After considering all the information submitted by both parties, the Board concurred that the Assessor's
valuation represents the fair market value of this parcel. The issue of poor upkeep and maintenance of
nearby properties can certainly affect market value. However, the Board found there was insufficient
evidence to prove the issue negatively impacts the market value of this parcel to such a degree that would
warrant a reduction in value. The Board further finds that comparable sales data supports the Assessor's
valuation.
Vice-Chairman Broders moved to sustain the Assessor's valuation of 5297,695 ($95,000 for the land and
5202,695 for the improvements). Member DeLeo seconded the motion which carried by a unanimous

The Board considered all the information presented by both parties. While the comparable sales presented
by the Assessor's representative were good examples of the general market activity, the appellant's
argument for a reduction due to easements and view restrictions was compelling and supported by
evidence. Therefore, a reduction of 10% off the base land value is given.
Vice-Chairman Broders moved to overrule the Assessor's valuation of the land value only and reduce it
from $210,000 to $190,000. The improvement value of$327,005 remains unchanged. The new total
property valuation is $517,005. Member DeLeo seconded the motion which carried by a unanimous vote.

assessment represents the fair market value ofthis parcel. The issue of junk on the neighboring parcel and
the quality of the house can affect market value, however, no market evidence was provided to show to
what extent these issues may negatively impact the market value of this property. If placed for sale on the
open market, the appellant could sell this property at the current assessed value.

$90,875 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote.

After considering all the information submitted by both parties, the Board concurred that a reduction in
value is necessary due to the issues with streams, wetlands and associated buffer zones. The building site
for this parcel is considerably farther from the water than the building site on a nearby parcel, that
otherwise, is a reasonably comparable property. The appellant's purchase price of$140,000 in 1994 was
not compelling evidence because there were few or no environmental restrictions at that time which would
affect the usability ofthe property. In this case the reduction already given for site quality should be
changed from -15% to -30%.
Vice-Chairman Broders moved to overrule the Assessor's valuation of the land value only and reduce it
from $352,025 to $274,192. The improvement value of$87,250 remains unchanged. The new total
property valuation is $361,442. Member DeLeo seconded the motion which carried by a unanimous vote.

The reductions already being applied to the land value by the Assessor's office are fair and reasonable.
