HomeMy WebLinkAbout037 09 STATE OF WASHINGTON County of Jefferson Dedication of Conservation Futures Funds to the } Tarboo Wildlife Preserve East Side Addition Project} as Authorized by 84.34 RCW and in Accordance } with Ordinance No. 06-0708-02 to Provide a System} of Public Open Spaces } RESOLUTION NO. 37-09 WHEREAS, conservation futures tax levy collections, authorized under RCW 84.34.230 are an important means of retaining community character and accomplishing open space policies and objectives ofthe Jefferson County Comprehensive Plan that encourage the coordinated acquisition of key open space lands for long term protection, WHEREAS, Jefferson County is authorized by RCW 84.34.210 and 84.34.220 to acquire open space land, agricultural and timber lands, as defined in RCW 84.34.220, WHEREAS, the Conservation Futures Citizen Advisory Board has reviewed project applications for 2009 and made its funding recommendations to the Board of County Commissioners in accordance with Ordinance No. 06-0708-02, WHEREAS, under the provisions of the Jefferson County Conservation Futures Program, the Northwest Watershed Institute as project applicant and the Jefferson Land Trust as sponsor, request funding towards the acquisition of a conservation easement in perpetuity on ten acres of open space land in Sec. 28, T. 28N., R. 1 W with Assessor's Parcel Numbers 801283012 and 801283010, WHEREAS, the County retains enough developable land to accommodate the Tarboo Wildlife Preserve East Side Addition Project as well as the housing and employment growth that it is expected to receive, thus satisfYing the requirements of Chapter 449, Laws of 2005, and WHEREAS, Jefferson County considers it in the best public interest to contribute to this acquisition project. NOW, THEREFORE BE IT RESOLVED. that: 1. Jefferson County hereby dedicates up to $50,000 in conservation futures funds to reimburse the Tarboo Wildlife Preserve East Side Addition Project for acquisition expenses contingent on a matching contribution of no less than the amount of conservation futures funds requested. 2. Jefferson County hereby dedicates up to $ 0 in conservation futures funds to reimburse the Tarboo Wildlife Preserve East Side Addition Project for operations and maintenance expenses incurred within ten years of the signing of this resolution contingent on a matching contribution of no less than the amount of conservation futures funds requested. This dedication of funding may be nullified if a submittal for reimbursement, accompanied by documentation of matching funds sufficient to complete the acquisition, is not received from the sponsor within three years of the signing of this resolution. -- .-- '&. Acquire a conservation easement for a 10-acre addition to the Tarboo Wildlife Preserve that protects naturally regenerated forest for restoration forestry purposes, wetland buffer, protection of tributary streams to Tarboo Creek, and reduction of traffic and impacts on an existing easement road that crosses the existing Tarboo Wildlife Preserve. 11. Estimate the total site acquisition costs below, including the cost for the entire property or property right, even if Conservation Futures funds will only cover a portion of that total cost. In the case of projects involving multiple acquisitions, please break out appraisals and estimated acquisition costs by parcel. JLT has extensive experience managing conservation easements in Jefferson County. NWI has extensive experience conducting and maintaining restoration projects in the Tarboo watershed and other areas of Oregon and Washington. 15. Has the sponsor and/or applicant of this project been involved in other projects previously approved for Conservation Futures funding? a. No, neither the sponsor nor applicant has been involved in a project previously approved for Conservation Futures funds. b._ X _ Yes, the sponsor and/or applicant for this project has been involved in a project previously approved for Conservation Futures funds. Please provide details: NWI has applied for the following projects - East Fork Tarboo Creek (two conservation easements on 68 acres) - completed Tarboo Creek Conservation (24 acres) - completed with other funding Upper Tarboo Creek - (to be completed by June 2009) JL T has applied for many other JCCF projects that have been successfully completed 16a. Please describe below, and describe how the proposed acquisition is consistent with the plan. _is a stand-alone project. The project is a small, but important part of the Tarboo Watershed Conservation program, a community conservation effort started in 2001. A major objective ofthis watershed conservation effort is to protect a riparian and wetland corridor from the headwaters of Tarboo Creek to Tarboo-Dabob Bay. The proposed project will reduce potential traffic on the access road across the valley and protect wetland buffers and wildlife corridors. 5 18. List the important milestones for this project. Conservation Easement and. management plan written and approved, CE purchased by September 1, 2009. 