Ridgley' RE: SHoreline Master Plan Hi Del & Dianne, Thanks for asking - we've received a lot of passionate public comment based on that rumor! Most folks are happy to learn the answer is no, that rumor is false. Take a look at Section 6 of Article 10 of the Preliminary Draft SMP (PDSMP), especially on page 10-6 that reads: 4. is damaged to an extent of the original development, it may be reconstructed to those configurations existing immediately prior to the time the development was damaged, provided that the applicant makes a good faith effort to apply for the permits necessary to restore the development within six (6) months of the date the damage occurred, and complete the restoration within two (2) years of permit issuance. B. If a non-conformin development is damaged by fire, explosion, flood, or other casualty to an extent of the original development, it must be reconstructed in a location and manner that complies with the Program. A single family residential development shall be able to redevelop in kind if there is no ability to redevelop in a manner that conforms to the Program. [emphasis added] Any legally existing home or other type of structure located closer than the proposed buffer (100' on lakes, 150' on rivers & marine shorelines) would be considered 'non-conforming' if the PDSMP was adopted as proposed. As you can see above, there is a special consideration for single family residential that is not afforded to commercial, industrial and other types of development. We are working to develop more informational materials, but with over 400 public comments it will take some time to prepare a Frequently Asked Questions (FAQ) document. There is a rumor going around that if this plan is approved, people whose homes are less than 150 feet from the shore would not be allowed to rebuild them if they were destroyed by fire, etc. Is this true?
