane Johnson 365 Camber Lane Port Ludlow, W A 98365 BOE: 07-68-R PN: 969700018 After considering all the information submitted by both parties, the Board concurred that the current assessment represents the fair market value of this parcel based on comparable sales data. The method of valuation based on square footage presented by the appellant was somewhat compelling, but was not sufficiently convincing to overrule the current valuation. Board of Equalization Minutes - October 24, 2007 Pa~e: 3 Vice-Chairman Broders moved to sustain the Assessor's valuation of$380,020 ($140,000 for the land and $240,020 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 18,2007) Ross Budden 1218 West Dravus Street Seattle, W A 98119 BOE: 07-69-R PN: 976500005 After considering all the information submitted by both parties, the Board concurred that the current assessment represents the fair market value ofthis parcel. The issue of junk on the neighboring parcel and the quality of the house can affect market value, however, no market evidence was provided to show to what extent these issues may negatively impact the market value of this property. If placed for sale on the open market, the appellant could sell this property at the current assessed value. Vice-Chairman Broders moved to sustain the Assessor's valuation of$345,695 ($254,820 for the land and $90,875 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of October 15, 2007) Mats Mats Bay Trust Nancy Zingheirn, Stephen Walsh, Trustee 6281 Oak Bay Road Port Ludlow, W A 98365 BOE: 07-71-R PN: 921324014 After considering all the information submitted by both parties, the Board concurred that a reduction in value is necessary due to the issues with streams, wetlands and associated buffer zones. The building site for this parcel is considerably farther from the water than the building site on a nearby parcel, that otherwise, is a reasonably comparable property. The appellant's purchase price of$140,000 in 1994 was not compelling evidence because there were few or no environmental restrictions at that time which would affect the usability ofthe property. In this case the reduction already given for site quality should be changed from -15% to -30%. Vice-Chairman Broders moved to overrule the Assessor's valuation of the land value only and reduce it from $352,025 to $274,192. The improvement value of$87,250 remains unchanged. The new total property valuation is $361,442. Member DeLeo seconded the motion which carried by a unanimous vote. Box 201 Nordland, W A 98358 BOE: 07-74-R PN: 021212 001 After considering all the information submitted by both parties, the Board concurred that the current assessment reflects fair market value of the property. The sale prices of two (2) somewhat comparable properties also support the Assessor's valuation. The fee appraisal submitted by the Appellant was found not reflective of the current market value. Vice-Chairman Broders moved to sustain the Assessor's valuation $1,053,480 ($826,750 for the land and $226,730 for the improvements). Chairman Marlow seconded the motion. The motion carried. (See also minutes of October 18,2007) James & Joan Edwards 235 Mats View Terrace Port Ludlow, W A 98365 BOE: 07-78-R PN: 970900011 After considering all the information submitted by both parties, the Board concurred that the current assessment reflects fair market value of the property based on sales of comparable properties. The issue of the adj acent manufactured home may affect the values of neighboring properties, however, sufficient evidence was not provided to show to what extent it negatively affects the market value. Vice-Chairman Broders moved to sustain the Assessor's valuation of$656,950 ($210,000 for the land and $446,950 for the improvements). Chairman Marlow seconded the motion. The motion carried. (See also minutes of October 18, 2007) Dale & Lisa Wilde 419 North Bayview Drive Port Ludlow, W A 98365 BOE: 07-80-R PN: 921332032 After considering all the information submitted by both parties, the Board concurred that the current assessment reflects the fair market value of the property. Because this parcel has been developed, the restrictions caused by the Eagle Management Plan do not drastically affect the usability of this parcel. The reductions already being applied to the land value by the Assessor's office are fair and reasonable. Vice-Chairman Broders moved to sustain the Assessor's valuation of$I,788,585 ($817,075 for the land and $971,510 for the improvements). Chairman Marlow seconded the motion. The motion carried. Heid 80 Burns Road Port Ludlow, W A 98365 BOE: 07-90-LO PN: 921194010 After considering all the information submitted by both parties, the Board concurred that because this property is unbuildable, the Assessor's current adjustment of -75% for depth and utility should be applied to the entire front footage, not just the first 100'. The $10,000 site reduction should also be removed. Vice-Chairman Broders moved to overrule the Assessor's valuation $204,500 (bare land) and reduce it to $144,750. Chairman Marlow seconded the motion. The motion carried.
