The SMP would not be effe9tive until the BOCC adopts the DOE approved version by ordinance. See the chart

Per Table 18.22.270(1) Type US" streams (shoreline streams) have a 150 foot buffer. IF the CAO applied to
the shoreline areas (which it doesn't), we would look to Table 18.22.270(2), Areas with Which Federally
Listed Species Have a Primary Association. Salmon and other threatened and endangered species live in our
marine waters.
Table 18.22.270(2): Buffers for Other FWHCAs
FWHCA Type Buffer Requirement
Areas with Which Federally Listed Buffers shall be 150 feet; provided, that local and site specific
Species Have a Primary Association factors shall be taken into consideration and the buffer width based
on the best available information concerning the species/habitat(s) in
question and/or the opinions and recommendations of a qualified
professional with appropriate expertise.

Stacie,
When does the SMP update become final and applicable; upon DOE approval subject to 90.58.090 or by
County ordinance after DOE approval? Also, at the last PC meeting I believe you said all shorelines were
considered critical areas as adopted in the CAO. My understanding is that shoreline streams and specific areas
of the marine shoreline designated as FWHCAs (kelp and eel grass, shellfish beds, sand lance, herring, surf
smelt spawning areas, etc.) have 150' buffers, but not the entire shoreline. Did I misunderstand you, or am I
misinterpreting the code?
