Broders James A. DeLeo Chairman Vice-Chairman Member Chairman William S. Marlow called the meeting to order at 9:30 a.m. in the presence of Vice-Chairman Richard A. Broders and Member James A. DeLeo. ASSESSMENT CORRECTION Vice-Chairman Broders moved to accept the following assessment correction. Member DeLeo seconded the motion which carried by a unanimous vote. APPELLANT Charles & Stephanie Batchelder APPEAL NO. BOE 07-136-R PARCEL NO. 801 322022 DETERMINATIONS Henry & Margaret Nelson Nelson Living Trust 1228 E. Ludlow Ridge Road Port Ludlow, W A 98365 BOE: 07-115-R PN: 821104009 The Board considered the testimony and information presented by both parties. Based on comparable property sales presented by the Assessor, the Board finds that this parcel is correctly valued. Four comparable sales were presented by the appellant, however, 3 of the 4 sales were over 4 years old, and the other was a 2005 house and land sale. The Board found the Assessor's comparable sales were more current and more accurately reflect the market value as of January 1,2007. The appellant felt that the Assessor should value property conservatively. State law requires the Assessor to value all property at 100% of fair market value. It is also noted that during the hearing the appellant pointed out an error on the Assessor's valuation sheet related to the type and size of bathrooms, however, the Assessor's representative stated a change can be made, but, it would not affect the assessed value. Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of November 19, 2007) Nancy O'Neill 71 Olympic Lane Port Ludlow, W A 98365 BOE: 07-220-R PN: 990400431 The Board considered the testimony and information presented by both parties. Based on sale of comparable property and the appellant's purchase price for this property, the Board finds that the valuation of this parcel is fair and equitable. The appellant's contention that they overpaid for the property was not sufficiently substantiated by evidence. The appellant also expressed concern about the fact that the Assessor's records show a "second floor", when in actuality it is a loft. It is noted that any difference in value for this issue is negated by the fact that the Assessor's representative did not value the deck and hot tub which currently exists on the property. Vice-Chairman Broders moved to sustain the Assessor's valuation of$380,645 ($65,000 for the land and $315,645 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of November 19,2007) John & Lori Carthum, Trust 694 Bywater Way Port Luldow, W A 98365 BOE: 07-209-R PN: 821355030 The Board considered the testimony and information presented by both parties. Based on sales of comparable property, the Board finds that the valuation of this parcel is fair and equitable. A comparable sale presented by the appellants was from June 2002 and is found to be too dated to be used to establish fair market value. Vice-Chairman Broders moved to sustain the Assessor's valuation of $507,550 ($159,300 for the land and $348,250 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of November 19,2007) Barbara J. Globus 11 0 West Ludlow Point Road Port Ludlow, W A 98365 BOE: 07-99-R PN: 969400021 The Board considered the testimony and information presented by both parties. Based on sales of comparable property, the Board finds that the valuation of this parcel is fair and equitable. An appraisal was presented by the appellant for this parcel, however, it was found to represent less than fair market value. Board of Equalization Minutes - November 26, 2007 Paj(e:3 Vice-Chairman Broders moved to sustain the Assessor's valuation of $994,450 ($612,060 for the land and $382,390 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of November 19,2007) John & Susan E. Chamberlain 160 - 24'h Avenue San Francisco, CA 94121 BOE: 07-188-R PN: 990 300 129 The Board considered the testimony and information presented by both parties. Based on sales of comparable property, the Board finds that the valuation of this parcel is fair and equitable. The information on sales presented by the Assessor's office show that similar units (non-upgraded, equal views) sell for approximately the assessed value of this unit. Vice-Chairman Broders moved to sustain the Assessor's valuation of$255,000 ($130,000 for the land and $125,000 for the improvements). Member DeLeo seconded the motion which carried by a unanimous vote. (See also minutes of November 19, 2007) Member DeLeo moved to adjourn the meeting until 9:30 a.m. Monday, December 10,2007.
