Of course, one expects the Dept of Ecology to err on the side of environmental protection; but their Regulations and SMP Guidelines are way out of line and basically draconian. There is absolutely nothing in RCW 90.58 that suggests that a "No Net Loss" policy is appropriate. RCW 90.58 only requires that there be "minimal environmental damage" and that projects with "significant irreversible damage to the environment" not be approved. There is nothing in RCW 90.58 that even remotely suggest that "geological hazards" be part of the SMP. Further, the Critical Area ordinance already covers geological hazards and the State Supreme court has decreed that two ordinances shall not cover the same thing. What about Private Property Rights? Just because someone has not developed their shoreline property, is no reason to give it a Natural Designation. What about the costs verses the potential environmental benefits? No where in this process has anyone been required to or ever considered evaluating the cost of these regulations to the county and property owner. Shouldn't the County buy up shoreline property it wants to keep natural, rather then confiscating our property? In denying me the ability to access the beach side of my property, is the County going to provided near-by public beach access for my neighborhood? The proposed 400% increase in use of the Natural Shoreline Designation in the County is gross over kill. Property zoned with Rural I home on 5 acres should have its shoreline designated as Shoreline Residential. It shouldn't be designated Natural unless there is some compelling ecological reason and not just because it has a geologically hazardous bluff. In summary, get rid of the "no Net Loss" policy. Remove all references to Geological hazards and unstable bluffs from the SMP and apply the Shoreline Residential designation to all but a few segments of our shoreline.
