HomeMy WebLinkAbout033 09 CC" All LXp-to 51d-'7{o~ STATE OF WASHINGTON County of Jefferson In the Matter of Amending the } Jefferson County Personnel } Administration Manual, Chapter 6 } Section 4.0 } RESOLUTION NO. 33-09 WHEREAS, the Board of Commissioners approved Resolution 27-09 on April 27, 2009 which implemented a mandatory budget reduction for the balance of 2009 including the use of a shortened workweek or furlough (days without pay) days for employees of various County departments; and WHEREAS, in some departments employees have voluntarily agreed to take furlough days instead of a shortened workweek to maintain department functions in the most effective and efficient manner and the Departmental Director of such department will monitor the use of such days each month to meet the needs of the department; and WHEREAS, in 2009 seven of the ten federal holidays when most County offices are closed fall in the period of this declared budgetary emergency; and WHEREAS, employees who have agreed to take furlough days may want to use some of these days to extend their time off around one of these holidays when the County office in which they work is closed; and WHEREAS, the County Personnel Administration Manual adopted in 2003 expressly states in Chapter 6, Section 4.0 - Holidays that "To be paid for a holiday, an employee must be on pay status the scheduled workday immediately preceding and immediately following the holiday"; and WHEREAS, allowing employees the ability to extend their holiday by one day before or after a paid holiday provides a positive impact to this negative situation. NOW, THEREFORE, BE IT RESOLVED by the Board of Jefferson County Commissioners as follows: 1. It is in the best interest ofthe County and its' employees to allow employees who have voluntarily agreed to take days off without pay (furlough days) to use a Resolution No. 33-09 re: Amendment to the Jefferson County Personnel Administration Manual- Chapter 6, Section 4.0 - Holidays furlough day to extend their time off before or after a paid holiday and still be paid for the holiday. ,2, That the attached amendment to Chapter 6, Section 4 is hereby approved and . ,,,,,~ '.~. When a holiday falls on a Sunday, it will be observed the following Monday, If an employee is on an authorized leave with pay when a holiday occurs, the holiday shall be paid and not charged against any accumulated sick or vacation leave, Section 4.3 - Holidays and Overtime Holidays paid for, but not worked, shall be recognized as time worked for determining weekly overtime. Hourly employees who work on holidays shall be paid at the rate of 1 Yz (one-and-one- half) times the regular hourly straight time rate of pay for hours worked, in addition to regular holiday pay, in accordance with Chapter 11, or the employee's collective bargaining agreement. FLSA exempt employees are not entitled to overtime pay, Section 4.4 - Holidays and Non-standard Workweeks 4.4.1 Continuous Operations: County services that operate 24 (twenty four) hours a day and 7 (seven) days a week may implement alternative holiday observance and compensation systems, with approval of the County Administrator. 4.4.2 Alternate Work Schedules: County DepartmentslDivisions that operate on a non-standard workweek will determine how holidays will be taken by mutual agreement with their Adoptedl December 2003 Revisedl September 2007 (Res. 82-07) Chapter 6 Jefferson County Personnel Administration Manual tracking all individual employee Catastrophic Sick Leave Bank balances. Section 3.9 -- Additional "Non-Accruable" PTO Days In addition to B above the accrual chart in Section 3.4 the following non-accruable PTO days will be available to employees on the PTO System as follows: Montbs of Montbs Non-Accruable PTO Days Employment (converted to Per Calendar Year (based vears) on FTE) 0-36** 0-2 1 37-60 3-4 1 61-120 5-9 2 121-180 10-14 2 181 + 16+ 3 The additional days available pursuant to this section shall be treated as floating holidays for the purpose of accruals (i.e, shall not be carried forward from one year to the next or be payable upon termination. ) Section 4.0 - Holidays Qualified regular employees shall be entitled to the paid holidays specified by the Board of County Commissioners, To be paid for a holiday, an employee must be on pay status the scheduled workday immediately preceding and immediately following the holiday, Employees are entitled to 10 (ten) specified holidays and 1 (one) floating holiday as specified on the next page. Description -- A brief description of the agenda item. A Resolution to update the Persounel Administration Manual section on Paid Holidays. Chapter 6, Section 4.0 of the Jefferson County Personnel Manual states that "To be paid for a holiday, an employee must be on pay status the scheduled workday immediately preceding and immediately following the holiday," II. Issues -- A short outline of the major issues or areas that should be given particular attention. Some employees are taking "furlough" days (without pay) for their department to meet the declared budgetary emergency for the balance of 2009 and would like to take that day before or after a regularly paid holiday, but this section of the Personnel Manual would preclude that possibility. This resolution adopts an amendment to Chapter 6, Section 4 which will allow employees to do this without losing their paid holiday. III. Action -- What is the nature of the action the Board is being asked to take (discussion, approval of a contract, support for a grant, etc.). Approve this resolution amending Chapter 6 on the Personnel Administration Manual which will allow employees to use their mandated days off without pay to extend a holiday weekend without losing the holiday pay, v. You may also want to express the department's position or recommendation. Suggested wording for the motion (a motion to approve/adopt/accept and a motion to deny/remand) would help especially if there are specific items or wording that needs to be covered in the motion.
