Sorry for the delay in my response - things are moving fast & furious here. Based on what you describe, the
road wouldn't be cause to not meet the provision as written but there may be other factors to consider such as
applying the Common Line Setback (PDSMP Page 16-18), Buffer Reduction/Averaging (PDSMP Page 6-5), Critical
Areas Stewardship Plan (PDSMP Page 6-6), applying setbacks identified by a subdivision plat, and/or the
Shoreline Variance (PDSMP Page 9-7).
This proposed code revision is written with much more flexibility than the existing code with the intent of
accommodating unique situations and still meeting the goals of shoreline protection, water-oriented
development and public access.

Thanks for the info. In our case, our home sits about 30' from the OHWM and our property is about 500' deep,
bisected by Old Gardiner Road. If more than 75% destruction it appears that we would be forced to rebuild on the
other side of Old Gardiner, which is the only way we could meet the 160' setback. Am I correct?

Hi Bill,
That rumor seems to have a lot of energy behind it, has generated a lot of angst among property
owners... and is false. Please see Section 6 Non-conforming Development of Article 10 that reads:

development, it may be reconstructed to those configurations existing
immediately prior to the time the development was damaged, provided that the
applicant makes a good faith effort to apply for the permits necessary to restore
the development within six (6) months of the date the damage occurred, and
complete the restoration within two (2) years of permit issuance.
B. If a non-conforming development is dama ed
casualty to an extent e~e~e~ing~e~ of
the original development, it must be reconstructed in a location and manner that
complies with the Program. A single family residential development shall be able
to redevelop in kind if there is no ability to redevelop in a manner that conforms
to the Program. [emphasis added]
Any legally existing home or other type of structure located closer than the proposed buffer (100' on
lakes, 150' on rivers & marine shorelines) would be considered 'non-conforming' if the PDSMP was
adopted as proposed. As you can see above, there is a special consideration for single family residential
that is not afforded to commercial, industrial and other types of development.
We are working to develop more informational materials, but with over 400 public comments it will take
some time to prepare a Frequently Asked Questions (FAQ) document.

Thank you for continuing to keep us in the loop. The one thing I cannot find is, I am told, a provision that if
your residence is currently closer to marine than 160' and your home burns down that you cannot rebuild.
Can you help me find something about this? Thanks for your help.
