Beau,
No SMP Update-related change that will affect current permitting are anticipated to occur in June 2009. The Planning
Commission has a June 30 due date but the new SMP won't take effect 'til mid-late-2010. A SPAAD must be issued prior
to new code takes effect in order to vest to the old code.
There was quite a rumor circulated (private party mailing to landowners) that the new rules take effect this June. That is
incorrect.

Hi, Michelle.
This is an excerpt from an email that our client received. Your voicemail yesterday said that as long as a SPAAD was
issued prior to the effective date of the revised SMP it would vest under the existing SMP. As you mentioned on a couple
of occasions, the revised SMP won't be effective until the middle of 2010 (at least). Therefore, it seems that one has until
the middle of next year (2010) to get a SPAAD approved that vests under the existing SMP. This understanding
contradicts that of the excerpt below which says it needs to be obtained by June 2009. Could you please confirm that the
position stated below is incorrect?