19. Conservation Opportunity or Threat: a. The proposed acquisition site X does _does not provide a conservation or preservation opportunity which would otherwise be lost or threatened. b. If applicable, please carefully describe the nature and immediacy of the opportunity or threat, and any unique qualities about the site. There is a high risk. The proposed 10 acres could be clearcut, cleared and two residential sites constructed. This would destroy older naturally regenerated forest, risk impacting South Creek that runs through one property, damage a wildlife corridor from the Tarboo valley to the upland hills, and impact forested wetland buffer. In addition, this would increase traffic and wildlife disturbance along the access easement road that runs across the Tarboo Wildlife Preserve. NWI purchased the properties with a loan that needs to be repaid in 2009. Without funding for conservation, NWI may be forced to re-sale the properties to pay the loan. 20. Describe the physical characteristics of the site that is proposed for acquisition with Conservation Futures Program funds including: vegetation, topography, surrounding land use, and relationship to parks, trails, and open space. Forested slopes adjacent to wetlands of the Tarboo Wildlife Preserve. South Creek, a tributary to Tarboo Creek, runs through one property. The two lots proposed for protection are part of only eight lots on the east side of the valley. 21. The proposed acquisition X provides habitat for State of Washington Priority Habitat or Federal Threatened, Endangered, or Sensitive Species X provides habitat for a variety of native flora or fauna species. X contributes to an existing or future wildlife corridor or migration route. If affirmative in any of the above, please describe below, and cite or provide documentation of species' use. Western toads and pileated woodpeckers use this area. Steelhead, listed as threatened, historically occurred in Tarboo Creek and tributaries aud may occur in South Creek. 22a. Describe the extent and nature of current and planned agricultural use of the proposed acquisition, including any anticipated changes to that use once the property, or property right, is acquired with Conservation Futures funds. None 6 b. Describe any participation by current property owner in any other agricultural land conservation programs, including the program and nature of the involvement. NWI is in the CREP program that pays for planting trees in riparian areas and the NRCS Restoration Cost Share program that is funding restoration of 120 acres of wetlands. 23. Describe the use planned for the site, any development plans after acquisition, characteristics of the site which demonstrate that it is well-suited to the proposed use, and plans for any habitable buildings currently on the site. The proposed properties will be added to the Tarboo Wildlife Preserve and will be an important addition for use of educational tours and field trips. 24a. Proposed acquisition site and any subsequent planned passive development (as described above) X is _is not part of a larger project. b. If applicable, describe how the site relates to the larger project, and whether the project has a plan, schedule and funding dedicated to its completion. Yes, the proposed project is critical for long term integrity of protection and restoration of the 300-acre Tarboo Wildlife Preserve by eliminating the development threat in an "inholding". 25. Describe how the proposed acquisition benefits primarily a _local area X broad county area including the area served, the nature ofthe benefit, the jurisdictions involved, and the populations served The project is as integral part of the larger Tarboo Wildlife Preserve, which has statewide and national benefits for protecting an extensive valley floodplain wetlands and over 20-at risk wildlife species, including salmon, that depend in clean water, wetlands, and streams. 26. Describe the educational or interpretive opportunities that exist for providing public access, educational or interpretive displays (signage, kiosks, etc.) on the proposed site, including any plans to provide those improvements and any plans for public accessibility. The property is part of an existing trail network that is used for guided field tours. The properties will be an important part of the long term plan for environmental education at the Tarboo Wildlife Preserve. 27. The proposed acquisition X includes historic or culturally significant resources and _ is registered with the National Register of Historic Places, or an equivalent program. X is recognized locally has having historic or cultural resources. is adjacent to and provides a buffer for a historic or cultural site. 7 If affirmative in any of the above, please describe below, and cite or provide documentation of the historical or cultural resources. Naturally regenerated Native forest has Native American cnltural importance that dates back nearly 10,000 years. Important cnltural resources include cedar trees and a variety of plant and animals. 28a. Describe the extent and nature of current and planned silvicultural use ofthe proposed acquisition. Please cite or provide documentation of existing or planned si/vicultural activities includingforest management plan(s). The property will be managed to restore old growth forest stand structure and habitat through restoration forestry methods and under a forest management plan to be developed as part of the conservation easement. b. Describe any participation by current property owner in silviculture conservation programs, including the program and nature ofthe involvement. NWI has discussed FSC certified forestry certification for the Tarboo Wildlife Preserve as a whole and will be completing that process over the next several years. 