While we don't normally respond to public comment, you participated as a member of the Shoreline Policy
Advisory Committee and so I wanted to provide you some clarifying information. The upper reaches of
Chimacum Creek have been included in SMP jurisdiction based on the 1998 USGS data recommended by
Ecology. This is described in Chapter 1 text, Table 1-1, Chapter 4 text, and Appendix C Map 1A of the November
'08 Final Shoreline Inventory & Characterization Report.

Regarding comments on the proposed Shoreline Management Plan it has come to my
attention that the shoreline jurisdiction on Chimacum Cr. has been moved upstream from the
previous upper extent of regulation. According to WAC 173-18-040 Streams and Rivers
"streams which constitute shorelines" are "(a) Western Washington. Streams in Western
Washington from the point at which the stream reaches a mean annual flow of twenty cubic
feet per second down to the mouth of said stream or river: Provided, that the stream falls at
said point, within the jurisdiction of chapter 90.58 RCW. "

In the 1950's US Geological Service (USGS) had a flow monitoring gage near tHe proposed
upper extent of shorelines jurisdiction. Attached is data from that stream gage. During
the years it was active the data indicated a mean annual flow of 15.3 cfs (water years 1952/53
to 1956/57). Of the 5 years recorded the range was 11.2 to 21.8 cfs with only 1 year that the
flow exceeded 20 cfs. It would seem that moving the shorelines jurisdiction upstream does
not meet the criteria stated in the WAC.
