THIS AGREEMENT made and entered into this 4th day of May, 1937, by and between the
COlJN'ry OF JEFF'.1l:RSON, acting through its Board of County Commissionel's, party of the
first part, and the PORT OF PORT TOW1{SElfJD, acting through its Port Commission, party
of the second part" witnesseth that,
~T.EP~AS, it has long Bince appeared to the parti~s hereto that the residents of
Marrow~tcne ~~d !ndi~~ Islands are, by reeson ,of gecgre~hy, ~_~ecegaarl1y disorLmln-
atedegainst by reason of lack of facilities to reach the county seat, and
\TIIEREAS, for Dcvoral y~~~ haretofore the party of the seoond part has been opera-
tine a ferry between said islands and the mainland, charging and exacting toll for such
service, and,
VrrrEREAS, the pa.rty of the first part has adopted a new forry route as a part of its
secondary highway system and is flnanclally ready, able and willing to pay the operaUn:j
costs of such ferry, and,
WHEREAS, the party of the oecond part; is w:i.ll:i.ng, and deems 1 t in the public interest'll
to remove the tolls heretofore exacted from such ferry cervice, now,
THEREFORE, IN consideration of the party of the first part ~aying for the entire
cost of the operation of s~id ferry, including maint~~ancc of landings, the party of
the second part, effective April 15, 1937, does hereby agree to remove all tolls from
such ferry service~
IT IS FURTIIER U}IDERSTOOD AND AGREED that the ovrnership in said ferry shall be and
remain in the party of the second part, and the party of the second part shall for all
major repairs ~d upkeep necessary to the continued operation of said ferry, and shall
retain control of all persons workln~ thereon, shall retain the right to fix schedules
and exact tolls fClr unusuB.l service.
THIS agreement may be terminated upon thirty (30) days notice in wr~tinB.
IN WITHESS WIIEl1EOF, the party of the first part has caused this agreement 1;0 bo
signed by the chairman of its Board of Cotmty Crnmnissioners and attested by tho Cle~(
thereof, ~~d the party of the second ~art hae caused the srone to bo siGned by the Pres-