29. Sponsors of applications that are approved for funding by the Board of County Commissioners are required to submit a brief progress report by October 30 every year for three years after the award is approved, or three years after the acquisition funds are disbursed to the applicant, whichever is later. The progress report must address any changes in the project focus or purpose, progress in obtaining matching funding, and stewardship and maintenance. Sponsors receiving O&M funds will also submit an annual report for each year that O&M funds are expended. The Committee will use the information to develop a project "report card" that will be submitted annually to the Board of County Commissioners. Ifthis application is approved for funding, I understand the sponsor is required to submit prog)~reports for three years and for any year in which O&M funds are expended. PB ... The Jefferson County Comprehensive Plan identifies goals and policies for the preservation and enhancement of open space. Open Space Goal (OSG) 1.0 guides Jefferson County to preserve and enhance the existing open space lands, and Open Space Policy (OSP)1.5 encourages the pursuit of public acquisition of potential parks, critical wildlife areas, and other open space lands by utilizing a variety of funding mechanisms. Recommendation: Based upon the preceding findings, the Department of Community Development believes proposed acquisitions would not significantly reduce the Jefferson County's capacity to accommodate planned growth and Jefferson County would retain enough development land to accommodate the housing and employment growth that it is expected to receive. Three project applications were submitted to the CF Committee this year. Two of these are outside of the City.of Port Townsend. On May 11, 2009 the BoCC approved a Public Hearing Notice for the Conservation Futures Program project applications for 2009. The notice was published on May 20 and May 27, 2009. Staff requests that the BOCC hold a public hearing on June 8, 2009, as scheduled, at 10:15 AM. ANALYSIS/STRATEGIC GOALS: Three applications for funding were received in 2009 and a total of $270,000 requested to support open space projects in Jefferson County. The three applications are: 1. Brown Dairy Project, $82,500 towards the purchase of a perpetual conservation easement on 50 acres at 9165 Rhody Drive in Chimacum. This sum includes $5,000 in operation and maintenance costs. Proposed match would be state or federal grants and cash contributions. Jefferson Land Trust is the applicant and sponsor. Project location: Sec. 14, T. 29N, R.1W. Project location: Sec. 33, T. 31N, R. 1W. . 3. Tarboo Wildlife Preserve East Side Addition, $50,000 towards the purchase of a perpetual conservation easement on 10 acres east of 2151 Dabob Road in the Tarboo Valley north of Quilcene. No operation and maintenance funds are requested. Proposed match would be a contribution from Northwest Watershed Institute and a National Coastal grant. The Northwest Watershed Institute is the applicant. Jefferson Land Trust is the sponsor. Project location: Sec. 28, T. 28N., R. 1W. After the Public Hearing, the BOCC may determine which project(s) will be awarded conservation futures funding in 2009. When approving any of the projects for funding, a factual finding is necessary in order to meet the requirements of Chapter 449, Laws of 2005. The BoCC is asked to consider whether, despite the approved purchases, the County would still retain enough "developable" land to accommodate the housing and employment growth that it is expected to receive (Ref D. Draft resolutions for each of the proposed projects with the award amounts left blank The purpose of the CF Ordinance is to address the "general and increasing need to prOVide a system of public open spaces...for the health, welfare, benefit and safety of the residents of Jefferson County," and to maintain "Jefferson County as a desirable place to live, visit and locate businesses." Conservation futures tax levy collections, authorized under RCW 84.34.230 are an important means of retaining community character and accomplishing open space policies and objectives of the Jefferson County Comprehensive Plan. II On January 3, 2006, the BOCC approved Ordinance No. 01-0103-06 in response to Chapter 449 of that year which allowed up to 15% of the conservation future levy monies raised in the preceding year to be used for operations and maintenance. Operations and maintenance funding may be used for any property acquired with. conservation futures funds. Chapter 449 also states that local governments must consider and analyze whether new CF projects would reduce capacity to accommodate planned growth. In the accompanying correspondence, the Department of Community Development and the City of Port Townsend recommend that the proposed acquisitions not be found to reduce the County's capacity to accommodate growth. FISCAL IMPACT: The explicit purpose of the Conservation Futures Program is to fund acquisition projects to support a system of public open spaces. There is no impact to the General Fund for this effort. The current balance in the Conservation Futures Fund is $730,284. Subtracting anticipated expenses leaves $275,000 to fund projects in 2009. Of this amount no more than $36,000 may be allocated to reimburse operations and maintenance expenses. RECOMMENDATION: In accordance with the Conservation Futures Ordinance, and to facilitate a timely public process, JCPH Management recommends that the BOCC hold a public hearing on June 8, 2009, at 10:15 AM. After the hearing, the BoCC may decide which project(s) to fund for 2009 and make a factual finding for each project as to whether it would reduce the County's capacity to accommodate growth. Draft resolutions accompany this request with the award amounts left blank. If the BoCC would like to leverage conservation futures funding for the Brown Dairy Project with matching state funds from the Recreation and Conservation Office Farmland Program this year, it is necessary make a funding determination for Brown Dairy today.
